You have requested to modify the use of the site,from retail sales to retail sales and personal services. The existing tenant on the site is a paint store and the additional new tenant will be a karate studio. The proposed use is permitted in the CBD zone. The 6,267-square foot paint store including storage) will be reduced by 1,280 square feet and an interior wall will be moved to accommodate the addition of the karate studio. No extenor changes are proposed. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The previous use, retail sales, required 17 spaces total (2.7 spaces per 1,000 square feet). The proposed use, retail sales and personal services, requires 17 spaces total- 14 spaces for the reduced paint store and 3 spaces for the karate studio (2.5 spaces per 1,000 square feet at 80% of the requirement for a secondary use). Therefore, the proposed modification does not require additional on-site parking in accordance with Chapter 18.765. In addition, because the building is located on Main Street and is a non-entertainment use, it is exempt from providing additional on-site parking spaces for a change of use (18.765.2,note 3). 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposal does not involve any structural changes. Therefore, the proposed modification does not cause a change in the type of commercial or industrial structure on the site. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. Therefore,this criterion does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal does not include changes to the access points, driveway aisles, or location of parking. Therefore,this criterion does not apply. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The applicant did not provide this information. However, according to the Institute of Transportation Engineers' trip generation manual, a karate studio would generate less vehicle trips than a paint store.1 The Daint store, classified as paint/hardware store in the manual, would generate 321 vehicle trips per weekday, 517 on Saturday and 430 on Sunday for the full 6,267 square feet of lease space. It would generate 256 vehicle trips per weekday, 412 on Saturday and 342 on Sunday for the reduced 4,987 square feet of lease space. The karate studio, classified as specialty retail in the manual, would generate 52 vehicle trips per week day, 54 on Saturday and 26 on Sunday. The reduced-size paint store with the karate studio would generate a total of 308 vehicle trips per weekday, 466 on Saturday and 368 on Sunday. While these numbers may not reflect the actual vehicle trips of the tenants, in theory there will be a reduction in traffic to and from the site based on what is typical for the uses. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area.Therefore,this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to existing landscaping. Therefore,this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing landscaping. Therefore,this criterion does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. There are no previous conditions of approval for the use of this site. Therefore,this criterion does not apply. THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNING DIVISION.
