MMD2007 00006 LITTLE CAESAR' S PIZZA City of Tigard, Oregon 13125 SW Hall Blvd. • Tigaru, OR 97223 February 7,2007 • • .1 Little Caesar's Pizza Attn: Derek Payne T I G A R D 13382 SW Macbeth Drive Tigard,OR 97224 RE:Little Caesar's Pizza Minor Modification (MtvID2007-00006) Dear Mr. Payne: This letter is in response to your request for approval of a Minor Modification (MMD2007-00006) at the Pacific Crossroads Center at 11705 SW Pacific Highway,WCTM 1S136CD,Tax Lot 100. You have requested to modify the use of an existing business space at the Pacific Crossroads Center from a copy center to take-out pizza business. The proposed use (Eating and Drinking Establishment) is permitted in a GG zone. The submitted site and floor plans reflect the current and proposed conditions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed pizza take-out business is classified as an Eating and Drinking Establishment, which requires 9.9 p arking spaces per square feet of business space, or 18 spaces. The previous use was a copy center (classified as Personal Services), which required 2.5 per square feet, or 5 spaces. While the proposed use technically increases the required parking for the existing space,the applicant's floor plan shows that there will be no on-site dining. The business is take-out or delivery only, most of the square footage being a commercial kitchen. It is unlikely there would be 18 customers waiting at the same time. The applicant's floor plan shows four seats in the waiting area. In addition, the tenant's lease agreement allows all businesses within the shopping center equal use of the parking lot. Lastly, a record of building permits shows that there have been previous businesses classified as Eating and Drinking Establishments in spaces that are now less intense uses. Therefore, it is unlikely the proposed change of use will require more parking. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposed modification does not cause a change in the type of commercial or industrial structure per the Oregon Structural Specialty Code. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. Therefore,this cntenon does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal does not include changes to the access points, driveway aisles, or location of parking. Therefore,this criterion does not apply. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposed modification will not generate an increase in vehicular traffic exceeding 100 vehicles per day. Based on estimated average weekly sales figures, the applicant estimates the business will generate the following vehicle trips: Monday through Thursday 65 trips per day Friday and Saturday- 95 trips per day Sunday- 50 trips 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area. Therefore,this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal does not include changes to existing common and/or usable open space. Therefore,this criterion does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing project amenities. Therefore,this criterion does not apply. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The applicants do not propose to modify any of the conditional approvals at the time of Site Development Review approval of this site. Therefore,this criterion does not apply. Tenant shall not install any radio or television antenna, loudspeaker or other devise on the roof or exterior walls of the Space or Center which, in Landlord's reasonable opinion, are inconsistent with the first-class appearance of the Center or which would alter the use of the Space. Tenant shall not interfere with radio or television broadcasting or reception from or in the Center or elsewhere. 7. Tenant may mark, dive nails or screw or drill on or into the partitions, woodwork or plaster of the Space provided that any damage caused thereby shall be repaired by Tenant prior to the expiration of the term of this Lease and that Tenant shall not penetrate the demising walls, ceiling or floors of the Space without the prior consent of Landlord. 8. Tenant shall not place in any trash box or receptacle any material which cannot be disposed of in the ordinary and customary manner of trash and garbage disposal. All garbage and refuse disposal shall be made in accordance with directions issued from time to time by Landlord. 10. Tenant shall not use in any space any hand trucks except those equipped with rubber tires and side guards or such other material-handling equipment as Landlord may approve. Tenant shall not bring any other vehicles of any kind into Tenant's store. 11. Tenant shall not use the name of the Center in connection with or in promoting or advertising the business of Tenant except as Tenant's address. 12. The delivery or shipping of merchandise, supplies and fixtures to and from the Space or the Center shall be subject to such rules and regulations as are reasonably necessary for the proper operation of the Center. 13. Landlord my designate certain areas of the parking lot as `employee parking areas" and no employee of Tenant may park outside of such designated areas. Tenant customer's shall have access to any space within the Center. 14. Landlord may waive an one or more of these Rules and Regulation for the benefit of any particular tenant or tenants, but no such waiver by Landlord shall adversely affect Tenant's business, be construed as a waiver of such Rules and Regulations in favor of any other tenant or tenants or prevent Landlord from thereafter enforcing any such Rules and Regulations against any or all of the tenants of the Center. 15. These Rules and Regulations are in addition to and shall not be construed to in any way modify or amend, in whole or in part, the term, covenants, agreements and conditions of any lease of Space in the Center. 16.
