You have requested to modify the site by moving an existing portable building from one location on site to another location on site and removing an existing portable building from the site. No other changes to the site or main building are proposed. The submitted plans reflect the current and proposed conditions. Analysis of Modification Request: Section 18.330.020 of the Tigard Development Code Conditional Use Chapter indicates that any modification which is not within the description of a major modification as provided in A through H below shall be considered a minor modification. e Director shall determine that a major modification(s) has resulted if one or more of the changes listed below have been proposed: A. A change in land use; The proposed P ortable buildings will be for the same use (school). Therefore, the proposed modification willnot cause a change in land use. B. A 10% increase in dwelling unit density; The site is not used for residential purposes. Therefore,dwelling unit density does not apply. C. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The applicant does not propose a change to the accessways or parking areas. In addition, the existing portable will not be not near any accessway and will be moved farther away from the parking area than it was previously. D. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The proposed relocation will not add any floor area to the site. In fact,the school is losing 1,800 square feet by removing an existing portable. The other portable is simply being moved to a different location on site. Therefore,floor area will not increase by more than 10%. E. A reduction of more than 10% of the area reserved for common open space and/or usable open space; The Tigard High School site is about 43 acres, or 1,856,706 square feet. All buildings on site comprise about 242,190 square feet and the parking lot comprises 206 034 square feet. There is about 1,408 482 square feet of common or usable open space on site. The relocation of the portable to the east parking lot to a portion of paved open space will reduce open space by 1,800 square feet square feet,or 0.12%. A reduction of specified setback requirements by more than 20%; The required setbacks for schools are 30 feet for the front, 20 feet for the side and 30 feet for the rear. The relocated portable will be 40 feet from the east side property line and more than 100 feet from all other propertylines.Therefore,there is no reduction of spec' ied setback requirements. G. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities; (2) Screening;or(3) Landscaping provisions; and While the relocation is removing a small portion of open space, that open space is already paved. Therefore,the proposed modification is not removing any project amenities. H. A 10% increase in the approved density; The site is not used for residential purposes. Therefore,this criterion does not apply. A minor modification shall be approved, approved with conditions, or denied following the Director's review based on the findings that: The proposed development is in compliance with all applicable requirements of this title; and The proposed modification complies with all the applicable requirements of this title. The modification is not a major modification as defined in A through H above. The proposed modification is not a major modification as defined in A H above.
