JR 97223 April 10,2007 1111 • Chris Bolick Lowe's Home Improvement TI G A R D PO Box 1111 North Wilkesboro,NC 28656 RE:Lowe's Parking Lot Redesign,MMD2006-00014 Dear Mr.Bolick This letter is in response to your request for Minor Modification (M D2006-00014) approval to the original Site Development Review(SDR98-00008) for the Lowe's Home Improvement Warehouse at 12615 SW 72nd Avenue, WGTM 2S101AC, Tax Lots 1801 and 1900. You have requested to modify the main parking area by filling parking spaces and a landscape island with pervious concrete to provide an outdoor space for displaying gardening products. The proposed use, outdoor sales, is permitted in the GG zoning district. In addition, you have proposed to modify the rear parking area by planting additional trees and shrubs in the landscape buffer adjacent to SW Beveland Street. The submitted plans reflect current and proposed conditions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed change does not require additional on-site parking; however, the applicant is removing parking spaces. The applicant roposes to pave over 20 general parking spaces and 4 disabled accessible spaces. An additional p7 general parking spaces will be removed so that the 4 disabled- accessible spaces can be relocated. Therefore, a total of 27 general parking spaces will be removed. While the site has a surplus of at least 100 parking spaces, the applicant is responsible for maintaining the required number of parking spaces per the decision and Development Code Chapter 18.765. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The type of modification proposed does not cause a change in the type of commercial or industrial structure on the site. Therefore,this criterion does not apply. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. Therefore,this critenon does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. As indicated by the plans submitted, the proposal does not include changes to the access points, driveway aisles, or location of parking where off-site traffic would be affected. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. This modification will serve customers in a similar way to existing practice on the site. Therefore,there is no substantial evidence that vehicle trips will increase. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification removes landscaping, but does not increase impervious floor area. Therefore,this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposed modification will reduce total landscaping by not more than 1.6%, as described below,but does not reduce any usable open space areas. Therefore, this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed modification involves replacing a landscape island with pervious concrete. Of the 227,585 square feet of total landscaping, the addition of the pervious concrete in the landscape island would remove at most 1.6% of existing landscaping and add some impervious surface in the location of the old parking spaces. In addition, the applicant proposes to remove 7 trees and replant new trees (Gallery Pear or Hedge Maple) in the same location after laying the pervious concrete. Additional trees and shrubs will also be added to the landscape buffer in the rear parking lot along SW Beveland Street. The proposed modification does not reduce project amenities below the minimum standard or by more than 10% specified in the site plan. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The proposed modification does not conflict with previous conditions of approval for the site,with the exception of using approved parking spaces for outdoor storage. THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNING DIVISION. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION.
