There are two tax parcels within the Burnham Business & Storage Park because the site crosses a tax map (8900 &9500 SW Burnham Street,WCTM 2S102AD, Tax Lot 2200 and WCTM 2S102DB, Tax Lot 200). The proposed generator is located on tax lot 200. The original approval in 1998 was to construct a 100 foot wireless communications tower. All related equipment for this tower was approved to be located within an adjacent storage unit. The tower is enclosed within a six-foot high chain link fence. You have requested a Minor Modification to install a 40kw diesel back-up generator within the fenced area. The site is located near sensitive lands associated with Fanno Creek The applicant provided information in the original land use approval that the lease area is above the 100-year floodplain elevation. A service provider letter from Clean Water Services has been provided that states no impact will be caused by the proposed generator on nearby wetlands. A noise study for the same type of generator at a Tacoma,WA site was provided by the applicant. The study showed the generator to create 64 dBA at 23 feet. The proposed location of the generator is just over 23 feet from the property line. The generator will operate for regularly scheduled maintenance and during power failures. Since the site is located in a commercial zone adjacent to Fanno Creek Park,there are no noise-sensitive units close to the site. Noise limits from the Tigard Municipal Code (TMC 7.40.160) are 60 dB between 9 pm and 7 am the following day and 75 dB any other time. If maintenance is scheduled between 7 am and 9 pm, then the standards will be met. Noise generated during power failures is exempt under TMC 7.40.180 for emergency equipment. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore,this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable as this request does not involve a residential development. Addition of a generator requires no additional on-site parking. This criterion is not applicable. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the buildings is proposed. Therefore,this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. This criterion is not applicable because no changes to the building are proposed with this application. The total height of the generator is 5 feet, eight inches. This is far below the height of the existing tower or adjacent building. This cnterion has been met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The accessways are located on the northeast side of the site, while the generator will be on the southwest side of the site within a fenced area. Accessways and parking areas will not be affected by the proposed change. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. This addition of the generator will not create additional vehicle trips to and from the site. Therefore,this criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The applicant is not proposing an expansion to the building floor area with this application. This standard does not apply. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There are no areas reserved for common open space for this development. This standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed generator will be located within a fenced, gravel area. No landscaping will be reduced by the installation. Portions of the existing arborvitae screen need to be replaced. The applicant has proposed to replace the dead plantings. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The original site plan was approved through a Site Development Review in 1993 (SDR 98- 00010). Staff has reviewed this decision. There were no conditions imposed at the time of approval. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, or injurious to surrounding properties,provided that development which occurs after this decision complies with all applicable local, state,and federal laws and the conditions below: Page 2 of 3 CONDITIONS OF APPROVAL PRIOR TO FINAL INSPECTION, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: (The staff contact shall be Cheryl Caines in the Planning Division(503) 639-4171) 1. In connection therewith, Lessee has the right to do all work necessary to prepare, maintain and alter the Premises for Lessee's business operations and to install transmission lines connecting the antennas to the transmitters and receivers. All of Lessee's construction and installation work shall be performed at Lessee's sole cost and expense and in a good and workmanlike manner. Title to the Lessee Facilities shall be held by Lessee. All of Lessee Facilities shall remain Lessee's personal property and are not fixtures. (a) Lessee shall operate the Lessee Facilities in a manner that will not cause interference to Lessor and other lessees or licensees of the Land, provided that their installations predate that of the Lessee Facilities. (b) Subsequent to the installation of the Lessee Facilities, Lessor shall not permit itself, its lessees or licensees to install new equipment on the Land or property contiguous thereto owned or controlled by Lessor, if such equipment is likely to cause interference with Lessee's operations. Such interference shall be deemed a material breach by Lessor. In the event interference occurs, Lessor agrees to take all reasonable steps necessary to eliminate such interference,in a reasonable time period. 