I have been working on the initial review of your application for minor modification of Tigard
Christian Church over the last few days,and some significant issues have arisen. I was preparing to
write you today when your e-mail came in asking for a status report. I also just received the report I
was asking for on the land use history for 13405 SW Hall Blvd.
At first your application was a little bit confusing in that the criteria you submitted is for
modifications of a Site Development (TMC18.0360.050.B),where your case would be a modification
of a Conditional Use (IMC18.330.020.B.2). I refer to the Conditional Use and Variance approved
by the Planning Commission on November 27, 1989 (CU 89-05,V 89-28,PD 89-04).
TMC18.130.020.B.5.c, Use Classification,lists pre-school as institutional day care, a different use
than has been previously approved for this address, and which would itself require a Conditional
Use review and approval (Table 18.510.1).Also,please see page 8 of the enclosed Planning
Commission Final Order No. 89-24.
If there is a change of use (Day Care) requested for a Conditional Use (Religious Assembly),a Major
Modification will be required for review (TMC18.330.020.B.2).Therefore,your application for
Minor Modification is deemed incomplete and review will not proceed until I hear from you that

The Tigard Planning Commission reviewed the above application at a public
hearing on November 7, 198x. The Commission based its decision upon the facts,
findings, and conclusions noted below.

2. Backoround
Condit nal use approval was granted by the Bearings Officer on August 22,
1985, for addition of an auditorium, office, and restrooms to the existing
church. A variance was granted to allow a :rout yard setback of 3.5 feet
where 20 feet is normally required (CU 4-85, V 14-85). The site plan
submitted with the application noted a future classroom in the general area
currently proposed for development.

Planning Division records do not include an original approval for use of
the site for religious assembly use.
3. Vicinity Informatioq
Properties to the north and west are monad R-12 (PC) and are developed
with a single family residence and the Tigard Senior Canter. Properties to
the south across O'Mara Street are developed with single family residences
and are coned R-4.5 (Residential, 4.5 units/acre). Properties to the east
across Ball Boulevard are zoned 1-12 (Residential, 12 units per acre) and
are currently developed with single family residences on large lats.
4. pits Information and Proposal Descriatioq
A church building including assembly area, fellowship hall and clasarooms
is presently located on the 3.7 acre parcel. A paved parking area
containing 177 parking spaces is located to the west and south of the
church building. Two driveways from O'Mara Street serve the parking area.
A small cottage and storage barn are located in the northwestern corner of
the site. The property is well landscaped and contains a number of mature
trees. Pull street improvements exist along both street frontages of the
mite.
Tigard Christian Church proposes developing a 12,620 square foot. two story
education wing addition to the existing church. The classrooms are not
intended for school use but instead are to be limited to religious
instruction and church related activities. No additional parking
facilities are proposed except for the addition of a bicycle rack with
spaces for 12 bicycles.
Construction of the addition would require removal of landscaping
materials installed after the last addition to the church, as well as the
removal of a 36 inch diameter walnut tree on the west side of the church
building. Landscaping materials would be replaced with lawn, groundcover,
and a variety of trees and shrubs near the building. sidewalks would be
installed between the east side of the addition and the Mall Boulevard
sidewalk and between the west side of the addition and the parking lot.
Tigard Christian Church requests conditional use approval of the addition
to the church. Religious assembly uses are conditional uses in the R-12
zone. In addition, the church also requests a variance to the 20 foot side
yard setback that applies to church buildings where they are permitted as
conditional uses. The church requests approval of a minimum eleven foot
setback on the building's northern side.
5. Aasncv and IfPO Casnsnts
The Engineering Division has reviewed the proposal and has offered the
following comments:

1. The proposed addition will not require an additional connection to a
public sanitary serer. Storm drainage is provided from an existing
storm sewer located east of the addition along Hall Boulevard.
2. The site fronts sM Ball Boulevard to the east. sail Boulevard, a
state highway, is classified by the City's Transportation Plan Map as
an arterial street. The site's frontage is fully improved. The
existing right-of-way has a width of 35 feet from centerline and
includes 20 feet of state highway right-of-wey as well as a 15 foot
wide strip of land owned by the City. So additional right-of-way or
improvements are required along this frontage of the sits.
3. The site fronts to the south along Si! O'Mara street, a minor collector
street. The frontage is fully improved, but to local street
standards. The right-of-way should be widened from the local street
standard width of 25 feet from centerline, to the minor collector
street right-of-way width of 30 feet from centerline to accommodate
possible future reconstruction of the street to minor collector street
standards. It is not clear from the record of the previous
conditional use application for this site why dedication was not
previously required.
The Oregon State Highway Divisio., has c wanted that the proposed addition
may contribute additional traffic to the Ball and O'Mara intersection
advancing the need for a traffic signal, although a signal is not
presently warranted. existing right-of-way and street improvements are
sufficient. The Highway Division also commsntsd that the existing eastern
access to the parking lot is too close to O'Mara street'• intersection with
Hall boulevard and should either be eliminated or moved. (Staff notes that
the eastern access driveway is approximately SS feet from the Ball
Boulevard right-of-way. The City's engineering Division finds that this is
an adequate separation between access to • parking lot of this sine and the
right-of-way of Hall Boulevard.)
The Washington County Consolidated Fire District has reviewed the plans and
has commented that the need for interior fire sprinklers as well as the
possible need for an additional fire hydrant will be addressed during .hs
proposed addition's building permit review.
The Building Division, Tigard Mater District, General Telephone, and
Portland Goreral Electric have reviewed the proposal and have offered no
comments.
No other comments have been received.
B. ANALYSIS

