VAR2O13 00004 TIGARD PLAZA PARKING ADJUSTMENT NOTICE OF TYPE II DECISION IN TIGARD PLAZA PARKING ADJUSTMENT VARIANCE (VAR) 2013 -00004 TIGARD 120 DAYS = 9/10/2013 SECTION I. APPLICATION SUMMARY FILE NAME: TIGARD PLAZA PARKING ADJUSTMENT CASE NOS.: Variance (VAR) VAR2013 -00004 PROPOSAL: The applicant is requesting approval for an Adjustment to the minimum parking requirement from 389 spaces to 312 spaces (a 20% reduction). There will be no additional paving as the site currently accommodates 312 spaces. This will allow for additional tenants to use vacant floor space within the shopping center. APPLICANT: Tigard Plaza, LLC OWNER: Same as applicant Jack Steiger 8320 NE Highway 99 Vancouver, WA 98665 ZONING: MU -CBD: Mixed Use - Central Business District. The MU -CBD zoning district is designed to provide a pedestrian friendly urban village in downtown Tigard. A wide variety of commercial, civic, employment, mixed - use, multifamily and attached single - family residences are permitted. New development and redevelopment is required to conform to the standards of Chapter 18.610. LOCATION: 11945 SW Pacific Highway; WCTM IS135DD, Tax Lot 03301. APPLICABLE REVIEW CRITERIA: Community Development Code Section 18.370.020.C.7 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above requested Adjustment to the minimum parking requirements. The findings and conclusions on which the decision is based are noted in Section V of this Decision. SECTION III. BACKGROUND INFORMATION Site Information: VAR2013 -00004 TIGARD PLAZA PARKING ADJUSTMENT Page 1 The subject property is located at the northwest corner of the intersection of SW Hall Boulevard and SW Pacific Highway. It is further bound by SW 88 Avenue to the north. The 6.45 acre site is currently developed with two commercial buildings, a total of 118,090 square feet, with mixed use occupancies. The property is zoned Mixed Use - Commercial Business District as are properties to the south, east and west; properties to the north are zoned Medium Density Residential (R -12). Site History In a search of city historical records, the construction of the shopping center dates back to 1961. Since construction, there have been several conditional use permits approved (CU57 -76, CU12 -77, CU17 -77) and a site development review (SDR97 -0002) to accommodate new tenants. A minor modification (MMD2005- 00016) was approved to permit a larger sign than what was originally allowed. There have also been several temporary use permits, between 1995 and 2001, for Christmas tree and firework sales. No other permits were found. In 2011, the SW Pacific Highway /SW Hall Boulevard intersection improvements resulted in a loss of 20 spaces for the shopping center. Proposal Description: The applicant is requesting approval for an Adjustment to the minimum parking requirement from 389 spaces to 312 spaces (a 20% reduction). There will be no additional paving as the site currently accommodates 312 spaces. This will allow for additional tenants to use vacant floor space within the shopping center. SECTION IV. PUBLIC COMMENTS Staff mailed a notice of pending land use application to property owners within 500 feet of the subject site and to the Interested Parties list maintained by the city. Staff received a telephone inquiry from one property owner requesting clarification. The city received no written comments. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS A. ADJUSTMENT TO PARKING REQUIREMENTS Section 18.370.020.C.7.a states that by means of a Type II procedure, as governed by Section 18.390.040, the Director may authorize up to a 20% reduction in the total minimum vehicle parking spaces required in Section 18.765.070.H when an applicant for a development permit can demonstrate in a parking study prepared by a traffic consultant or in parking data from comparable sites that: 1. Use of transit, demand management programs, and /or special characteristics of the customer client employee and resident population will reduce expected vehicle use and parking space demand for this development, as compared to standards Institute of Transportation Engineers (ITE) vehicle trip generation rates and minimum city parking requirements, and; 2. A reduction in parking will not have adverse impact on adjacent uses. The applicant submitted a parking analysis, prepared by Dan Seeman of Kittelson & Associates, Inc, dated May 8, 2013. Parking demand was observed on peak periods of demand; Tuesday, April 2 from 11 AM to 2 PM and Friday, April 5, from 4 PM to 7PM. The table below demonstrates