8. Taxes. If personal property taxes are assessed, Lessee shall pay any portion of such taxes directly attributable to the Lessee Facilities. Lessor shall pay all real property taxes,assessments and deferred taxes on the Land. 9. Waiver of Lessor's Lien. (a) Lessor waives any lien rights it may have concerning the Lessee Facilities which are deemed Lessee's personal property and not fixtures, and Lessee has the right to remove the same at any time without Lessor's consent. In connection therewith, Lessor(i)consents to the installation of the Collateral;(ii)disclaims any interest in the Collateral, as fixtures or otherwise; and (iii) agrees that the Collateral shall be exempt from execution, foreclosure, sale, levy, attachment, or distress for any Rent due or to become due and that such Collateral may be removed at any time without recourse to legal proceedings. 10. Termination. This Agreement may be terminated without further liability on thirty(30) days prior written notice as follows: (i)by either party upon a default of any covenant or term hereof by the other party, which default is not cured within sixty (60) days of receipt of written notice of default, provided that the grace period for any monetary default is ten(10)days from receipt of notice;or(ii)by Lessee for any reason or for no reason, provided Lessee delivers written notice of early termination to Lessor no later than thirty (30) days prior to the Commencement Date; or (iii) by Lessee if it does riot obtain or maintain any license, permit or other approval necessary for the construction and operation of Lessee Facilities;or(iv)by Lessee if Lessee is unable to occupy and utilize the Premises due to an action of the FCC,including without limitation,a take back of channels or change in frequencies; or (v) by Lessee if Lessee determines that the Premises are not appropriate for its operations for economic or technological reasons,including,without limitation,signal interference. 11. Destruction or Condemnation. If the Premises or Lessee Facilities are damaged,destroyed, condemned or transferred in lieu of condemnation, Lessee may elect to terminate this Agreement as of the date of the damage, destruction, condemnation or transfer in lieu of condemnation by giving notice to Lessor no more than forty-five (45) days following the date of such damage, destruction, condemnation or transfer in lieu of condemnation. If Lessee chooses not to terminate this Agreement, Rent shall be reduced or abated in proportion to the actual reduction or abatement of use of the Premises. 12. Insurance. Lessee,at Lessee's sole cost and expense,shall procure and maintain on the Premises and on the Lessee Facilities,bodily injury and property damage insurance with a combined single limit of at least One Million and 00/100 Dollars($1,000,000.00)per occurrence. Such insurance shall insure,on an occurrence basis, against all liability of Lessee, its employees and agents arising out of or in connection with Lessee's use of the Premises,all as provided for herein. Lessor shall be named as an additional insured on Lessee's policy. Lessee shall provide to Lessor a certificate of insurance evidencing the coverage required by this paragraph within thirty(30) days of the Commencement Date. 13. Waiver of Subrogation. Lessor and Lessee release each other and their respective principals, employees, representatives and agents, from any claims for damage to any person or to the Premises or to the Lessee Facilities thereon caused by,or that result from, risks insured against under any insurance policies carried by the parties and in force at the time of any such damage. Lessor and Lessee shall cause each insurance policy obtained by them to provide that the insurance company waives all right of recovery by way of subrogation against the other in connection with any damage covered by any policy. Neither Lessor nor Lessee shall be liable to the other for any damage caused by fire or any of the risks insured against under any insurance policy required by Paragraph 12. 14. Assignment and Subletting. Lessee may not assign,or otherwise transfer all or any part of its interest in this Agreement or in the Premises without the prior written consent of Lessor; provided, however, that Lessee may assign its interest to its parent company,any subsidiary or affiliate or to any successor-in-interest or entity acquiring fifty-one percent (51%) or more of its stock or assets, subject to any financing entity's interest, if any, in this Agreement as set forth in Paragraph 9 above. Lessor may assign this Agreement upon written notice to Lessee, subject to the assignee assuming all of Lessor's obligations herein, including but not limited to, those set forth in Paragraph 9 above, and Lessee may sublet or license all or any portion of the Premises to one or more entities for communications uses only, without Lessor's consent. Lessor warrants that: (i)Lessor owns the Land in fee simple and has rights of access thereto and the Land is free and clear of all liens,encumbrances and restrictions; (ii)Lessor has full right to make and perform this Agreement;and(iii)Lessor covenants and agrees with Lessee that upon Lessee paying the Rent and observing and performing all the terms, covenants and conditions on Lessee's part to be observed and performed, Lessee may peacefully and quietly enjoy the Premises. Lessor agrees to indemnify and hold harmless Lessee from any and all claims on Lessee's leasehold interest. 