RE:Northview Park Minor Modification MMD2007-00013
Dear Steve:
This letter is in response to your request for approval for a Minor Modification(M D2007-00013) to the original
land use approval (SUB97-00003) at Northview Park Tract "A", WCTM 2S104BB, Tax Lot 8200. You have
requested to modify the site by adding a park shelter. The proposed activity is consistent with the existing open
space use and is,therefore,permitted. The submitted plans reflect the current and proposed conditions.
Analysis of Modification Request:
Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any
modification which is not within the description of a major modification as provided in section 18360.050 shall
be considered a minor modification."
Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1)
or more of the changes listed below have been proposed:
1. An increase in dwelling unit density or lot coverage for residential development. The proposal
does not involve residential development. Therefore,this criterion does not apply.
2. A change in the ratio or number of different types of dwelling units. The proposal does not
involve residential development. Therefore,this criterion does not apply.
3. A change that requires additional on-site parking in accordance with Chapter 18.765. No
parking is required for the open space site. Therefore,this criterion does not apply.
4. A change in the type of commercial or industrial structures as defined by the Uniform
Building Code. There is no existing structure on the site. Therefore,this criterion does not apply.
5. An increase in the height of the building(s) by more than 20 percent. No building exists at
Northview Park. Therefore,this criterion does not apply.
6. A change in the type and location of accessways and parking areas where off-site traffic
would be affected. The proposal does not include changes to the access points, driveway aisles, or
location of parking. Therefore,this criterion does not apply.
7. An increase in vehicular traffic to and from the site and the increase can be expected to
exceed 100 vehicles per day. Northview Park is an open space tract used by neighboring residents
who walk there. The proposed park shelter should not create additional traffic. In addition, there is
no place for vehicles to park for the purpose of using the open space site.
8. An increase in the floor areas proposed for a non-residential use by more than ten percent
excluding expansions under 5,000 square feet. The proposed park shelter is less than 5,000
square feet. In addition, it is considered part of the existing open space. Therefore,this criterion does
not apply.

9. A reduction in the area reserved for common open space and/or usable open space that
reduces the open space area below the minimum required by the code or reduces the open
space areas by more than ten percent. The proposal does not include changes to existing
landscaping. The site is 3.5 acres of landscaping and the shelter is part of the usable open space.
Therefore,the proposed shelter does not reduce common/usable open space.
10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping
provisions) below the minimum established by the code or by more than ten percent where
specified in the site plan. The proposal involves adding an amenity, the picnic shelter. Therefore,
project amenities will not be reduced.
11. A modification to the conditions imposed at the time of Site Development Review approval
that is not the subject of criteria (B). 1 through 10 above this subsection. The proposed park
shelter is not a modification to the conditions imposed at the time of land use approval for the site
(SUB97-00003). Therefore,this criterion does not apply.
THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNING DIVISION.
PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT
APPLICATION.
This request is determined to be a minor modification to an approved site development plan. The Director's
designee has determined that the proposed minor modification of this existing plan will continue to promote the
general welfare of the City and will be significantly detrimental, nor injurious to surrounding properties
provided that, development which occurs after this decision complies with all applicable local, state, and federal
laws.

Design and Construction Standards Resolution and Order No.04-9:
