The site is located at 11075 SW Gaarde Street, WCTM 2S103DC,Tax Lot 1100. The request is to increase the floor area and modify the proposed footprint of the sanctuary building being constructed in Phase 2 of the project. The proposed building footprint is similar to the originally approved footprint (CUP2004-00005) and the change to the footprint does not increase the amount of site coverage. The additional floor area is proposed within the mezzanine storage level between the finished floor of the lower level and the finished floor of the main level. The applicant is requesting to increase the square footage from the previously approved 22,450 to 24,695 square feet. A search of City records revealed an additional Minor Modification approved in January of 2006 (M D2005- 00024) to change the phasing of the project,to modify the building footprint, add/modify parking spaces, and to install a storm drain outfall from the water quality swale to the on-site drainageway. Analysis of Modification Request: Section 18.330.020 of the Tigard Development Code Conditional Use Review Section, states; "if the requested modification meets any of the major modification criteria,that the request shall be reviewed as a new Conditional Use application." Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use; The prior use approved for this site is a religious institution. The applicant is not proposing a change to the approved use. The additional floor area is to be used for storage. 2. A 10% increase in dwelling unit density; The site is not developed with a residential use;therefore this criterion is not applicable. 3. A change in the type and/or location of access ways and parking areas where off-site traffic would be affected; The proposed modification to the building footprint and additional square footage are outside the on-site access ways and parking areas. Parking requirements for religious institutions are based on the number of seats in the main sanctuary. No changes are proposed to the previously approved seating capacity. The modifications will have no effect on access ways, parking, or off-site traffic. This standard is met. An increase in the floor area proposed for non-residential use by more than 10% where previously specified; The previously approved square footage of the new sanctuary building is 22,450 square feet. The proposed addition and footprint modification will increase the building size by 2,245 square feet. All square footage is being added to the mezzanine level of the sanctuary. This is an increase of 10% and is allowed with a minor modification. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space; This religious institution development does not have any area reserved for common open space or usable open space. This criterion does not apply. 6. A reduction of specified setback requirements by more than 20%; The modified footprint still meets the required setbacks and is similar to the originally approved footprint (CUP2004-00005). This standard is met. 7. An elimination of project amenities by more than 10% where previously specified provided such as: (a) Recreational facilities; (b) Screening; or (c) Landscaping provisions; Based on the plans approved in 2006 through a minor modification (MMD2005-00024), the site's landscaping was reduced from 82,418 to 75,744 square feet with the addition of 6,674 square feet of parking area. The applicant states that the proposed footprint modification creates an additional 59 square feet of landscaped area. This critenon is satisfied. 8. A 10% increase in the approved density; The proposed modification request does not involve residential development;therefore,no increase to density is involved in the request. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental,or injurious to surrounding properties,provided that development which occurs after this decision complies with all applicable local,state,and federal laws: THIS REQUEST FOR MINOR MODIFICATION APPROVAL IS HEREBY GRANTED. In response to your email question above, the building submitted in the site plan A1.2 in 2005 represents a schematic design for Phase 2. A note on the drawing says "Phase 2 addition ... Building outline to be determined." The building that was recently submitted represents the final design or Phase 3. I have scanned the drawings that we submitted for the 2005 Minor Modification: Phase 1 Site Plan A1.1, Phase 2 Site Plan A1.2, and Phase 3 Site Plan A1.3. and have attached them to this email for clarification. " The shape of the building is not critical, but do the changes affect site coverage or landscaping? Will each one increase or decrease? By what percent and square footage? If I can get that information, then we'll just make it part of this minor mod." The building submitted recently, has the same amount of landscape/open area as the plan that was submitted in 2005 in all areas except the area directly adjacent to the proposed church building. That area has 59 square feet more landscaped area than the 2005 submittal. So, we have changed the shape of the building, added more landscaped area adjacent to the building, and increased the floor area by less than 10% within the footprint of the building. Response: Per 18.130.020 Listing of Categories, B 9 Religious Institutions Definition: Places of worship may include related accessory uses such as offices, classrooms, auditoriums, social halls, gymnasiums and other