Garden Place, WCIM 2S101BB, Tax Lot 1400. You have requested to the use of the site, from office to motor vehicle sales. AAA Oregon Autosource, LLC,will be the new tenant. The proposed use will occupy Building 3 and is permitted in a GG zone. No exterior changes to the building are proposed. The submitted site plan reflects the current and proposed conditions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. . 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The parking required for the proposed use at the subject property is calculated below using Table 18.765.2 of the Tigard Development Code. 2,927 sq. ft. for sales X 1 parking space per 1,000 sq.ft. =3 Spaces 1,628 sq. ft. for office X 2.7 parking spaces per 1,000 sq. ft. =4 Spaces Total Spaces Required for Proposed Use 7 Spaces 4,555 sq.ft.for office X 2.7 parking spaces per 1,000 sq. ft. = 13 Spaces Total Spaces Required for Previous Use 13 Spaces As shown above,the proposed use does not require more off-street parking than the previous use. In addition,the applicant has indicated the site would provide 14 parking spaces for the proposed tenant. Therefore, the proposed modification does not cause a change requiring additional on-site parking and there is an excess of arking spaces. The applicant is hereby notified that using required parking spaces for the outdoor sale of motor vehicles is not permitted. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposed use does not cause a change in the type of commercial or industrial structure as defined by the building code. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. Therefore,this critenon does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal does not include changes to the access points, driveway aisles, or location of parking. Therefore,this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. Staff calculated the weekday average number of vehicle trips for the past and proposed use of the site, using the Institute of Transportation Engineers Trip Generation Manual, 6th edition. The vehicular traffic to and from the proposed site is calculated to decrease from 907 trips per day to 404 trips per day. Therefore,there is no expected increase in traffic from the site. The calculations follow: Previous Use General Office 199 trips per weekday/ 1,000 sq ft*4,555 sq ft = 907 trips per day Proposed Use New Car Sales 27 trips per weekday/ 1,000 sq ft *2,927 sq ft = 80 trips per day General Office 199 trips per weekday/ 1,000 sq ft 1,628 sq ft = 324 trips per day Total 80 +324 =404 trips per day 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area. Therefore,this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to existing landscaping. Therefore,this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing landscaping. Therefore,this criterion does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. There have not been any previous conditions of approval for the use of this site. Therefore,this criterion does not apply.
