Box [GARD Tigard, OR 97281 RE: Minor Modification Approval City of Tigard Case File No. MMD2008-00020/Tigardville Station Dear Mr. Louw: This letter is in response to your application dated September 29, 2008 for a Minor Modification approval for an addition (10 feet by 18 feet =180-square feet), a front awning (6 feet by 50 feet = 300 square feet), and a rear awning 8 feet by 30 feet =240 square feet) to the existing building located at 12370 SW Main Street;Washington C aunty lax Assessor's Map 2S 102AB, Tax Lots 3900/4200/4290 within the City of Tigard, Oregon (formally "Manila Express Bar &Grill"). A 117-square foot accessory structure for use as a coffee shack is also proposed to be located in the parking lot. The proposed modifications to the existing development are described in the application narrative and site plan. The following analysis shows that, the proposed development is a minor modification and is hereby approved,with conditions of approval. Section 18.360.060.A of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The subject development is commercial. This criterion does not apply. 2. A change in the ratio or number of different types of dwelling units. The subject development is commercial. This criterion does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposed addition would increase the floor area of the existing structure by 180 square feet. Pursuant to Table 18.765.2, Note 5, remodeled buildings that add square footage are required to add additional off-street parking. At 15.3 spaces per 1,000 square feet for eating and drinking establishments, three additional spaces would be required (1.8 x 15.3 = 2.7). Staff conducted a site visit and determined that approximately 14 parking spaces exist on the subject site. As the existing building_ require 36 spaces (2,400 square feet x 15.3 spaces/1,000 square feet = 36 spaces), it is nonconforming. Tigard Development Code 18.765.020 states that for the expansion of an existing use, the number of vehicle parking spaces required shall be based only on floor area capacity of such enlargement. Provided the nonconforming development can accommodate three additional parking spaces, and acknowledging the site's constraints, the proposed addition would not be subject to a major modification determination. However,the property lines are such that the Building Code would prohibit the addition as proposed, where the addition crosses property lines. The applicant has considered consolidating the property lines to remove the building code obstacle. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. The proposed modification does not involve a change to the type of commercial structure. According to the applicant's narrative, the proposed building height will increase by 20% from 15 feet to 18 feet. The applicant has submitted elevation drawings showing a sign that extends above the existing parapet by three feet. As this is not allowed by the sign code, the applicant is considering extending the parapet by three feet and affixing the proposed sign as a wall sign. Extension of the parapet would be allowed as a minor modification to the existing development provided it did not exceed 3 feet or 20%. This can be verified when the applicant submits an application for a sign permit. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The modification proposal does not include any change in the type or location of accessways or parking areas. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposed covered areas would not result in additional trips other than would be expected from a natural increase in patrons due to an improved reputation from an aesthetic upgrade and patio amenity. Therefore, an increase in vehicular traffic as a result of the modification would not be expected to exceed 100 vehicles per day. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed 540 square feet covered by the proposed awnings replace an existing awning in the front of the building and, in back, would cover an existing asphalt path. Further, the additional covered area is less than 5,000 square feet and is,therefore,excluded. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The Development Code requires a minimum 15% landscaped area. The existing building is approximately 2,400 square feet in size. The three parcels together total approximately 9,764 square feet. As shown in an aerial view of the subject property, a small portion of the site at the perimeter on the south and west property lines is in landscaping (approximately 1,200 square feet or 12%). The property is otherwise paved and used for parking. The proposed awnings would be built over an existing deck in the front and over a sloped paved area not used for parking) in the rear. The existing open space area is non-conforming. The proposal would not reduce the existing open space area. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. As shown in the applicant's site plan, the proposed awnings and accessory structure would not reduce the existing landscaped area and no recreational facilities or screening exists on the site. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria B1 through 10 above. A review of City records found no land use permits applicable to the subject property. The development occurred prior to the City's incorporation and proposed modifications do not modify any conditions of approval. If the applicant wants to pursue the proposed addition, a copy of a recorded lot consolidation would be required, as conditioned below. In addition,Tigard Development Code (TDC) 18.360.060.C1 states that a minor modification shall be approved approved with conditions, or denied following the Director's review based on the finding that the proposed development is in compliance with all applicable requirements of this title. TDC 18.765.040 contains general design standards for parking lots. Standards regarding pedestrian access surfacing, striping, and space and aisle dimensions shall be addressed when accommodating the three additional required spaces and location of the proposed accessory structure,as conditioned below. TDC 18.520.030.C,states "accessory structures are permitted in all commercial zones providing the site is in compliance with all development standards, including but not limited to setbacks, height, lot coverage and landscaping requirements, Of the base zone. All accessory structures shall comply with all requirements of the Uniform Nuilding Code. All accessory structures except those less than 120 square feet in size require a building permit." Therefore,the applicant must comply with the following applicable development standards: TDC 18.705.030.F.1 states, ". . unless impractical, walkways shall be constructed between new and existing developments and neighboring developments. TDC 18.705.030.3 states "wherever required walkways cross vehicle access driveways or parking lots, such crossings shall be designed and located for pedestrian safety. Required walkways shall � physically separated from motor vehicle traffic and parking by either a minimum 6-inch vertical separation (curbed) or a minimum 3-foot horizontal separation,except that pedestrian crossings of traffic aisles are permitted for distances no greater than 36 feet if appropriate landscaping, pavement rings, or contrasting pavement materials are used. Walkways shall be a minimum of four feet in width, exclusive of vehicle overhangs and obstructions such as mailboxes,benches,bicycle racks,and sign posts,and shall be in compliance with ADA standards. CONDITIONS OF APPROVAL: 1. Prior to issuance of building permits for the proposed addition,the applicant shall submit a copy of a recorded lot consolidation demonstrating the proposed addition does not cross property lines. 2. Prior to issuance of building permits, the applicant shall submit a site plan demonstrating compliance with the applicable parking standards regarding pedestrian access, surfacing, striping,and space and aisle dimensions. 3.
