MMD2009 00005 CITY CHRISTIAN SCHOOL CHANGE OF USE NOTICE OF TYPE I DECISION • MINOR MODIFICATION (MMD) 2009-00005 CITY CHRISTIAN SCHOOL CHANGE OF USE TIGARD 120 DAYS = 09-10-2009 SECTION I. APPLICATION SUMMARY FILE NAME: City Christian School Change of Use CASE NO.: Minor Modification (MMD) MMD2009-00005 PROPOSAL: The proposal is to change the use of approximately 4,000 sq. ft. of classroom space in the City Bible Churc 1 Building from Religious Institutional to Institutional Day Care (Pre-school) for 40 3 & 4 year old children.The school will be licensed by the State of Oregon for 13 or more students.There are no other proposals. ZONING DESIGNATION: C-P: Professional/Administrative Commercial District. The C-P zoning district is designed to accommodate civic and business/professional services and compatible support services, e.g., convenience retail and personal services, restaurants, in close proximity to residential areas and major transportation facilities. Within the Tigard Triangle and Bull Mountain Road District, residential uses at a minimum density of 32 units/net acre, i.e., equivalent to the R-40 zoning district, are permitted in conjunction with a commercial development. Heliports, medical centers, religious institutions and utilities are permitted conditionally. Developments in the C-P zoning district are intended to serve as a buffer between residential areas and more-intensive commercial and industrial areas. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.520, 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section N. CONDITION OF APPROVAL PRIOR TO THE REQUEST FOR FINAL BUILDING INSPECTION, THE FOLLOWING CONDITION SHALL BE SATISFIED 1. Applicant shall request final inspection from the Planning Division prior to occupancy. BACKGROUND INFORMATION Site Information: The subject parcel is located at 11765 SW Pacific Highway, WCTM 1S136, Tax Lot 00100. The building containing the four classrooms is the City Bible Church with a 185 space parking lot. The access is from Pfaff le Street on the south side of a parcel of 7.44 acres. Proposal Description: The proposal is to change the use of approximately 4,000 sq. ft. of classroom space in the City Bible Church Building from Religious Institutional to Institutional Day Care (Pre-school) for 40 3 & 4 year old children. The school will be licensed by the State of Oregon for more than 14 students. There are no other proposals. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.050.B contains the following criteria for approval of a request for Minor Modification: Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed. There will be: 1. An increase in dwelling unit density,or lot coverage for residential development; There are no dwelling units on the property. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore, this criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The parcel has 185 existing parking spaces, very few of which are used on week days. The Church holds services on weekends. There is no requirement for additional parking. Therefore, this criterion is satisfied. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There will be no changes in the type of structures. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20%; There is no proposed change in building height. Therefore, this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; This proposal does not require a change in the type or location of access ways or parking areas where off-site traffic would be affected. An increase in vet. lar traffic to and from the site and , increase can be expected to exceed 100 vehicles per day; The proposal for 40 students does not increase vehicular traffic that would exceed 100 trips per day. Therefore this criterion is satisfied. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The change of use does not involve an increase in floor area. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; The proposal does not reduce the area reserved for common space or usable open space. Therefore, this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10%where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions. The proposal does not reduce the project amenities.Therefore, this criterion does not apply. 11. A modification to the conditions imposed at the time of site development review approval which are not the subject of B 1 through 10 above of this subsection. The proposal does not modify conditions imposed at the time of side development review approval which are not the subject of B1 through 10 above of this subsection. FINDING: Based on the analysis above, Staff finds that the criteria for minor modification of a site development have been met. SECTION V. It is part of the ministry of City Bible Church who has been in operation for over 50 years in the Portland area. The ministry of the church now extends to three campuses including NE Portland,Tigard,and Vancouver. City Christian School is located on the NE Portland campus and provides classes for children K3 -12. The preschool portion of the school began in 2001 as a half day only preschool and in 2008 we licensed with the State of Oregon and began a full day program. Our plan is to license a full day preschool for 3 &4 year old children on our Tigard and Vancouver campuses. It would require little or no renovations to either facility as both are nicely equipped for Sunday classes with the same age of children.The plan for the first year would be to provide classes for 40 children on each campus. The Tigard campus would probably be allowed to expand to no more than 100 over several years while the Vancouver campus would be limited to 40 or 50. The licensing process began with an on-site meeting with the state licensing agency from both Washington and Oregon. They inspected both facilities and determined that we could easily meet all the qualifications for a licensed preschool. In order to proceed with the process,we would have to have the Tigard campus preschool rooms classified with an E occupancy and in Vancouver an E or an I occupancy. The process now is to proceed with the Tigard and Vancouver building departments and have the occupancy for the preschool areas changed to an E in Tigard and an I in Vancouver. Our plan is to use four classrooms that are located at the West side of the building. These classrooms have been inspected by the state and recommended to be large enough for 33 children each based on 35 sq. ft. per child. After conferring with the zoning and building departs in Tigard they recommended that we proceed directly to a Minor Modification - Type I Application which requires an Applicants Statement/Narrative. This involves the answering of the following questions. An 10% increase in dwelling unit density; No—The addition of preschool classes in the church facilities will have no effect on the dwelling unit density. c. There is more than adequate off-street parking since the requirement for the church far exceeds that of the preschool. d. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; No—There is no increase in proposed floor area use. No–There are no changes in the height of the building. It will be used as it currently exists. 6. A change in the type and/or location of access ways and parking areas where off- site traffic would be affected; No—No changes to any access ways or parking areas are needed.