COIIUITIONAL USE
The Community Development Cods (CDC) conditionally allows religious
assemblies (churches) in the R-12 zone upon demonstration that certain
approval criteria are satisfied. General approval standards include: (1)
the site size and dimensions are adequate for the proposed use and will
allow adequate buffering from adjacent uses; (2) site characteristics are
appropriate for the use; (3) adequate public facilities serve the site;
(4) all applicable requirements of the zoning district and the Code are
satisfied; and, (5) the use complies with applicable comprehensive plan
policies (CDC Chapter 18.130.040). in addition, specific approval criteria
for religious assemblies include (1) the site size must be at least 20,000
square feet; and (2) the following setback regulation must be satisfied:
a. The front yard setback shall be a minimum of 25 feet.
b. On corner lots and through lots, the setback shall be a minimum
of 20 feet plus meeting visual clearance areas (Chapter (18.102).
c. The side yard setback shall be a minimum of 20 feet.
d. The rear yard setback shall be a minimum of 20 feet.
e. Each setback shall be increased S feet for every 10 feet of
building height over 45 feat.
In the present situation, the general and specific conditional use approval
standards for a religious assembly (church) are satisfied because (1) the
3.68 acre parcel is substantially larger than the 20,000 square foot
minimum required parcel size and the parcel provides adequate space for the
expanded church building, for landscaped areas, for needed parking
facilities, and to reserve approximately 1 acre on the northeastern portion
of the lot for possible future parking lot expansion; (2) no
characteristics of the site impede the use; (3) all necessary public
facilities presently serve the site; (4) 1-12 zoning district maximum sits
coverage requirements are satisfied. Setback requizements are either
satisfied as proposed or have been requested to be varied as described in
the following section; and (5) plan policies which apply to the use
proposed are satisfied as noted in Section C of thin report.
Requirements of the Sate Development Review section of the Community
Development Code are also satisfied. The existing parking lot providr ;
sufficient numbers and location of parking spaces based upon the Code
standard of 1 parking space for every 12 feet of pew length. Pour
handi r.pped parking spaces already are provided as required by the Code.
The currant plan proposes to add a bicycle rack with spaces for twelve
bicycles. This will bring the church development into compliance with Code
Section 18.106.020(P) which requires that secure bicycle parking spaces be
provided at a ratio of one bicycle rack parking space for may fifteen
automobile parking apaces.

satisfied. Adequate parking lot lighting is provided. The parking lot and
site are very well landscaped. Overall, the landscaping buffers adjoining
prop. ties well from possible impacts of the church use.
Because the applicable criteria are presently satisfied or will be
satisfied through the proposed improvements and site plan revisions
recommended in this report, the Planning Commission shall grant Conditional
Use approval of the Tigard Christian Church application for expansion of an
existing religious assembly in the R-12 sons at 13405 SO Hall Boulevard.
SETBACK VARIANCE
Required eetbs�:ks for the proposed addition are met with the exception of
the nort!, rn side yard setback. The applicant has requested that this
setback be varied to allow the building's northeastern corner to be
situated 11 feet from the northern property line ratter than the required
20 feet. The northwestern corner of the building would be situated 23 feet
from the property line. Section 18.134.050 of the Community Development
Code provides that variances may be granted upon satisfaction of the
following criteria:
1. The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensive plan, to any other applicable policies and standards,
and to other properties in the same district or vicinity;
2. There are special circumstances that exist which are peculiar to the
lot vise or shape, topography or other circumstances over which the
applicant has no control, and which are not applicable to other
properties in the same zoning district;
3. The use proposed will be the same as permitted under this Code and
City standards will be maintained to the greatest extent that is
reasonably possible, while permitting some economic use of the land.
4. existing physical and natural systems, such as but not limited to
traffic, drainage, dramatic landforms, or parks will not be adversely
affected any more than would occur if the development were located as
specified in the Code; and
5. The hardship is not self-imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The primary purposes of the 20 foot side yard setback requirement for
churches are to (1) prevent excessive shading of adjacent buildings from a
building type which is typically taller than other buildings in residential
zones; and (2) to provide additional area for sound dissipation and
possible landscaped buffering to reduce the noise effects of a church on
adjacent properties. In the present situation the proposed addition would
be 18 fest high in the area of the variance, no taller than a typical
single family residence. Therefore, no excessive shading would occur if

