Dear Mr. Lee:
This letter is in response to your request for a Minor Modification (MMD2005-00022) of the
approved conditional use permit (CUP94-0009) located at 11511 SW Bull Mountain Road,
WCTM 2S110BD, Tax Lot 00100. You have requested a Minor Modification request for
placement of a mobile classroom/storage facility at the Saint James Episcopal Church.
The submitted site plan reflects the current conditions and proposed addition.
Analysis of Modification Request:
Section 18.330.020 C-1 of the Tigard Development Code Site Development Review
chapter, states; "Any modification which is not within the description of a major
modification as provided in Subsection B above shall be considered a minor
modification."
Section 18.330.020 B-2 (a thru h) states that the Director shall determine that a major
modification(s) has resulted if one (1) or more of the changes listed below have been
proposed:
a. A change in land use. The proposal does not propose a change in land use.
Therefore, this criterion does not apply.
b. An 10% increase in dwelling unit density. This request does not involve a
residential development. Therefore, this criterion does not apply.
c. A change in the type and/or location of access ways and parking areas
where off-site traffic would be affected. The proposed Minor Modification
request for placement of a mobile classroom/storage facility would not require
additional parking beyond the 67 parking spaces currently existing (3
handicapped). The original approval for CUP94-0009 calculated a parking
requirement of 47 spaces based upon the seating capacity of the sanctuary
(occupancy 188). Table 18.765.2 of the Tigard Community Development Code
specifies Minimum and Maximum Required Off-street Vehicle and Bicycle
Parking Requirements for religious institutions and schools. The proposed
portable classroom would have seating capacity for approximately 30 persons
generating a requirement for an additional ten (10) parking spaces and a total of
57 on-site. No off-site traffic impacts are anticipated. Therefore, this criterion
does not apply.

d. An increase in the floor area proposed for non-residential use by more than
10% where previously specified. Although no dimensions were provided on the
un-scaled site plan submitted with the application, the added meeting
room/storage building is calculated to be approximately 1 ,248 square feet. This is
less than three percent (3%) of the square footage of the existing church.
Therefore, this criterion does not apply.
e. A reduction of more than 10% of the area reserved for common open space
and/or usable open space. The proposal will reduce the existing open space
area and usable open space, but does not reduce the landscaped area required
under the CUP94-0009 permit. The reduction in open space would be less than
ten percent (10%). Therefore, this criterion does not apply.
f. A reduction of specified setback requirements by more than 20%. Existing
setbacks are proposed to be maintained at twenty (20) feet along the north and
west property lines and no reduction in setbacks would occur. Therefore, this
criterion does not apply.
g. An elimination of project amenities by more than 10% where previously
specified provided such as: (1) Recreational facilities; (2) Screening; or (3)
Landscaping provisions. The proposal will reduce the existing open space area
and usable open space, but does not reduce the landscaped area required under
the CUP94-0009 permit by more than ten percent (10%). Therefore, this criterion
does not apply.
h. A 10% increase in the approved density. The proposal does not include any
residential development. Therefore, this criterion does not apply.
3. A minor modification shall be approved, approved with conditions, or
denied following the Director's review based on the findings that:
a. The proposed development is in compliance with all applicable
requirements of this title; and
b. The modification is not a major modification as defined in
Subsection 18.330.020 B-2 (a thru h) above.
Therefore, pursuant to Section 18.330.020 C (a & b) of the Tigard Development Code
Conditional Use chapter, the proposed modification is not within the description of a major
modification as provided in section 18.330.020 B-2 (a thru h) and shall be considered a
minor modification.
THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT
SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS
LETTER WITH YOUR BUILDING PERMIT APPLICATION.

1. Should a conflict between the proposed site plan arise that cannot be
satisfactorily resolved in compliance with the conditions of approval for
CUP94-0009, this minor modification request will be invalidated.
This request is determined to be a minor modification to an existing site. The Director's
designee has determined that the proposed minor modification of this existing site will
continue to promote the general welfare of the City and will not be significantly detrimental,
nor injurious to surrounding properties provided that, development which occurs after this
decision complies with all applicable local, state, and federal laws.

