You have requested to modify the site by constructing a new driveway between the two properties. The existing use,motor vehicle servicing and repair, is permitted in the I-L zone. No changes to the building are proposed. The submitted plans reflect the current and proposed conditions. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The applicant is not proposing an increase in floor area. Therefore, the change will not require additional on-site parking. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The applicant has not proposed any changes to the building. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to the building. Therefore,this criterion does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The applicant is proposing an internal driveway between the two properties to avoid using the public right-of-way. The proposal does not include changes to the access points, driveway aisles, or location of parking where off-site traffic would be affected. Therefore, this criterion does not apply. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposed driveway will serve the typical number of cars already on the site on any given day. It will not increase vehicular traffic to and from the site. In fact, the purpose is to limit vehicles from entering the public-right-of-way. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area. Therefore,this criterion does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal reduces existing landscaping by 8.9%. The proposed driveway will remove 2,344 square feet of landscaping. The site currently has 26,045 square feet of landscaping and the gross site area is 153,600 square feet (includes two tax lots). The removal of landscaping will reduce the total landscaping onsite from 17.02% to 15.43%. Therefore, the reduction is not greater than 10% and is not reduced below the 15% required in the zone. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. There are no recreational facilities onsite. As discussed previously, landscaping and project amenities will not be reduced below 10% or the minimum established by the code. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. There have not been any previous conditions of approval for the use of this site. Therefore,this criterion does not apply. THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNING DIVISION. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. This request is determined to be a minor modification to an approved site development plan. The criteria for approval of the proposal are listed below. The owners propose to install a driveway between the two properties to allow direct access for motor vehicles between the two properties without using the public right-of-way. The connection requires grading of a limited portion of the site to accommodate the grade difference between the properties, as shown on the plans. (Excerpt from Tigard Development Code section I 8.360.050) Evaluation criteria.The Director shall determine that a major modification(s) will result if one or more of the following changes are proposed. There will be: I. An increase in dwelling unit density, or lot coverage for residential development; This is not a residential development and the criteria concerning density does not apply. 2. A change in the ratio or number of different types of dwelling units; There are no dwelling units and this criteria does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765; This change does not require additional parking but does help alleviate congestion on the west lot by opening up leased space on the east lot. 4. A change in the type of commercial or industrial structures as defined by the International Building Code; No structures are being changed and this criteria does not apply. 5. However, a reduction in existing off-site traffic would likely occur because currently the only means to transfer vehicles from one portion of the Applicant's work area to the other is on Hunziger. The proposed driveway will keep this traffic off of the public right-of-way. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day, The proposal will reduce vehicular traffic to and from the site as the internal driveway is used instead of the adjacent public street. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; No increase in floor area is proposed and this criteria does not apply. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; Common open space is not a requirement for I-L zoning districts;therefore this is not a criteria. 10. The existing screening along Hunziger will not be significantly disturbed. We are proposing a reduction of approximately 2,344 s.f. of vegetation. Therefore,the site will have a revised landscape area of 23,701 s.f. which leaves 15.43% landscaping to remain. In addition the reduction does not exceed the 10%allowed per the minor modification requirements (2604>2370).
