The responses to the criteria for minor modification, however, are for modification of a conditional use and this application involves modification of a site development review. The criteria from TMC 18.330.020.(B)(2) must be replaced with those under TMC 18.360.050(B). I have enclosed this section of the code for your reference. Please provide your statement of the vehicular traffic to and from the site for the current use as basic data and the expected increase in vehicular traffic to and from the site as a result of this modification as required in item#7 of the criteria. I believe you already have sufficient information to respond to the other criteria. Upon receipt of this re-submittal, I will route the application to other departments for review. RECEIVED To: City of Tigard MAR 0 1..2009 /4-r Building/Zoning CITY OF TIGARD From: City Bible Church PLANNH'f !: NG NEERING 9200 NE Fremont Portland,OR 97220 Re: Occupancy classification change for preschool City Christian School is a private Christian school that is completing its 35th year this year. It is part of the ministry of City Bible Church who has been in operation for over 50 years in the Portland area. The ministry of the church now extends to three campuses including NE Portland,Tigard, and Vancouver. City Christian School is located on the NE Portland campus and provides classes for children K3 -12. The preschool portion of the school began in 2001 as a half day only preschool and in 2008 we licensed with the State of Oregon and began a full day program. Our plan is to license a full day preschool for 3 &4 year old children on our Tigard and Vancouver campuses. It would require little or no renovations to either facility as both are nicely equipped for Sunday classes with the same age of children. The plan for the first year would be to provide classes for 40 children on each campus. The Tigard campus would probably be allowed to expand to no more than 100 over several years while the Vancouver campus would be limited to 40 or 50. The licensing process began with an on-site meeting with the state licensing agency from both Washington and Oregon. They inspected both facilities and determined that we could easily meet all the qualifications for a licensed preschool. In order to proceed with the process,we would have to have the Tigard campus preschool rooms classified with an E occupancy and in Vancouver an E or an I occupancy. The process now is to proceed with the Tigard and Vancouver building departments and have the occupancy for the preschool areas changed to an E in Tigard and an I in Vancouver. Our plan is to use four classrooms that are located at the West side of the building. These classrooms have been inspected by the state and recommended to be large enough for 33 children each based on 35 sq. ft. per child. After conferring with the zoning and building departs in Tigard they recommended that we proceed directly to a Minor Modification - Type I Application which requires an Applicants Statement/Narrative. This involves the answering of the following questions. The Director shall determine that a major modification has resulted if one or more of the changes listed below have been proposed: 9200 NE Fremont Portland, Oregon 97220 / www.citychristianschool.com / 503-252-5207 a. A change in land use; No--City Bible Church uses this facility as a place of worship for its members. The activities involve worship services, training and teaching sessions for all age levels, as well as social activities. Most of these activities take place on the weekends. City Christian School will utilize classrooms that are designed for preschool age children, but only used on the weekends. We will now use these rooms for preschool during the five weekdays. b. An 10% increase in dwelling unit density; No—The addition of preschool classes in the church facilities will have no effect on the dwelling unit density. c. A change in the type and/or location of access ways and parking areas where off- site traffic would be affected; No—No changes to any access ways or parking areas are needed. There is more than adequate off-street parking since the requirement for the church far exceeds that of the preschool. d. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; No—There is no increase in proposed floor area use. The rooms being proposed to use are currently being used for the same purpose. e. A reduction of more than 10% of the area reserved for common open space and/or usable open space; No—There would be no reduction of common open space; f. A reduction of specified setback requirements by more than 20%; No—No setback requirements are being changed as there is no change at all to any part of the physical structure. g. An elimination of project amenities by more than 10%where previously specified provided such as: Recreational facilities, Screening,or landscaping provisions. None of the above mentioned concerns are affected in any way. Fencing, screening, landscaping, etc will all remain as approved without any changes. h. A 10% increase in the approved density; No—There is not increase in the density as a result of our preschool. This involves the answering of the following questions. The Director shall determine that a major modification has resulted if one or more of the changes listed below have been proposed: 1. An increase in dwelling unit density, or lot coverage for residential development; No—Our proposal requires no change in the dwelling unit density or the lot coverage. 9200 NE Fremont Portland, Oregon 97220 / www.citychristianschool.com / 503-252-5207 2. A change in the ratio or number of different types of dwelling units. No–The addition of our preschool would require no change in the number or different types of dwellings as we plan to use the church facilities as they currently exist. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. No–No additional parking would be required. The parking lot provides enough parking for the entire church. The preschool will use only a fraction of what currently exists. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No–There are no changes in the type of structures that are affected by the starting of a preschool. 5. An increase in the height of the buildings by more than 20%. No–There are no changes in the height of the building. It will be used as it currently exists. 6. A change in the type and/or location of access ways and parking areas where off- site traffic would be affected; No—No changes to any access ways or parking areas are needed. There is more than adequate off-street parking since the requirement for the church far exceeds that of the preschool. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. No–The enrollment of the preschool will not exceed 35 students, which will generate approximately 70 vehicle trips per day. An additional 4 staff for the preschool and 6 already existing for the church will add another 20 vehicle trips per day. This brings the total to 90 trips per day. 8. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; No—There is no increase in proposed floor area use. The rooms being proposed to use are currently being used for the same purpose. 9. A reduction of more than 10% of the area reserved for common open space and/or usable open space; No—There would be no reduction of common open space; 10. An elimination of project amenities by more than 10% where previously specified provided such as: Recreational facilities, Screening, or landscaping provisions. None of the above mentioned concerns are affected in any way. Fencing, screening, landscaping, etc will all remain as approved without any changes. 11. A modification to the conditions imposed at the time of site development review approval which are not the subject of B1 through 10 above of this subsection. No– No conditions exist that would require a modification of our site development review approval.
