You have submitted a Minor Modification request to expand the existing on-site parking capacity at the Tigard Public Library from 104 spaces to 124 spaces.The submitted site plan reflects the current conditions and proposed parking expansion. Analysis of Modification Request: Section 18.330.020.C1 of the Tigard Development Code Conditional Use chapter states, "Any modification which is not within the description of a major modification as provided in Subsection B... shall be considered a minor modification." Subsection B (or section 18.330.020.B.2, a-h) states that the Director shall determine that a major modification has resulted if one or more of the changes listed below have been proposed: a. A change in land use. The applicant does not propose a change in land use. b. An 10% increase in dwelling unit density. The proposed modification does not involve residential development. c. A change in the type and/or location of access ways and arking areas where off-site traffic would be affected. The proposed expansion of the library parking area would not cause a change in the type and/or location of the parking area or access way where off-site traffic would-be affected. The parking area remains in the same location. The extension of Wall Street, which changes the location of the library's access way, is the result of separate land use decisions and not the proposed proect. To provide context, this change in access location would alleviate off-site traffic and already been authorized. Site plans for the Tigard Public Library (CUP2003-00001) as well as the Fanno Pointe Condominiums (SDR2002-00012) to the south of the library were approved with interim accesses to Hall Boulevard that would eventually be replaced b a joint access in the future. The future access required the extension of Wall Street,which City Council authorized on May 9,2006 when it approved a Comprehensive Plan amendment to allow development on identified wetlands. A sensitive lands review was conducted for the Comprehensive Plan amendment to allow the Wall Street extension. d. An increase in the floor area proposed for non-residential use by more than 10% where previously specified. The applicant does not propose to increase the floor area of the library. e. A reduction of more than 10% of the area reserved for common open space and/or usable open space. The proposed project will not reduce the existing open space area and/or usable open space. The parking lot area is on the south side of the site. All common open space and/or usable open space is located on the north and east sides of the site. f. A reduction of specified setback requirements by more than 20%. The applicant does not propose to alter the structure of the building. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities; (2) Screening; or (3) Landscaping provisions. The applicant does not propose to eliminate any recreational facilities on the site. The applicant does not propose to remove existing screening, but is required to provide continuous screening if the parking lot is expanded, which the applicant indicates in its narrative and planting plan. Currently,eighty-one percent (360,000 square feet) of the site is landscaped. The proposed modification eliminates existing landscaping by approximately 2% (7,040 square feet),which is less than the 10% (36,000 square feet) allowed. h. A 10% increase in the approved density. The proposed modification does not involve residential development. Therefore,the proposed modification would not affect density. A minor modification shall be approved, approved with conditions or denied following the Director's review based on the findings that: a. The proposed development is in compliance with all applicable requirements of this title; and b. The modification is not a major modification as defined in Subsection 18.330.020 B-2 (a thin h) above. Finding: The proposed modification complies with all applicable requirements of this tide and is not a major modification. THIS MINOR MODIFICATION REQUEST HAS BEEN APPROVED BY THE PLANNING DIVISION, SUBJECT TO THE FOLLOWING CONDITION. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. 1. Approval of this minor modification request has been contingent upon an amendment to the City of Tigard Comprehensive Plan to allow development of identified wetlands on the library site. As part of a separate land use action(CPA2004-00001),City Council approved the required plan amendment on May 9,2006. Therefore,this minor modification is authorized. This request is determined to be a minor modification to an existing.site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that development which occurs after this decision complies with all applicable local, state,and federal laws. The application has been reviewed by Planning and is approvable once you sign it. Please sign as owner so that the application may be submitted for approval. The purpose of the project is to provide twenty additional parking spaces at the library. Development of the library was approved with 104 spaces on-site and an additional 16 spaces shared with City Hall. Since then,the need for additional on-site parking has become evident. The parking lot is proposed to be reconfigured by installing 37 additional