accommodate a full range of retail, office and civic uses with a City -wide and even
regional trade area. A wide range of uses, including but not limited to adult
entertainment, automotive equipment repair and storage, mini - warehouses, utilities,
heliports, medical centers, major event entertainment, and gasoline stations, are
permitted conditionally.

Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request. The findings and conclusions on which the decision is based are noted
in Section IV.
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE
OF THIS DECISION.

SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 9855 SW Walnut Place, at the northeast corner of Walnut Place and Pacific
Highway (99W). The approximately half -acre site contains an existing six -bay, self - service car wash
and a storage structure. The property is part of a three lot commercial area also containing Davidson's
Restaurant and a Jiffy Lube. Parking is not shared, but common drive aisles provide for internal
circulation.
Proposal Description:
The project would include the following modifications to the existing structure and site plan:
➢ The relocation of three existing self -serve vacuum stations.
➢ The conversion of three existing self -serve bays to the following:
o One "touch -less automatic wash bay ".
o One equipment room to support the automatic car wash system and vacuum stations.
o One car - detailing area.
➢ The construction of a free - standing, galvanized canopy approximately 650 square feet in size.
➢ New striping to provide navigational arrows for vehicles using the automated car wash.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
The proposed site improvements will modify the existing conditional use on the site. Therefore,
compliance with applicable development standards must be demonstrated.
MINOR MODIFICATION OF APPROVED OR EXISTING CONDITIONAL USE: Section
18.330.020.C.3 states a Minor Modification shall be approved, approved with conditions, or denied
following the Director's review based on the following findings:
1. The proposed development is in compliance with all applicable requirements of this
title.
The project conforms with all applicable requirements pertaining to permitted land uses,
development standards, and off -street parking within the C -G zoning district. Changes
proposed do not constitute a change of land use classification, and the proposed canopy
satisfies all development standards including setbacks and stacking lane requirements for
mechanical car washes.
2. The modification is not a major modification.
Section 18.330.020.B.2 states that the Director shall determine that a major modification
will result if one or more of the following changes are proposed:
1. A change in land use;
The project does not change the land use, only modify the existing configuration and
equipment. Therefore, this criterion does not apply.
2. A 10% increase in dwelling unit density;
There are no dwelling units on the property. Therefore, this criterion does not apply.

3. A change in the type and /or location of access ways and parking areas where
off -site traffic would be affected;
The project does not change the type or location of access ways serving the property.
Stacking lane requirements for mechanical car - washes are satisfied, and off -site traffic
flow is not expected to change as a result of this project. Therefore, this criterion does
not apply.
4. An increase in the floor area proposed for non - residential use by more than 10%
where previously specified;
A search of land use files for this property did not reveal any previous approvals that
would have specified floor area. Therefore, this criterion does not apply.
5. A reduction of more than 10% of the area reserved for common open space
and /or usable open space;
The project does not reduce areas reserved for common and /or usable open space.
Therefore, this criterion does not apply.
6. A reduction of specified setback requirements by more than 20 %;
The project does not change or affect setback requirements. Therefore, this criterion
does not apply.
7. An elimination of project amenities by more than 10% where previously specified
provided such as:
(1) Recreational facilities;
(2) Screening; or
(3) Landscaping provisions; and
The proposed project does not eliminate any recreational facilities, screening, or
landscaping. Therefore, this criterion does not apply.
8. A 10% increase in the approved density;
The project does not include or affect residential land uses. Therefore, this criterion
does not apply.
Based on the analysis above, the project does not meet the criteria for a major
modification.
FINDING: Based on the analysis above, staff finds that the criteria for minor modification of a site
development have been met.

THIS DECISION IS FINAL ON FEBRUARY 27, 2012.
AND BECOMES EFFECTIVE ON FEBRUAY 28, 2012.

9855 SW Walnut Place. Unfortunately we cannot approve your application until the following
revisions are made:
1. Please revise your site plan to remove all unrelated markings to this application. A
redlined site plan has been attached for your reference. .
2. During a recent site visit by staff, it was noted that two tow - trucks are parked on your
property. Based on previous conversations at the Permit Center, City staff
understands they are parked here when not in operation. Please note how many
parking spaces, and which ones, are dedicated to this use.
3. Please detail the dimensional standards of the vacuum stations as they do not appear
to be drawn to scale on your siteplan.