the setback is reduced as requested. The existing approximately twenty
foot high laurel hedge on the property to the north should provide
sufficient visual and sound buffering for the expanded use. Classrooms
would be located in the area of the building which would intrude into the
required setback area. Church related classrooms typically would not be
expected to produce as such noise as a church meeting hall. Therefore, the
sound dissipating and buffering purposes for the required setback would
also not appear to be detrimentally affected by granting the variance.
The locations cif the existing church building and parking area are such
that the most logical location for expansion is to the north. In order to
efficiently design the building with classrooms on either side of a central
hallway, the architect found it necessary for the building to intrude into
the required setback area. In order to avoid this intrusion, the proposed
• addition otherwise would have had to have been substantially dowrsised or
else would have had to have a single row of classrooms located oft of the
eastern end of the hallway. Stther of these alternativws would have
resulted in an inefficient and less attractire building than the Church
desired, thereby necessitating the applicant's variance request.
The use proposed is conditionally allowed by the Code and would not be
altered by granting the variance. ixisting physical and natural systems
would not be any more adversely affected by the allowance of the variance
than they would if the variance was not granted. The apn..rt of variance
requested is the minimum necessary to permit this building deign.
Therefore, the criteria for varying the side yard setback requirement are
satisfied.
C. FINDINGS AND CONCLUSIONS
The relevant criteria in this case are Tigard Comprehensive Plan Policies
2.1.1, 6.6.1, 7.1.2, and 8.1.3, and Community Development Code Chapters
18.54, 18.90, 18.100, 18.102, 18.106, 18.108, 19.120, 18.130, 18.134, and
18.164.
The Planning Commission has determined that the proposal as submitted is
consistent with the Comprehensive Plan based upon the findings noted below.
a. Policy 2.1.1 is satisfied because 11100 1 and surrounding property
owners were given notice of the hearing and an opportunity to comment
on the applicant's proposal.
b. Policy 6.1.1 is satisfied because intervening roadways and landscaping
screen the church tr adjacent residential uses.
c. Policy 7.1.2 is satisfied because adequate water and sanitary and
storm sewer facilities already serve the church and have the necessary
capacity to handle any increased demand resulting from the addition.
d. Policy 8.1.3 is satisfied because necessary street improvements are

already in place.
The Planning Commission has determined that the proposal as submitted is
consistent with relevant portions of the Community Development Code based
upon the following findings:
a. Chapter 18.54 (R-12 Zone) is satisfied because the prooposa.l meets all
applicable requirements of the R-12 sone.
b. Chapter 18.80 (Planned Development) is satisfied because the proposal
meets the requirements of the Planned Development overlay moos.
c. Chapter 18.100 (Landscaping and Screening) is satisfied because both
the existing and proposed landscaping will adequately and attractively
buffer the proposed expanded church from adjacent residential uses.
d. Chapter 18.102 (Visual Clearance Areas) is satisfied because existing
site improvements provide adequate vision clearance for vehicular
access from the site onto O'Mara Street.
a. Chapter 18.106 (Off-Strest Parking) is satisfied because the existing
parking lot meets Code requirements for number of parking spaces
provided, provision of handicapped parking space., and general
requirements for parking lot design. The plan currently under review
would correct a deficiency with respect to Code compliance by
providing a sufficient amount of bicycle rack parking spaces thereby
promoting an alternative to automobile transportation
f_ Chapter 18.108 (Access) is satisfied because existing accesses to the
parking lot provide for safe and efficient access to the church in
compliance with Code requirements for nn■ber and location of aoceeses.
The site also appropriately provides adequate pedestrian access to the
building from the parking area and adjacent sidewalks.
g. Chapter 18.120 (site Development Review) is satisfied because existing
site improvements as well as proposed site improvements satisfy the
standards contained in the Chapter and the requirements of related
section of the Code.
h. .:hapter 18.130 (Conditional Use) is satisfied because both the general
and specific conditional use criteria for a religious assembly are met
as described in the Analysis above.
i. Chapter 18.134 (Variance) is satisfied because the criteria for a
variance to the 20 foot side yard setback requirement for churches are
met as discussed above.
j. Chapter 18.164 (Street and Utility Standards) is satisfied because the
existing public improvements satisfy City of Tigard and Oregon State
Highway Division standards.

