MMD2007 00003 CLEARWIRE US , LLC City of Tigard, Oregon - 13 12 5 SW Hall Blvd. • Tigaru, OR 97223 January 26,2007 I1 • •Clearwire US,LLC C/o Cheryl Bennett T I G A R D 20422 S.Beavercreek Road Oregon City,OR 97045 RE: Clearwire US,LLC Minor Modification MMD2007-00003 Dear Ms.Bennett: This letter is in response to your request for a Minor Modification (MMD2007-00003) approval to the original Conditional Use (CUP97-00002). You have proposed to collocate antennas on the Global Signal monopole at 12390 SW Scholls Ferry Road, WCTM 1S134BC,Tax Lot 600. The proposed use is permitted in a GG zone. The submitted site plan reflects the current and proposed conditions. Section 18.798.040A provides for collocation of antennas on existing towers in commercial and industrial zones. It states, "Installing an antenna(s) on an existing communication tower of any height is permitted outright,so long as the additional antenna(s) are no more than 20 feet higher than the existing tower,no more than three providers are collocating on the towers, and the color of the antenna(s) blends with the existing structure or surroundings." The proposed collocation complies with this provision for the following reasons: 1) The proposed collocation will not change the height of the existing tower;2) Clearwire will be the third provider collocating on the subject tower, therefore, within the limit. The other providers are a gular (MMD2002-00010) and Sprint PCS (MMD2002-00021); and 3) the color of the new antennas will beoff off-white, the new dishes will be charcoal and the radio boxes will be gray aluminum These colors blend with the existing gray aluminum tower. Therefore,the collocation criteria are met. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The Code does not require on-site parking for wireless communication facilities and the proposed change does not require additional on-site parking. Therefore,this criterion is met. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposal does not involve changing the type of commercial or industrial structure of the existing building or monopole. The new antennas will be located on the existing monopole. Therefore,this criterion is met. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the existing building or monopole. A change in the type and location of accessways and parking areas where off site traffic would be affected. The proposal includes no changes to the location of accessways and parking areas. Clearwire US, LLC, will use the existing access onto SW Scholls Ferry Road. Therefore, this criterion is met.. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The Clearwire US, LLC, facility will generate up to two vehicle vehicles to and from the site per month. Therefore,this criterion is met. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area of the existing building or an increase in the area occupied by the monopole and its accessory equipment. Therefore,this criterion is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to existing common and/or usable open space. Therefore,this criterion is met. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing landscaping. The collocation will be entirely within the approved lease area. Accessory equipment will be contained in the existing 20 x 18 x 3 x 18 foot area for equipment. Therefore,this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The proposal does not conflict with the conditions of approval for CUP97-00002. Therefore,this criterion is met. THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNING DIVISION. PROJECT DESCRIPTION Clearwire US LLC is a wireless provider bringing high-speed internet access to residential and small business customers. Clearwire will provide a complete self- installed bundle of high-speed internet access, local and long distance phone service and in-home networking at a compelling pricepoint for the consumer market. The service is intended to compete with existing high-speed cable, DSL and cellular/PCS voice and data services. Clearwire is in the process of permitting and building numerous sites in the Portland metro area. They are dedicated to building virtually their entire network on existing vertical elements, including monopoles, lattice towers, water tanks, buildings, and power poles. Because the service is wireless, it will be available to areas that currently do not have access to cable or DSL service. Clearwire US LLC is headquartered in Kirkland, Washington. They are currently operating and building networks in a number of states, including Oregon, Washington, Idaho, California, Alaska, and other states in the eastern part of the country. Clearwire US LLC proposes to co-locate its antennas on the Global Signal monopole located at 12398 SW Scholls Ferry Road, Tigard, OR 97224. The associated accessory equipment will be located within an existing 20'x18'xl l'x3'x18' area of the previously approved equipment area(Exhibit A). III. APPLICABLE STANDARDS 18.798 WIRELESS COMMUNICATION FACILITIES 18.798.040 Uses Permitted Outright A. Collocation of antennas(s) on existing towers in commercial and industrial zones. Installing an antenna(s) on an existing communication tower of any height is permitted outright, so long as the additional antenna(s) are no more than 20 feet higher than the existing tower, no more than three providers are collocating on the towers, and the color of the antenna(s) blends with the existing structure or surroundings. Clearwire US LLC is proposing to co-locate antennas on the Global Signal monopole at 12398 SW Scholls Ferry Road, Tigard, OR 97224. The height of the tower will not be increased. The property is zoned C-N Neighborhood Commercial. Therefore, the co- location is a permitted use. Staff determined that the co-location should be reviewed as a Type I Minor Modification. 18.360 SITE DEVELOPMENT REVIEW 18.360.050 Major Modification(s) to Approved Plans or Existing Development A. Determination request An applicant may request approval of a modification to an approved plan or existing development by: 1. Providing the Director with three copies of the proposed modified site development plan; and 2. A narrative which indicates the rationale for the proposed modification addressing the changes listed in subsection B below. The applicant has submitted three copies of the development plan. The narrative addressing the changes is contained in succeeding sections of this report. B. Evaluation criteria. The Director shall determine that a major modification(s) will result if one or more of the following changes are proposed There will be: 1.