spaces and removing 17 spaces as shown on the attached map. Wall Street will be extended as required to accommodate the reconfigured parking lot and will provide 10 additional on-street parking spaces. The staff report for the Library development approval (CUP 03-01) notes that the current driveway onto Hall Boulevard is to be replaced by the extension of Wall Street. This project will provide the extension of Wall Street as anticipated by the development approval. On May 9,2006, City Council will be requested to approve a Comprehensive Plan amendment required for the project. If approved,bids for constructing the library parking expansion and the Wall Street extension will be requested. Construction is expected to be completed this summer. Background: Development of the library was approved with 104 spaces on-site and an additional 16 spaces shared with City Hall. Since then, the need for additional on-site parking has become evident. All available off-site parking is on the opposi e ide of Hall Boulevard. The parking lot is proposed to be reconfigured by installing,2-9ditional spaces and removing paces as shown on the attached map. Wall Street will be extended as required to accommodate the reconfigured parking lot and will provide 10 additional parking spaces. The CUP 03-01 staff report notes that the current driveway onto Hall Boulevard is to be replaced by the extension of Wall Street which will also serve the Fanno Pointe Condominiums, SDR 02-12, development to the south. Similarly, SDR 02-12 notes that once Wall Street is extended, the temporary access to Hall Boulevard will be closed and a new access will be established at Wall Street. This request will allow the extension of Wall Street as anticipated by these development approvals. Access from the Library and Fanno Pointe Condominiums to Wall Street will create an intersection adequately spaced from Hall Boulevard. Procedure: Type I Approval Criteria: TDC at 18.330.020 C.3.a.,b. The TDC at 18.330.020 C.3.a. requires proposed development is in compliance with all applicable requirements of the TDC. Response: The proposed parking will be provided with striping and wheel stops as required by the TDC Chapter 18.756 and landscaping in accordance with TDC at 18.745.050E.1.a. The total of 119 spaces is less than the 211 spaces permitted within the Metro Zone B. i,• /5"; oc The TDC at 18.330.020C.3.b. requires a showing that the proposed changes are not a major modification. The TDC at 18.330.020 B.2. provides that a major modification results if one or more of the following changes are proposed. 1. A change in land use; Response: The land use designation will remain Medium Density Residential. 2. A 10% increase in dwelling unit density; Response: No dwelling units are proposed 3. A change in the type and/or location of accessways and parking areas where off-site traffic would be affected; Response: The purpose of the modification is to provide additional on-site parking so that the need for off-site parking is lessened. The parking lot connections to Wall Street for the Library and Fanno Pointe Condominiums will be relocated as required by their respective development approvals. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; Response: No changes to buildings are proposed. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; Response: No changes to open space areas are proposed. 6. A reduction of specified setback requirements by more than 20%; Response: No changes to set back requirements are proposed. 7. An elimination of project amenities below by more than 10% where previously specified such as: a. Recreational facilities; Response: No changes to recreational facilities are proposed. b. Screening; and/or Response: No changes to existing screening are proposed. The proposed additional parking will require screening as required by the CDC at 18.745.050(E)(1)(a). c. Landscaping provisions. Response: Currently, 81% of the site or 360,000 square feet is landscaped. The proposed parking, regardless of the option selected, will eliminate far less than the 36,000 square feet allowed for a minor partition. 8. Background: Development of the library was approved with 104 spaces on-site and an additional 16 spaces shared with City Hall. Since then, the need for additional on-site parking has become evident. All available off-site parking is on the opposite side of Hall Boulevard. The parking lot is proposed to be reconfigured by installing 29 additional spaces and removing 14 spaces as shown on the attached map. Wall Street will be extended as required to accommodate the reconfigured parking lot and will provide 10 additional parking spaces. The CUP 03-01 staff report notes that the current driveway onto Hall Boulevard is to be replaced by the extension of Wall Street which will also serve the Fanno Pointe Condominiums, SDR 02-12, development to the south. Similarly, SDR 02-12 notes that once Wall Street is extended, the temporary access to Hall Boulevard will be closed and a new access will be established at Wall Street. This request will allow the extension of Wall Street as anticipated by these development approvals. Access from the Library and Fanno Pointe Condominiums to Wall Street will create an intersection adequately spaced from Hall Boulevard. Procedure: Type I Approval Criteria: TDC at 18.330.020 C.3.a.,b. The TDC at 18.330.020 C.3.a. requires proposed development is in compliance with all applicable requirements of the TDC. Response: The proposed parking will be provided with striping and wheel stops as required by the TDC Chapter 18.756 and landscaping in accordance with TDC at 18.745.050E.1.a. The total of 119 spaces is less than the 211 spaces permitted within the Metro Zone B. The TDC at 18.330.020C.3.b. requires a showing that the proposed changes are not a major modification. The TDC at 18.330.020 B.2. provides that a major modification results if one or more of the following changes are proposed. 1 . A change in land use; Response: The land use designation will remain Medium Density Residential. 2. A 10% increase in dwelling unit density; Response: No dwelling units are proposed 3. A change in the type and/or location of accessways and parking areas where off-site traffic would be affected; Response: The purpose of the modification is to provide additional on-site parking so that the need for off-site parking is lessened. The parking lot connections to Wall Street for the Library and Fanno Pointe Condominiums will be relocated as required by their respective development approvals. 4. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; Response: No changes to buildings are proposed. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; Response: No changes to open space areas are proposed. 6. A reduction of specified setback requirements by more than 20%; Response: No changes to set back requirements are proposed. 7. You have submitted a Minor Modification request for expanding the existing on-site parking capacity at the Tigard City Library from 104 to 119. The submitted site plan reflects the current conditions and proposed parking expansion. Analysis of Modification Request: Section 18.330.020 C-1 of the Tigard Development Code Site Development Review chapter, states; "Any modification which is not within the description of a major modification as provided in Subsection B above shall be considered a minor modification." Section 18.330.020 B-2 (a thru h) states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: a. A change in land use. The proposal does not propose a change in land use. Therefore, this criterion does not apply. b. An 10% increase in dwelling unit density. This request does not involve a residential development. Therefore, this criterion does not apply. c. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected. The proposed Minor Modification request for expanding the existing on-site parking capacity at the Tigard City Library would not result in a change from the original approval for CUP2003- 00001. The Tigard Library and the Fanno Pointe Condominiums project adjoining to the south (SDR2002-00012) were approved with separate interim accesses to Hall Boulevard. These land use approvals included the future access locations submitted with the minor modification application. No off-site traffic impacts are anticipated. Therefore, this criterion does not apply. No structure additions to the existing library are proposed with this application. Therefore, this criterion does not apply. e. A reduction of more than 10% of the area reserved for common open space and/or usable open space. The proposal will reduce the existing open space area and usable open space, but does not reduce the landscaped area required under the CUP2003-00001 permit approval. The reduction in open space would be less than ten percent (10%). Therefore, this criterion does not apply. f. A reduction of specified setback requirements by more than 20%. No structure additions to the existing library are proposed with this application. Therefore, this criterion does not apply. g. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities; (2) Screening; or (3) Landscaping provisions. The proposal represents no change in the landscaped area required under the CUP2003-00001. Therefore, this criterion does not apply. h. A 10% increase in the approved density. The proposal does not include any residential development. Therefore, this criterion does not apply. 3. A minor modification shall be approved, approved with conditions, or denied following the Director's review based on the findings that: a. The proposed development is in compliance with all applicable requirements of this title; and b. The modification is not a major modification as defined in Subsection 18.330.020 B-2 (a thru h) above. Therefore, pursuant to Section 18.330.020 C (a & b) of the Tigard Development Code Conditional Use chapter, the proposed modification is not within the description of a major modification as provided in section 18.330.020 B-2 (a thru h) and shall be considered a minor modification. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. 1. The construction of the Phase 1 Wall Street extension and the driveways to the Tigard Library and the Fanno Pointe Condominiums will require a Comprehensive Plan amendment to allow grading and filling within identified wetlands and associated buffers. Prior to the construction of the Phase 1 Wall Street extension the approval of the Comprehensive Plan amendment will be required.
