DTI ` STIOAOH0.1,01AT IIVH,L NODMIO 9T000 9003UJAUAT City of Tigard, Oregon - 13125 SW Hall Blvd. • Tigard, OR 97223 November 14,2006 II • • Scott A.Russell T I GARD Oregon Trail Motorcycles,LLC 2891 W 11th Avenue Eugene, OR 97402 RE: Oregon Trail Motorcycles,LLC,Minor Modification Case File # MMD2006-00016 Dear Mr. Russell: This letter is in response to your request for a Minor Modification (MMI)2006-00016) at 12010 and 12020 S.W. Garden Place,WCTM 2S101BB,Tax Lot 1400. You have requested to modify the use of the site, from office to motorcycle sales, to accommodate your motorcycle retail business (dba BMW Motorcycles of Western Oregon). The proposed use will occupy Building 6 and is permitted in a GG zone. No exterior changes to the building are proposed. The submitted site plan reflects the current and proposed conditions. Analysis of Modification Request: Section 18360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore, this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The parking required for the proposed use at the subject property is calculated below using Table 18.765.2 of the Tigard Development Code. 7,962 sq.ft. for sales X 1 parking space per 1,000 sq. ft. = 8 Spaces 4,601 sq. ft. for office X 2.7 parking spaces per 1,000 sq.ft. = 12 Spaces 6,195 sq. ft.for service X 2 parking spaces per 1,000 sq. ft = 12 Spaces 5,000 sq. ft. for clothes/accessories X 3.7 spaces per 1,000 sq. ft. = 19 Spaces Total Spaces Required for Proposed Use 51 Spaces 23,758 sq. ft. for office use X 2.7 spaces per 1,000 sq.ft. = 65 Spaces Total Spaces Required for Previous Use 65 Spaces As shown above, the proposed use does not require more off-street parking than the previous use. In addition, the applicant indicates the site would provide 73 parking spaces for the proposed tenant. Therefore, the proposed modification does not cause a change requiring additional on-site parking and the site has an excess of spaces. The applicant is hereby notified that using required parking spaces for the outdoor sale of motorcycles is not permitted. Page 1 of 3 Phone: 503.639.4171 • Fax: 503.684.7297 • www.tigard-or.gov • TTY Relay: 503.684.2772 4 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposed use does not cause a change in the type of commercial or industrial structure as defined by the building code. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. Therefore, this critenon does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal does not include changes to the access points, driveway aisles, or location of parking. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. Staff calculated the weekday average vehicle trips for the past and proposed use of the subject site, using the Institute of Transportation Engineers Trip Generation Manual, 6th edition. The vehicular traffic to and from the proposed site is calculated to decrease from 4,728 to 1,629 trips per day. Therefore, there is no expected increase in traffic from the site. The calculations are below: Previous Use General Office 199 trips per weekday/ 1,000 sq ft *23,758 sq ft = 4,728 trips per day Proposed Use New Car Sales, includes service 27 trips per weekday/ 1,000 sq ft * 14,157 sq ft = 383 trips per day General Office 199 trips per weekday/ 1,000 sq ft *4,601 sq ft = 916 trips per day Apparel Sales 66 trips per weekday/ 1,000 sq ft *5,000 sq ft = 330 trips per day Total 383 +916 +330 = 1,629 trips per day 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to existing landscaping. Therefore, this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing landscaping. Therefore, this criterion does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. There have not been any previous conditions of approval for the use of this site. Therefore, this criterion does not apply. THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNING DIVISION, SUBJECT TO THE CONDITION BELOW. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. Page 2 of 3 CONDITION OF APPROVAL 1. The applicant is hereby notified that the use of required parking spaces for the outdoor sale of motorcycles is prohibited. This request is determined to be a minor modification to an approved site development plan. The Director's designee has determined that the proposed minor modification of this existing plan will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws. If you need additional information or have any questions, please feel free to call the Current Planning Division at (503) 639-4171 or stop by the Permit Center at 13125 SW Hall Blvd,Tigard,OR 97223.
