Beaverton, OR 97007 RE: National Safety Office Building Minor Modification Request (MMD2009-00028) 7075 &7105 SW Gonzaga Street;WCTM 2S101AC,Tax Lots 300&400 Mr. Skourtes: This letter is in response to your request for a Minor Modification(MMD2009-00028) of the previously approved Site Development Review(SDR2008-00006) on the property located at 7075 &7105 SW Gonzaga Street. This proposal is to increase the square footage of the building from 10,416 square feet to 11,160 square feet. By enlarging the building footprint,the eastern side yard setback will be reduced to 11.59 feet. No other changes are being proposed or approved through this modification. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter,states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore,,this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The approved plan shows 46 parking spaces. A minimum of 38 spaces was required for the 10,416 square foot building (70% dental office/30% regular office) previously approved. This proposal is for an 11,160 square foot building. With the same mix of uses, 41 spaces are required. Because adequate parking has been proposed,this criterion has been satisfied. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural type of the buildings is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to building heights. Therefore,this standard is met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. The proposal is to enlarge the proposed building. No changes are proposed to accessways or parking areas. This criterion is satisfied. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. The proposed 544 square foot increase will increase the vehicle traffic by no more than 10 per day. This cntenon is met. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposed expansion is 544 square feet. Therefore,this standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. No common open spaces were previously required. This criterion is not applicable. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The approved proposal had 26.7% landscaping (8,263 square feet). Landscaping will be 25.5% with the proposed larger building (7,894 square feet). This is a reduction of roughly 4.7%. No other amenities will be affected by the building increase. This standard is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. Staff has reviewed the previous Site Development Review (SDR2008-00006). This proposal does not modify or adversely affect any previously imposed conditions. All conditions associated with SDR2008-00006 must be satisfied. This standard is met. In addition to showing that the modification is not a major modification, Section 18.360.060 requires that the proposed development is in compliance with all applicable requirements of this title. The following standards are applicable to the proposal: Section 18.520.050.C.1 states that the maximum floor area ratio (FAR) for all commercial and industrial use types and mixed-use developments within the Mixed Use Employment (MUE) zone shall not exceed 0.40. Residential use types, including transient lodging, shall not be subject to this requirement. Per the original approval,the proposed 10,416 square foot building had a FAR of 0.35. The new building at 11,160 square feet will have a FAR of 0.37. Therefore,this standard is met. Page 2 of 3 Section 18.620.040.A.1 requires that all street-facing elevations within the Building Setback (0 to 10 feet) along public streets shall include a minimum of 50% of the ground floor wall area with windows, display areas or doorway openings. The ground floor wall area shall be measured from three feet above grade to nine feet above grade the entire width of the street-facing elevation. The ground floor window requirement shall be met within the ground floor wall area and for glass doorway openings to ground level. Up to 50% of the ground floor window requirement may be met on an adjoining elevation as long as all of the requirement is located at a building corner. The proposed building is 90 feet along the street (south elevation). That would mean a ground floor window area of 270 square feet (90 x 6 x 50%). Based on plans submitted to the Building Division (Sheet A3) in May 2009, the proposed window and door area is 285 square feet. This total includes three windows at the corner of the west elevation (64 feet). The window/doorway requirement within the ground floor area is met. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local,state,and federal laws. The ground floor window requirement shall be met within the ground floor wall area and for glass doorway openings to ground level. Up to 50% of the ground floor window requirement may be met on an adjoining elevation as long as all of the requirement is located at a building corner. The proposed building is 90 feet along the street (south elevation). That would mean a ground floor window area of 270 square feet (90 x 6 x 50%). Based on plans submitted to the Building Division (Sheet A3) in May 2009, the proposed window and door area is 285 square feet. This total includes three windows at the corner of the west elevation (64 feet). The window/doorway requirement within the ground floor area is met.
