You have requested to m the use of the site, from General Retail to an Eating and Drinking Establishment. "A Taste of Heaven," which sells packaged diabetic and non-diabetic food and drinks,will be moving into the building formerly occupied by Sherries Jewelry Store. The applicant proposed to make interior and exterior cosmetic improvements. No structural improvements or expansions are proposed. The proposed use is permitted in the Central Business District(CBD). Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter states: "Any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential development. Therefore,this criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The proposal does not involve residential development. Therefore,this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The minimum on-site parking requirement for retail is 3.7 spaces per square feet (or 2 total, based on 444 square feet). The minimum on-site parking requirement for the proposed eating and drinking establishment is 9.9 spaces per 1,000 square feet (or 5 total). While the proposed use requires more on-site parking than the former use, Table 18.765.2 indicates that properties abutting Main Street are exempt from adding parking as long as the proposed use is not entertainment and there is no expansion in floor area. Therefore, the proposed change does not require additional on-site parking in accordance with Chapter 18.765. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The applicant proposes only cosmetic improvements to the interior and exterior of the building and does not propose any structural changes. There will be no expansions or reductions in floor area and no walls will be removed,moved or structurally modified. Therefore, there could be no change in the type of commercial structure as defined by the Building Code. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed to increase the height of the building. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. While the applicant did not provide information on expected number of vehicle trips per day, the 444-square foot eating and drinking establishment is unlikely to generate 100 vehicles more than the former business. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed modification does not include an increase in floor area. Only interior and exterior cosmetic changes are proposed. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There is no area designated for common open space, nor is it required in this case. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposal does not include changes to existing landscaping. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The current owner purchased the property in its current condition in 1980 and the subject building was likely built decades before. The City's records do not show a Site Development Review or previous Minor Modifications. Therefore,there are no conditions of approval for the use of this site. THIS REQUEST HAS BEEN APPROVED BY THE CURRENT PLANNNG DIVISION. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. Page 2 A Taste of Heaven intends to focus on the local trade. This site is close to local apartment developments, and local Main Street business, which are within walking distance. The site is in close proximity to the City's Fanno Creek Trail and bike path systems. It is anticipated that patrons will use those facilities to access our establishment. Tri-met buses have a stop at the Fanno Creek Bridge and the MAX stop is close by. We anticipate that customers will use that service to patronize our operation. We will encourage the use of these services, given the small amount of onsite parking available. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet: Response: Floor area is not being increased due to businesses on both sides. 9. a reduction in the area reserved for a common open space and /or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%: Response: No reduction is open space is involved. 10.