16. Repairs. Lessee shall not be required to make any repairs to the Premises or Land unless such repairs shall be necessitated by reason of the default or neglect of Lessee. PROJECT DESCRIPTION: Install a back-up generator ensure that the existing wireless facility will continue to operate even if there is a power failure. The location of the generator is in an existing wireless equipment area and is obscured from view by existing landscaping. The generator will only operate for regularly scheduled maintenance and during power failures. A specific development schedule indicating the approximate dates of construction activity, including demolition, tree protection installation, tree removal, ground breaking, grading, public improvements, and building construction for each phase. It will take approximately 2 weeks to complete the installation of the proposed generator. The work will likely start in September or October. The work is planned to be completed by the end of November. Installation of additional accessory equipment shelters or related equipment if required existing landscaping is removed and cannot be replaced on the site to achieve the original intent, or to sufficiently screen any proposed new shelter and/or equipment if the original intent is no longer applicable. The proposed diesel generator will not go into the existing room that houses the data cabinets because there is not adequate space or ventilation. The generator is designed to be outdoors and is sheltered by just its housing. Below is a picture of this type of generator. (It will not need extra housing when exposed to the elements.) The generator will be located inside of the existing compound. The compound is surrounded by a 6' tall chain link fence and is partially surrounded by arborvitae. The arborvitae will obscure the generator from view. Noise: Noise-generating equipment shall be sound-buffered by means of baffling, barriers or other suitable means to reduce the sound level measured at the property line to 50 dBA (day)/40 dBA (night) when adjacent to a noise-sensitive land use and 75 dBA (day)/60 dBA (night) when adjacent to other uses. The proposed facility is not adjacent to sound sensitive land. The generator has been shown to create 64 dBA at 23 feet. (See attached sound study for the same type of generator at a site in Tacoma, WA.) The location of the proposed generator to the property line is just over 23 feet. The generator will operate for regular maintenance only during daylight hours and only at night if there is a power failure. This generator is strictly for emergency use. This noise survey extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing sound levels were measured on site with a Larson-Davis 820 sound level meter on June 27, 2007 to determine ambient sound levels. Measurements were conducted as close to the proposed location as possible and the property lines in accordance with the State of Washington code for Maximum Environmental Noise Levels WAC 173-60-020. The average ambient noise level was 63 dBA, due to traffic noise on South 15th Street. The weather during the measurements was overcast and the roads were dry. Code Requirements The site is located within the City of Tacoma Zoning jurisdiction on property with a Residential zoning. All of the adjacent receiving properties are also Residential. The proposed new equipment consists of an emergency generator. The generator will run once a week during daytime hours for maintenance and testing purposes only. Tacoma Municipal Code requires that no equipment associated with wireless communication facilities shall be operated so as to produce noise in violation of the maximum noise levels set forth in WAC 173-60. Under WAC 173-60-040, noise from equipment on a Class A EDNA(Residential) property is limited as follows: Class A EDNA Receiver: Noise is limited to 55 dBA during daytime hours. Predicted Equipment Sound Levels Emergency Equipment The proposed equipment includes one MQ Power 40 kW Diesel Generator. According to data obtained from the manufacturer, the generator will produce a sound level of 64 dBA at 23 feet. This generator will run for emergency purposes only when an unexpected power loss is experienced. Power losses are expected to occur very rarely at this site. According to code exemptions, the generator is exempted from the noise statutes since it is used for emergency purposes. In addition, the generator will run for a maximum duration of 15 minutes once a month during the daytime only for maintenance testing purposes. The nearest receiving property is 57 feet east of the equipment location. The predicted sound level at the nearest property is shown below in Table 1.
