The proposed change is to enlarge the size of the freestanding sign from 3 ft. 4 in. x 4 ft. 11 5/8 in. to 4 ft. x 8 ft. and to modify the location of the sign. The applicant's traffic engineer recommended the sign be relocated away from the eastern access drive to ensure it does not cause an issue with sight-distance. The applicant's narrative addresses the Minor Modification criteria under Chapter 18.330 Conditional Use Permit. Analysis of Modification Request: Section 18.330.020 of the Tigard Development Code Conditional Use Review Section, states; "if the requested modification meets any of the major modification criteria, that the request shall be reviewed as a new Conditional Use application." Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: '1. A change in land use; The prior use approved for this site is a fire station (Emergency Services). The use is not proposed to change. 2. A 10% increase in dwelling unit density; The site is not developed with a residential use; therefore, this criterion is not applicable. 3. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; There are no changes proposed to the access ways or parking areas. The freestanding sign was to be next to the eastern entry drive. As shown on the revised site plan (January 31, 2009), the applicant has relocated the sign to the west near the emergency vehicle exit drive. The applicant moved the sign to ensure sight distance and visual clearance standards are met for all access drives. The eastern access drive is an entrance only and vehicles should not be exiting at this location. This standard is met because the proposed changes do not affect off-site traffic. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The request is to modify the proposed freestanding sign. No increase to the building square footage is proposed. This standard is met. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space;Because the development is a fire station,no common open space is required. Open areas are present on the western and northern portions of the site, but these were not required and may someday become part of Jack Park to the north across Kreuger Creek. This standard does not apply. 6. A reduction of specified setback requirements by more than 20%; The applicant has not requested changes to the building location or proposed setbacks. This standard is not applicable. 7. An elimination of project amenities by more than 10% where previously specified provided such as: (a) Recreational facilities; (b) Screening; or (c) Landscaping provisions; The approved plan has 15.5% landscaped area and does not include the pervious area of the site that is not landscaped. The revised sign will cover approximately three (3) additional square feet, but the difference in landscaping will be imperceptible. This standard is met. 8. A 10% increase in the approved density;The proposed modification request does not involve residential development; therefore,no increase to density is involved in the request. 18.780 Signs Section 18.780.130.A.4. states that for non-residential uses,one illuminated or non- illuminated freestanding sign not exceeding six feet in height and 32 square feet in area per sign face for uses approved under the site development review or conditional use process will be permitted.Wall signs may not exceed five percent of the gross area of the wall face on which the sign is mounted; The proposed freestanding sign is 4 ft. x 8 ft. (32 square feet). The sign has a 2 ft. 9 in. base/footing. The portion above ground (4 ft. 9 in.) does not exceed six feet, therefore this standard is met. The applicant is being conditioned to apply for a building permit prior to installation of the sign since the structure exceeds 6 feet,including the portion below grade. Decision This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local,state,and federal laws and the condition below: CONDITIONS OF APPROVAL PRIOR TO THE ISSUANCE OF BUILDING PERMITS FOR THE SIGN, THE FOLLOWING CONDITIONS SHALL BE SATISFIED: 1. The applicant shall obtain a sign permit for the freestanding sign from the Planning Division that meets the sign code dimensional requirements. Tualatin Valley Fire & Rescue is seeking a Minor Modification to the signage previously proposed for Station 50 located at 12585 SW Walnut Street (2S104AD04500) in the City of Tigard. The development of the station was approved by the City of Tigard on January 8, 2008 and included a sign permit (SGN2007-00171). The sign approved was a freestanding illuminated monument sign measuring approximately 3 feet high, 4 inches in height and 16.5 square feet per sign face. The applicant is now proposing to install a freestanding illuminated changeable letter sign measuring 4 feet in height and 32 square feet per sign face. The sign requirements of Chapter 18.780 of the City's Development Code will still be met. As required by the Minor Modification application, the criteria of Section 18.360.050(B) have been addressed below. Tigard Development Code Section 18.330.020(B) 1. Once we were able to get our traffic engineer out, we realized that even the sign as approved might be an issue. Our traffic engineer has recommended that we relocate it as shown on the attached drawing to ensure that it is not an obstacle. Will I need to do anything else to relocate as recommended?
