The site is zoned Industrial Park (I-P), as are parcels to the east and south. Medium-High Density residential zoning (R-12) is to the west of the site and north across Durham Road. The request is to change the existing bulk retail sales use in Suite 400 (furniture sales - Cachet Home Furnishings) to Light Industrial (catering business — Portland Catering Company). The Light Industrial use is permitted in the I-P zone. A search of City records revealed several land use permits issued for the parcel. The original approval for a 21,000 square-foot commercial building was given in 1998 (SDR98-00004). An addition of 10,320 square feet (SDR2000-00016) and lot line adjustment (MIS2000-00007) were approved in November 2000. A Conditional Use Permit (CUP2007-00004) was granted in 2007 to join the access for Durham School to the west with the existing access for Jackson Business Center. No other land use cases were found. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore,this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The original approval (SDR98-00004) for Jackson Business Center required a total of 21 parking spaces for a mix of uses (Industrial Services, Light Industrial and Wholesale Sales). The addition in 2000 required an additional 19 spaces for assumed uses of Office, Warehouse, and Light Industrial. The combined total number of required spaces is 40. A site visit and review revealed that the proposed mix of uses is Wholesale Sales, Light Industrial, and Office. Based on the square footages of the suites, a minimum of 59 spaces are required for the current mix of proposed uses. Previous SDR approvals show a total of 98 spaces were provided. The recent approval to grant joint access to Durham Elementary School eliminated 11 parking spaces according to the site plan; therefore the net is 87 parking spaces. No additional on-site parking is required for the proposed change. This standard is met. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural type of the buildings is proposed. This criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The proposal is the change of use in Suite 400 from Bulk Retail to Light Industrial. No changes are proposed to the height of the building. This criterion does not apply. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. No changes to the access and egress driveways are proposed. Off-site traffic will not be affected by the change of use. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The applicant states that on average, there will be three (3) employees present and likely 2 visitors. Catering delivery trips will average 12 vehicle trips per clay with four vehicle trips associated with lunch deliveries, two morning vehicle trips, and six afternoon trips. This number of trips is not an increase greater than 100 vehicle trips per day. This criterion is satisfied. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The applicant is not proposing to increase the floor area of the building. This standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. There are no areas reserved for common open space within this development. This standard does not apply. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. All modifications will be interior. Landscaping, screening and other site amenities will not be affected by the proposed change of use. Based on the Site Development Review (SDR2000-00016),approximately 23% of the site is landscaped. This exceeds the 20% allowed in the Industrial Park zone through Site Development Review. Page 2 of 3 f 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above this subsection. Previous site designs were approved under SDR98-00004 and SDR2000-00016. The proposed modification does not affect the conditions imposed by these decisions. No changes to previous imposed conditions are requested with this application. This criterion is met. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, or injurious to surrounding properties, provided that development which occurs after this decision complies with all applicable local, state,and federal laws: This request for Minor Modification approval is hereby granted. That requies that we leave once in the morning and once agian just before lunch. In the mornings we will likely only have one vehicle leaveing and returning however, in the afternoon we will usually have two vehicles possibly three leaving and returning. How many employees are present on a typical day? 4 - What is the business in suite 900.