recreational activities. The increase in floor area for storage, while not specifically listed as a use, is assumed to be within the definition of uses for Religious Institutions and as a result, does not change the land use. B. An 10% increase in dwelling unit density. Response: Not applicable. Our application is nonresidential. C. A change in the type and/or location of access ways and parking areas where off street traffic would be affected. • Page 2 October 2, 2008 Response: The parking requirements for Religious Institutions are based on the number of seats in the main sanctuary per 18.765.2 City of Tigard Community Development Code. Because we are adding storage space and not occupants or seats, the parking areas, access ways and off site traffic will not be affected. D. An increase in the floor area proposed for the nonresidential use by more than 10% where previously specified. Response: We propose an increase in floor area for nonresidential use of 10% of the previously specified floor area as stated above. The previously specified floor area is 22,450 square feet. An elimination of project amenities by more than 10% where previously specified such as: (1) Recreational facilities; (2) Screening: or (3) Landscape provisions Response: The addition of mezzanine storage floor area will not eliminate any project amenities such as those listed above because the floor area occurs within the submitted building footprint and does not affect any exterior space, landscape amenities or screening. All of those project amenities will be preserved. H. A 10% increase in the approved density. Response: Not Applicable. Our application is nonresidential. EXPLANATION FOR REVISED FLOOR AREA NUMBERS: The allowable square footage per the Conditional Use Permit is 22,450. The drawings as submitted show 24,247 square feet. We are allowed a 10% increase in square feet by minor modification which will result in a total floor area of 24,695 square feet. We propose adding 2245 square feet which is 10% of 22,450. Some of the additional floor area was submitted in the drawings for permit, and some is incorporated in the newly created mezzanine storage space. The church needs extra storage space, and when we were working on the stair sections, we noticed that the landing occurred at a level that would work for a mezzanine storage space. We decided to • Page 3 October 2, 2008 provide an elevator stop at the same level to facilitate movement of large items such as tables and chairs for banquet storage. The clear height above and below the mezzanine is greater than the 7 foot requirement in section 505.1 of the 2007 Oregon Structural Specialty Code. It is important to consider the type of use of the added floor area. The addition of storage space does not affect occupancy, parking requirements, setbacks, landscaping, common open space or any other project amenity. This space was created out of space within the floor to floor space of the lower level. It will not change the perimeter of the building footprint. Per 2007 Oregon Structural Specialty Code, Mezzanines, Section 505.1, "A mezzanine or mezzanines in compliance with section 505 shall be considered a portion of the story below. Such mezzanines shall not contribute to either the building area or number of stories as regulated by section 503.1." While this section is within the building code and not the planning code, the information in the building code is pertinent to the area calculations. We are within the 10% allowable increase in floor area and we are adding a mezzanine over usable floor area that previously has been counted in the floor area calculations. Therefore, our application meets the requirements for a Type 1 Minor Modification. We request approval of a minor modification for an increase in floor area by means of a Type 1 Procedure because we believe that the proposed increase is in compliance with all applicable requirements of this title and it is not a major modification. (22,450 + 2,245 =24,695 square feet.) • The floor area of the church as submitted to the City of Tigard for permit is: 24,247 square feet The church was submitted to the City of Tigard with a floor area of 24,247 square feet, which is over the amount per conditional use permit but within the allowable floor area if we apply for a minor modification. We submitted with the intention of applying for a minor modification. As we worked on the stair sections, we saw an opportunity to create a mezzanine at a level that worked with the stair landing. We extended the mezzanine to the elevator to use the elevator for moving tables, chairs and other large items. The mezzanine floor area added 1,129 square feet to the building. We added 74 square feet to the baptistery to accommodate a ramp for accessibility. With the additional floor area in the baptistery and mezzanine, the total floor area grew to 25,450 square feet or 755 square feet over the allowable floor area for a minor modification. To remain within the allowable floor area for the minor modification we had to reduce the floor area. As a result, we eliminated the doors on the lower level storage rooms. That space will revert to unfinished space adjacent to crawl space. The storage space we eliminated has a floor area of 757 square feet. 25,450—757=24,693 sf. This floor area is within the allowable square feet for a minor modification to the conditional use permit or 24,695 square feet.
