Portland, OR 97204 RE: Minor Modification,MMD2008-00003 Twality Middle School Portable Relocation and Addition Dear Mr. Westf all: This letter is in response to yyoour request for approval for a Minor Modification (M D2008-00003) at 14650 SW 97th Avenue, WC FM 2SI11AC, Tax Lot 2700. You have requested to modify the site by moving an existing portable building from one location on site to another location and adding a new portable, to be moved from Tigard Higgh School. No other changes to the site or main building are proposed. The submitted plans reflect the current and proposed conditions. Analysis of Modification Request: Section 18.330.020 of the Tigard Development Code Conditional Use Chapter indicates that any modification which is not within the descnption of a major modification as provided in A through.H below shall be considered a minor modification. major Director shall determine that a major modification(s) has resulted if one or more of the changes listed below have been proposed: A. A change in land use; The pproposed portable buildings will be for the same use (school). Therefore, the proposed modification wtl[not cause a change in land use. B. A 10% increase in dwelling unit density; The site is not used for residential purposes. Therefore,dwelling unit density does not apply. C. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The applicant does not propose a change to the accessways or parking areas. Neither portable will be near an accessway or in a parking area. In addition the proposed change will not require the need for more parking. The parking requirement for a middle school-is 2 spaces per classroom. There are currently 38 classrooms at Twality, with the additional portable adding 2 more classrooms. Eighty (80) spaces are required and there are 138 standard parking spaces on site,thereby meeting the parking requirement. D. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The additional portable building will add about 1,800 square feet of floor area to the existing 106,182 square feet (includes permanent buildings and portables), an increase of 1.7%. Therefore,floor area will not increase by more than 10%. E. A reduction of more than 10% of the area reserved for common open space and/or usable open space; There is about 499,808 square feet of common or usable open space on site. The addition of the portables will reduce open space by 1,800 square feet, or 0.36%. Therefore, open space is not reduced by more than 10%. A reduction of specified setback requirements by more than 20%; The required setbacks for schools are 30 feet for the front, 20 feet for the side and 30 feet for the rear. The new portable will be 20 feet from the east property line and more than 50 feet from all other property lines. The existing relocated portable will be more than 20 feet from the east property line and more than 50 feet from alI other property lines. Therefore, there is no reduction of specified setback requirements. G. An elimination of project amenities by more than 10% where previously specified provided such as: (1) Recreational facilities;(2) Screening;or(3) Landscaping provisions;and The proposed modification is removing 0.36% of the landscaping onsite.
