Beavercreek Road Oregon City, OR 97045 RE: Clearwire US,LLC Minor Modification/MMD2007-00009 Dear Ms.Bennett: This letter is in response to your request for Minor Modification(IvIMD2007-00009) approval to the Clean Water Services site. You have proposed to be the fourth provider to collocate antennas on the roof of the Clean Water Services building at 16580 SW 85th Avenue,WCTM 2S113B0,Tax Lot 600. The proposed use is permitted in an I-P zone. The submitted site plan reflects the current and proposed conditions. Section 18.798.040.B provides for collocation of antennas on existing non-tower structures in commercial and industrial zones. It states, "Installing an antenna(s) on an existing structure other than a tower, such as a building, water tank, sign, light fixture or utility pole, is permitted outright,so long as the additional antenna(s) are no more than 20 feet higher than the existing structure,no more than three providers are collocating on the structure, and the color of the antenna(s) blends with the existing structure or surroundings." The proposed collocation complies with this provision,except that it will result in more than three providers on the structure. Therefore, a Minor Modification approval per 18.360 is necessary. Clearwire will be the fourth provider collocating on the subject building. The other providers are Verizon (BUP2000-00332), Voice Stream (BUP2001-00050) and Cricket(BUP2006-00385). Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The Code does not require on-site parking for wireless communication facilities and the proposed change does not require additional on-site parking. Therefore,this criterion is met. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The pro-posal does not involve changing the type of commercial or industrial structure of the existing bui.ding or monopole. The new antennas will be located on the roof of the existing building. Therefore,this criterion is met. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the existing building. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal includes no changes to the location of accessways and parking areas. Clearwire US, LLC,will use the existing access from SW 85th Avenue. Therefore,this criterion is met. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The Clearwire US, LLC, facility will generate up to two vehicle vehicles to and from the site per month. Therefore,this criterion is met. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area of the existing building or an increase in the area occupied by the monopole and its accessory equipment. Therefore,this criterion is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to existing common and/or usable open space. Therefore,this criterion is met. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing landscaping. The collocation will be entirely on the roof. Accessory equipment will be contained in the existing 49- square foot lease area on the roof. Therefore,this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The proposal does not conflict with the conditions of approval for the site. Therefore,this criterion is met. THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNING DIVISION. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. This request is determined to be a minor modification to an approved site development plan.
