MMD2007 00021 METZGER ELEMENTARY SCHOOL PORTABLES PLACEMENT City of Tigard, Oregon 13125 SW Hall Blvd. • Tiga> JR 97223 • August 14,2007 TIGARD Rob Saxton Tigard-Tualatin School District#23J 6960 SW Sandburg Road Tigard,OR 97223 RE:Metzger Elementary School Minor Modification/MMD2007-00021 Dear Mr. Saxton: This letter is in response to your request for approval of a Minor Modification (MMD2007-00021) to the original Metzger Elementary School Conditional Use Permit (CUP2003-00003) approval in 2003. The subject site is located at 10350 SW Lincoln Street; WCTM 1S135AB, Tax Lot 100. You have requested to modify the use of the site by adding two portable buildings to the Metzger Elementary School site. No changes to the school building are proposed. The submitted plans reflect the current and proposed conditions. Analysis of Modification Request: Section 18.330.020 of the 'Tigard Development Code Conditional Use Chapter indicates that any modification which is not within the descnption of a major modification as provided in A through H below shall be considered a minor modification. The Director shall determine that a major modification(s) has resulted if one or more of the changes listed below have been proposed: A. A change in land use; The proposed portable buildings will be for the same use (school). Therefore,the proposed modification not cause a change in land use. B. An 10% increase in dwelling unit density; The site is not used for residential purposes. Therefore,dwelling unit density does not apply. C A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The applicant does not propose a change to the accessways or parking areas. In addition, the proposed portables are not near any accessways or parking areas where they would be affected. D. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The proposed portable buildings will add about 3,000 square feet of floor area to the existing 43,360 square feet,an increase of 6.9%. Therefore,floor area will not increase by more than 10%. E. A reduction of more than 10% of the area reserved for common open space and/or usable open space; There is about 196,200 square feet of common or usable open space on site. The addition of the portables will reduce open space by 3,000 square feet, or 1.5%. Therefore, open space is not reduced by more than 10%. F. A reduction of specified setback requirements by more than 20%; The required setbacks for schools, are 30 feet for the front,20 feet for the side and 30 feet for the rear. Affected setbacks are the side and the rear setback The proposed portables are 40 feet from the rear property line and 261/2 feet from the side property line.Therefore,there is no reduction of specified setback requirements. It is not removing any screening or recreational amenities. Therefore,project amenities are no reduced by more than 10% where previously specified. H.A 10% increase in the approved density; The site is not used for residential purposes. Therefore, this criterion does not apply. A minor modification shall be approved, approved with conditions, or denied following the Director's review based on the findings that: A. The proposed development is in compliance with all applicable requirements of this title; and The proposed modification complies with all the applicable requirements of this title. B. Defects,liens,encumbrances,adverse claims or other matters. (a) created,suffered,assumed or agreed to by the insured claimant. (b) not known to the Company,not recorded in the public records at Dale of Policy,but known to the insured claimant and not disclosed in writing to the Company by the insured claimant prior to the date the insured claimant became an insured under this policy; - (c) resulting in no loss or damage to the insured claimant: (d) attaching or created subsequent to Date of Policy(except to the extent that this policy insures the priority of the lien of the insured mortgage over any statutory lien for services,labor or material or the extent insurance is afforded herein as to assessments for street improvements under construction or completed at Date of Policy):or (e) resulting in loss or damage which would not have been sustained if the insured claimant had paid value for the insured mortgage. 4. Unentorceability of the lien of the insured mortgage because of the inability or failure of the insured at Date of Policy,or the inability or failure of any subsequent owner of the indebtedness,to comply with applicable doing business laws of the state in which the land is situated. 5. Invalidity or unentorceability of the lien of the insured mortgage,or claim thereof,which arises out of the transaction evidenced by the insured mortgage and is based upon usury or any consumer credit protection or truth in tending law_ 6. Any statutory lien for services,labor or materials(or the claim of priority of any statutory lien for services,labor or materials over the lien of the insured mortgage)arising from an improvement or work related to the land which is contracted for and commenced subsequent to Date of Policy and is not financed in whole or in pad by proceeds of the indebtedness secured by the insured mortgage which at Date of Policy the insured has advanced or is obligated to advance. 7. Any claim,which arises out of the transaction creating the interest of the mortgagee insured by this policy,by reason of the operation of federal bankruptcy.state insolvency,or similar creditors'rights laws,that is based on' (i) the transaction creating the interest of the insured mortgagee being deemed a fraudulent conveyance or fraudulent transfer;or (ii) the subordination of the interest of the Insured mortgagee as a result of the application of the doctrine of equitable subordination;or (iii) the transaction creating the interest of the insured mortgagee being deemed a preferential transfer except where the preferential transfer results from the failure: (a) to timely record the instrument of transfer;or (b) of such recordation to impart notice to a purchaser for value or a judgement or lien creditor.