The Planning Commission approves Conditional Use tat 39-05 and Planned
Development Pt' 89-04 for an addition to the ewistin4 Tigard Christian
Church. The variance (V 89-28) is also approved to allow the expended
church building to be located no less than 11 fsr- from the northern
property line. Approv of thaw requests should be subject to the
conditions which follow ♦pproval of this conditional use request will
allow for expanded relic ► assembly use of the site only. If in the
future the church should Qesire to use the classrooms for school use, a
separate conditional use review for possible school use of the site will be
necessary.

Minor Modification — Type I Application CITY OF TIGARD
Applicant's Statement: PLAA�NI , /ENGi EERING
Tigard Christian Church located at 13405 SW Hall Blvd., Tigard, OR 97223 is
seeking an Occupancy Change from A-3 to E at the Education Wing only to allow
for a preschool to operate within the existing building Monday through Friday.
Operation of the preschool will occur at times currently when the building is not
heavily used. This preschool will serve children ages 3 to 6. It is anticipated that
there will be no more than 50 children maximum in the preschool.
Tigard Christian Church is solely owned by the congregation and governed by a
Board of Elders. There are paid staff members which deal with the day to day
operation.
The preschool intends to occupy three existing classrooms on the Lower Level of
the Education Wing. The classroom rooms on the Lower Level are connected to
a rated corridor that exists directly to grade at either end of the corridor. Arrival
and departure for the school will use the West exit. Parking and/or drop off will
occur from the adjacent existing parking area.
There is no building additions or alterations planned for with this Occupancy
Change. There is no addition or modification to existing site parking planned for
with this Occupancy Change. There is no modification to vehicle or pedestrian
access to the site planned for with this Occupancy Change.
There is no anticipation of exterior signage on the property or the building for this
preschool. If such signage is requested it will be brought forward at a later date.
Tigard Christian Church existing waste/collection will be used any waste
generate by the preschool.
Existing Conditions:
The building was originally construction in 1964 and since that time it has had
three additions. The most recent in 1991 with the construction of the Education
Wing which is the area of the building we are proposing to locate the preschool.
According to existing construction documents the building was classified with the
City under UBC as an A-3 Occupancy, Type 5-1 Hr Construction. According to
today's Code: 2007 Oregon Structural Specialty Code, we believe this to be; A-3
Occupancy, Type 5-A Construction. There currently exists a Two Hour Fire Wall
with one and one half hour fire rate doors between the Education Wing and rest
of the building. This Wing is two stories, rectangular in shape with an exit at
each end which exists directly to the outside at grade from the Lower Level. The
Education Wing is not sprinkled and is approximately 6,200sf per floor. Within
this Wing there is a one hour rated double loaded corridor with self closing 20
minute rated doors to individual rooms.
Evaluation Criteria, City of Tigard 18.360.050 (B):
1 . An increase in dwelling unit density, or lot coverage for residential
development;
This Occupancy Change will not increase density or lot coverage as there
will be no construction. Use of the building will occur at off times from
normal Church functions.
2. A change in the ratio or number of different types of dwellings units;
Does not apply.
3. A change that requires additional on-site parking in accordance with
Chapter 18.765;
An increase in the existing parking is not proposed with this Occupancy
Change. It is anticipate that 6 to 10 spaces will be used by preschool staff
and parents although most parents will be dropping children off and
parking only temporarily.
4. A change in the type of commercial or industrial structures as defined by
the Uniform Building Code;
As noted we are only seeking an Occupancy Change classification.
5. An increase in the height of the building(s) by more than 20%;
Does not apply.
6. A change in the type and location of accessways and parking areas where
off-site traffic would be affected.
There will be no changes to parking lot ingress/egress. Drop off for the
preschool will occur in a similar location to that servicing the Church on
Sunday morning.
7. An increase in vehicular traffic to and from the site and the increase can
be expected to exceed 100 vehicles per day;
The preschool will be operating at off times from that of the Church
functions. It is anticipated that multiple children will arrive/depart in
individual vehicles and will not exceed the 100 vehicle trips per day.
8. An increase in the floor area proposed for a nonresidential use by more
than 10% excluding expansion under 5,000 square feet;
Does not apply.
9. A reduction in the area reserved for common open space and/or usable
open space which reduces the open space area below the minimum
required by this code or reduces the open space area by more than 10%;
No reduction in open space is planned or anticipate.
10.A reduction of project amenities below the minimum established by this
code of by more than 10% where specified in the site plan:
a. Recreational facilities;
No reduction in recreational facilities is planned.
b. Screening; and/or
No reduction in screening is planned.
c. Landscaping provisions
No reduction in landscaping is planned.
We believe this change in Occupancy Classification meets the conditions of a
Minor Modification and compliments current use and occupancy of the building.
Attached is a site plan identifying the existing building, parking and location of the
proposed preschool.