Description of Change in Land Use: Placement of a Mobile Classroom at the St.
James Episcopal Church
Narrative:
The congregation of Oriental Mission Church of Oregon,herein after `OMC', has entered
into a lease agreement with the St. James Episcopal Church, herein after `SJEC', in
Tigard, Oregon. As part of the lease agreement, SJEC agreed to allow OMC to move and
place its Modular Classroom currently situated in Beaverton at a previously leased church,
The Mission of Atonement on 7400 S.W. Scholl Ferry Road, Beaverton, OR 97008.
This unit will be located against the Northwest corner of the property, facing east, as
described in the drawing. All the required preparation for setting this unit up will be the
responsibility of OMC including the permits for the temporary use, electricity hookup,
moving and setup, including the handicapped access ramp.
This unit will be used primarily for the Youth Group of OMC and for some adult
meetings. OMC will also use portion of the space as its storage of equipment and
supplies. OMC does not anticipate any increased parking space need, nor any increase in
traffic. OMC is planning on creating a graveled pathway from the paved parking area to
the structure to allow access during the rainy season.
Proposed Changes:
a. A change in land use;
OMC and SJEC are requesting an approval for a new conditional use for the
placement of the Modular Classroom described above.
b. An 10% increase in dwelling unit density;
There is no increase in density.
c. A change in the type and/or location of access ways and parking areas where
off-site traffic would be affected;
No change in the type and/or location of access ways and parking areas which
will impact the off-site traffic.
d. An increase in the floor area proposed for non-residential use by more than
10%where previously specified;

18330.010 Purpose
A. Purpose. The purpose of this chapter is to provide standards and procedures under which a
conditional use may be permitted,enlarged or altered if the site is appropriate and if other appropriate
conditions of approval can be met. There are certain uses which due to the nature of the impacts on
surrounding land uses and public facilities require a case-by-case review and analysis.
18330.020 Approval Process Oy 'T2 ‘q.
A. Initial applications. A request for approval for a new conditional use shall be processed as a Type III-
HO procedure, as regulated by Chapter 18.390.050, using approval criteria contained in Section
18.330.030A and subject to other requirements in this chapter.
B. Major modification of approved or existing conditional use.
1. An applicant may request approval of modification to an approved plan by:
a. Providing the Director with five copies of the proposed modified conditional use site plan;
and
b. A narrative addressing the proposed changes as listed in subsection B below.
The Director shall determine that a major modification(s) has resulted if one or more of the
changes listed below have been proposed:
4, A change in land use;
II. An 10%increase in dwelling unit density;
c. A change in the type and/or location of access ways and parking areas where off-site traffic
would be affected;
An increase in the floor area proposed for non-residential use by more than 10% where
previously specified;
of. A reduction of more than 10% of the area reserved for common open space and/or usable

3. Upon the Director determining that the proposed modification to the conditional use plan is a
major modification, the applicant shall submit a new application in accordance with Section
18.390.050.
C. Minor modification of approved or existing conditional use.
1. Any modification which is not within the description of a major modification as provided in
Subsection B above shall be considered a minor modification.
2. An applicant may request approval of a minor modification by means of a Type I procedure, as
regulated by Section 18390.040,using approval criteria in Subsection C3 below.
3. A minor modification shall be approved, approved with conditions, or denied following the
Director's review based on the findings that:
a. The proposed development is in compliance with all applicable requirements of this title;and
b. The modification is not a major modification as defined in Subsection A above.
D. Phased development approval. As part of the approval process,the Hearings Officer shall approve a
time schedule for developing a site in phases over a period of time of one year, but in no case shall
the total time period for all phases be greater than three years without reapplying for conditional use
review. The criteria for approving a phased conditional use review proposal is that all of the
following are satisfied:
1. The public facilities shall be constructed in conjunction with or prior to each phase.
2. The development and occupancy of any phase shall not be dependent on the use of temporary
public facilities. A temporary public facility is any facility not constructed to the applicable City
or district standard.
3. The phased development shall not result in requiring the City or other property owners to
construct public facilities that were required as part of the approved development proposal.
18330_030 Approval Standards and Conditions of Approval
A. Approval standards. The Hearings Officer shall approve, approve with conditions, or deny an
application for a conditional use or to enlarge or alter a conditional use based on findings of fact with
respect to each of the following criteria:
