CITY OF TIGARD September 12,2006 OREGON Teri Swift 5144 SE Monroe St. Milwaukie, OR 97222 RE: Morning Rush,Minor Modification Request, Case File No.MMD2006-00012 Dear Ms.Swift: This letter is in response to your request for a Minor Modification (MMD2006-00012) of the approved Hudson Plaza site development plan (SDR 36-78) located at 12910 SW Pacific Hwy, WCFM 2S102BD, Tax Lot 1900. You have requested to place a prefabricated 8'x 20'building on site that will be used as a drive-thru coffee shop. The concrete slab was already approved through a Minor Modification (MMD2006-00010). That�appplication requested construction of another small building to house environmental clean-up equipment and modification of the current parking lot layout. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter,states;"any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore,this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable,as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed building is a drive-thru coffee shop,so customers driving to the site will utilize the drive.up window. An additional window is available to service customers that will walk from neighboring businesses and the nearby Tri-met bus stop. The design of the building as a drive-up facility will not require additional parking. Therefore,this criterion is not applicable. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the buildings is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to the existing buildings. A change in the type and location of accessways and parking areas where off-site traffic would be affected. There are no changes proposed to the existing accessways or parking areas. The drive-up window is accessed by a one-way traffic aisle. The aisle is 18 feet wide at the narrowest spot which would still allow cars to pass those being served. Stacking area is sufficient on-site to have no affect on off-site traffic. This standard is satisfied. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. Expected additional vehicle trips will not exceed 100 vehicles per day. This is based upon information gathered from other espresso owners, research on coffee businesses, and supply vendors. The majority of the traffic will be generated during the morning rush hours and proposed hours of operation are from 5:30 a.m.to 12:30 p.m. Average vehicle counts used for supply ratios are based on 10 vehicles per hour. The expected increase in traffic will only be approximately 70 vehicle trips. Therefore,this criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The pre-fabricated building is only 160 square feet; therefore this standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten ercent. There are no areas reserved for common open space within this development. This standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. No changes are proposed to the project amenities with this application. The building will be placed on a new concrete slab previously approved through minor modification MMD2006-00010. Therefore this criterion is satisfied. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The original site plan was approved under SDR 36-78. Staff recommendations from the decision had to do with inadequacy of the proposed landscape/street trees along Walnut Place and parking lot screening. The existing street trees are being replaced as a condition of approval of minor modification MMD2006- 00010. This proposal has no effect on previously issued conditions of approval for the minor modification or site development review. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injunous to surrounding properties, provided that development which occurs after decision complies with all applicable local,state,and federal laws This request for Minor Modification approval is hereby granted. The coffee shop will produce espresso drinks with other snack type foods for sale to operate in the morning hours not a full food menu and operate only in the morning hours(tentatively 5:30AM to 12:30PM)and be operating seven days a week. The NEW 8-foot by 20-foot moveable prefabricated structure is to be moved to the site, located on Tax Lot 1900, placed on a concrete pad (to be provided by the property owner) as shown on Site Location Map Figure 1. 455.010 Definitions for ORS chapter 455 (6) "Prefabricated structure"means a building or subassembly that has been in whole or substantial part manufactured or assembled using closed construction at an off-site location to be wholly or partially assembled on-site. "Prefabricated structure" does not include a manufactured dwelling, recreational structure or recreational vehicle, as those terms are defined in ORS 446.003. To provide entry and egress of traffic, cars will be routed as shown on Traffic Flow and Site Layout Figure 2 to allow for the easy flow off of Pacific Highway to the site and to return back to the traffic flow at the light or through egress on the western and northern entrances existing at the property. The coffee shop is a prefabricated relocatable structure (8 foot x 20 foot) constructed by C&M Manufacturing of Portland, Oregon. The structure was built and inspected to meet the State of Oregon Prefabricated Structure, Department of Consumer & Business Services, Building Code Division (plan number M4o1-3923D-P). The building will be placed as shown on the Site Plan with service for traffic to be on the western face of the building and walk-up service on the southeast side of the building. All electrical and plumbing connections to the new removable prefabricated structure will be performed by Oregon Board Contractors-licensed contractors with permits and inspections provided by said contractors as part of service on the project. A change in the type and location of access ways and parking areas where off-site traffic would be affected; D There are no proposed changes for type and location of access ways. 7.An increase in vehicular traffic to and from the site and the increase can be expected to exceed loo vehicles per day; D From speaking with other espresso owners, research on coffee businesses, and coffee supply vendors the expected traffic through the drive up portion of the business would not exceed the 100 car per day number. The majority of the vehicle traffic through the drive through portion of the business is expected to be in the early morning hours and not at afternoon rush hours. The traffic will be generated from two access/egress points on the property from two separate streets and controlled by an electronic traffic signal. The average vehicle count used for supply ratio is expected to be 10 vehicles per hour.
