Boise,ID 83704 RE: Tigard WinCo Foods Minor Modification Request, Case File No. MMD2008-00002 Dear Mr. Van Enan: This letter is in response to your request for a Minor Modification approval (MMD2008-00002) of the approved WinCo Foods site development plan (SDR2007-00002) located at 7501 SW Dartmouth Street, WCTM 15136CD,Tax Lot 4500. This decision approved a 9,824 square foot addition at the rear of the building and 3,501 square foot expansion into neighboring retail space for the existing WinCo store. A Minor Modification (MMD2007-00014) in 2007 approved re-striping and landscape changes to the existing parking lot. As in previous applications, no work is proposed within the adjacent sensitive lands. The current request is to reduce the previously approved addition by 582 square feet, from 9,824 to 9,242 square feet. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore,this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. Required parking is based on the square footage of the uses. The existing retail building with the previously approved addition is 92,776 square feet. This requires 344 spaces, with a maximum of 576 spaces allowed. With the proposed reduction 342 spaces are required, and a maximum of 572 spaces are allowed. The WinCo parkin lot has 490 spaces which meets the minimum and maximum requirements. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural type of the buildings is proposed, but permitting by the Tigard Building Division is required for the addition. This cnterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The proposal is to decrease the proposed square footage by 582 square feet. No changes are proposed to the height of the building. This criterion does not apply. 6. A change in the type and location of accessways and parking areas where of site traffic would be affected. No changes to the access and egress driveways are proposed. Off-site traffic will not be affected by the building square footage reduction. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. A reduction to the previously approved square footage will not increase vehicular traffic to and from the site. This criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposal is to reduce the previously approved addition by 582 square feet to 9,242 square feet. No expansion is proposed;therefore this standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There are sensitive lands on- site to the west of the existing improvements. No changes are proposed to decrease this open area. This standard is met. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The addition was approved within an existing asphalt area of the site. No landscaping or screening will be affected by the building reduction. Based on the Site Development Review (SDR2007-00002), approximately 32% of the site is landscaped. This exceeds the 15% required for the General Commercial zone. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. The original site plan was approved under SDR2007-00002. The proposed modification does not affect the conditions imposed by this decision. No changes to the conditions are requested with this application. This criterion is met. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties,provided that development which occurs after this decision complies with all applicable local, state,and federal laws and the condition of approval below: Page 2 of 3 CONDITION OF APPROVAL PRIOR TO THE ISSUANCE OF SITE AND/OR BUILDING PERMITS, THE FOLLOWING CONDITION SHALL BE SATISFIED: (The staff contact shall be Cheryl Gaines in the Planning Division(503) 639-4171.) 1. Refinements were made to the architectural plans and the building footprint was reduced by 582 square feet. No changes to site design, landscaping, vehicle circulation, pedestrian accommodations, utilities and infrastructure will occur with the proposed reduction. WinCo Building Expansion 3 WRG Design,Inc. City of Tigard—Minor Modification February 22,2008 TIGARD MUNICIPAL CODE 18.360 SITE DEVELOPMENT REVIEW 18.360.050 Major Modification(s) to Approved Plans or Existing Development B. Evaluation criteria. The Director shall determine that a major modification(s) will result if one or more of the following changes are proposed.There will be: 1. An increase in dwelling unit density,or lot coverage for residential development; Response: No residential development is proposed. This criteria does not apply. 2. A change in the ratio or number of different types of dwelling units; Response: No residential development is proposed. This criteria does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765; Response: The reduction of square footage to the building footprint does not require additional on- site parking in accordance with Chapter 18.765. 490 parking spaces already exist on the site. A total of 504 parking spaces are proposed as part of the approved parking lot improvements (MMD2007-00014). The amount of parking proposed falls within the range of parking spaces allowed for this site. This criteria is met. (92,184 SF/ 1,000)x 3.7=341 minimum parking spaces (92,184 SF/ 1,000)x 6.2=572 maximum parking spaces 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; Response: No changes in the type of commercial or industrial structures as defined by the Uniform Building Code are proposed. The current structure is a WinCo Foods store and it will remain.This criteria is met. 5. An increase in the height of the building(s) by more than 20%; Response: No changes to the building height are proposed with this minor modification request. This criteria does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected; Response: No changes to the access and egress driveways are proposed. No off-site traffic will be affected by the building square footage reduction. This criteria is met. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; Response: A reduction in the square footage for the building expansion will not generate additional traffic to or from the site.This criteria is met. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; Response: The current development application is requesting approval for a reduction in building square footage of the previously approved building expansion. Screening; and/or c. Landscaping provisions. Response: No reduction of project amenities is proposed. This criteria is met. 11. This criteria is met. 18.360.060 Minor Modification(s)to Approved Plans or Existing Development A. Minor modification defined. Any modification which is not within the description of a major modification as provided in Section 18.360.050 shall be considered a minor modification. Response: The responses and development plans included in this application submittal provides evidence that this proposal meets all the criteria necessary to be qualified as a Minor Modification. C. Approval criteria. A minor modification shall be approved, approved with conditions or denied following the Director's review based on the finding that: 1. The proposed development is in compliance with all applicable requirements of this title; and Response: This narrative, attached exhibits and the Development Plan Set provide evidence that the proposal is in compliance with all applicable requirements of this title. 2. The modification is not a major modification. Response: As provided in the responses to the applicable criteria above, clear evidence has been supplied which proves that the modification proposed is not a major modification.
