First off, thank you for taking the time to review the sign permit application with me yesterday. Hopefully, there was no
issue while manually entering the $178 credit card payment today. As we discussed, attached is the pdf of the drawings,
along with the 2 page of sign application containing the property owners signature. Also attached, is a revised page 1
of the Sign Application, as the property owner recommended we use the local IS Properties PO Box address. Clear
Channel sends all rent checks and correspondence to this PO Box as well. The Texas address is where county tax
statements are sent.

Hi Jami,
This email is intended as a follow -up to my voicemail of a few minutes ago. As I stated there, we've run into an issue
with your sign permit to convert an existing billboard to LED.
While there are nonconforming aspects of your billboard in regards to dimensions and number, the core issue is
whether or not an "electronic message center" may be erected on this property. As an industrially zoned property (I -L:
Light Industrial to be specific), the city is not able to permit an electronic message center within the zone, and as such
we should not have accepted the application. This oversight was likely due to the lateness of the hour when you arrived,
and our endeavors to provide good customer service and save you a second trip. I recommend we void the application
and issue a full refund. Please let me know if that is acceptable to you.
Since you'll probably want to read the code language for yourself I am including relevant excerpts below. Please feel
free to give me a call to discuss this. Also, we may want to review the zoning designations of the other billboards you
plan to convert so we can avoid this issue in the future. Sorry for the bad news.

18.780.015 Definitions
A. Definitions. As used in this title, unless the context requires otherwise, the following words and
phrases shall have the meanings set forth in this chapter. The definitions to be used in this chapter are
in addition to Chapter 18.110, Definitions, and are as follows:
18. "Electronic information sign" means signs, displays, devices or portions thereof with lighted
messages that change at intermittent intervals, each lasting more than two seconds, by electronic
process or remote control. Electronic information signs are not identified as rotating, revolving or
moving signs. Also known as an automatic changeable copy sign or electronic variable message
center.
18.780.090 Special Condition Signs
D. Electronic message centers.
1. Electronic Message Center (variable message) sign regulations shall be as follows:
a. Electronic message center signs shall be permitted only in the C -G and MU -CBD zones, and
at schools that front an arterial street where the sign is not less than 200 feet from an abutting
residential use and is oriented to the arterial street;
b. The maximum height and area of an electronic message center sign shall be that which is
stipulated in Section 18.780.130;
c. An electronic message center shall be allowed to substitute for one freestanding sign or one
wall sign;
d. One electronic message center sign, either freestanding or wall- mounted, shall be allowed per
premises;
e. With regard to light patterns:
(1) Traveling light patterns ( "chaser effect ") shall be prohibited;
(2) Messages and animation shall be displayed at intervals of greater than two seconds in
duration.

Hello Jami,
As we discussed on Tuesday morning, the planning department met to review the conversion of existing, non-
conforming billboards to LED displays. Having reviewed the sign code (Tigard Development Code Chapter 18.780), we
find the conversion to LED displays to be outside of the scope of changes allowed under nonconforming sign regulations
(18.780.110), and requires approval under all applicable sign standards at the time of application (18.780.020-
030). This would include regulations applicable to the base zone, as well as special regulations applicable to
billboards, free -way oriented signs and electronic message centers. The six permits issued in April were done so in error,
but will not be withdrawn or invalidated at this time. Please note the permits lapse after 90 days unless extended or
vested.
This leaves the city unable to approve your sign permit of July 25 (SGN2013- 00084). I can void this permit and issue a
refund if you like. Just reply to this email if that is your preference.
Please forward this message to your colleague Dan who also attended our Tuesday meeting. I left him a voicemail, but
don't have an email for him at this time.

I tried calling you a couple of times and left a voicemail, but since you might be on vacation I'm going to send an email as
well. We have reconfirmed our decision that your recent applications for two LED billboards were issued in error, and
will be refunding your application fees and closing the cases. Since I know you are interested in the fate of the recently
constructed LED billboard at 10185 SW Cascade, I can say that we have asked the owner to remove the LED sign and
restore it to original condition. Let me know if you have any questions.