the parking demand and utilization for the site. The report concludes that based on the parking counts, the shopping center has unique characteristics that result in significantly lower parking needs compared to typical parking rates generated by similar uses. In addition, several TriMet bus lines (Lines 12, 76, 78 and 94) run within the vicinity along SW Pacific Highway and SW Greenburg Road. These lines provide both local and regional services to the Tigard Plaza shopping center. In 2011, the SW Pacific Highway and SW Hall Boulevard intersection project resulted in a loss of twenty spaces along SW Hall Boulevard. Since this intersection project created a further non- conforming situation for the parking center, the city has agreed to grant credit for the twenty parking spaces. In accordance with TDC 18.765.070 and based on existing uses, the shopping center is required to provide 389 spaces. The 20 percent adjustment reduces the required spaces to 312, which is what currently exists. The credit of 20 spaces due to the intersection project brings the total of spaces up to 332. The table below summaries the Tigard Plaza parking calculation and adjustment request. B. IMPACT STUDY Section 18.390.040.B.2.e states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standards, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. The proposed parking adjustment will not impact parks, the sanitary sewer, water or drainage system, or transportation system. The adjustment will not result in construction of additional parking facilities or paving therefore, there will be no impact to the storm drainage system. The surrounding areas to the south, east, and west are similar commercial uses. The adjustment will not impact public facilities or services. This criterion is met. This analysis is particularly triggered by the re -use of Unit 238, which previously was occupied by a bridal shop and is proposed for use as a church. This report documents the current supply and demand of parking at the shopping center, and is meant to serve as a basis to determine parking adequacy for future changing uses at the center. The parking analysis documented in this memorandum addresses the requirements prescribed in City of Tigard guidelines and discussions with City staff in a pre - application conference. The Tigard Plaza Shopping Center has 118,090 gross square feet of building space that is inhabited by about 35 different businesses providing a wide range of services from tattoos to accounting, and products from coffee to carpets. A site plan is attached. EXISTING PARKING DEMAND AND SUPPLY SURVEY A parking survey was conducted to determine the adequacy of parking during peak times at the center. Based on discussions with City staff, it was decided that peak periods of demand at the center occur during the lunch hour on typical weekdays, and during the early evening hours on Friday. Thus, parking demand at the center was observed every half hour on Tuesday, April 2 from 11:00 a.m. to 2:00 p.m. and on Friday, April 5 from 4:00 p.m. to 7:00 p.m. These dates and times were deemed to be "typical" with respect to parking demand, in recognition that normal activities occurred at the shopping center and on the adjacent public street system. Parking spaces were also counted. This includes 195 striped spaces in the Main Lot (upper Level) that is at ground level and alongside Hall Boulevard and Highway 99W as well as 102 striped spaces in the Lower Level lot to the west of the buildings and 15 striped spaces (that were always empty) in the North Lot, north of the buildings. Of the 312 striped spaces, 7 are designated handicapped spaces, while another 3 spaces are designated for 10- minute parking only. All of these specialized parking spaces were in the Main Lot. Existing Parking Demand Parking demand was observed every half hour on Tuesday, April 2 during the 11:00 a.m. to 2:00 p.m. time period. During that interval, there were no more than 129 (41 %) parking spaces occupied at any time; the majority of spaces remained empty the whole time, with between 177 and 188 spaces available. There was heavier use of the Main Lot than of the Lower Level lot, yet a majority of spaces remained empty even in the Main Lot. Therefore, between 11:00 a.m. and 2:00 p.m. on a "typical" weekday, there was an abundance of empty parking spaces. Parking demand was also observed on Friday, April 5 between 4:00 and 7:00 p.m. Parking demand was somewhat heavier than as measured during the weekday lunch period. Nonetheless, no more than 193 (62 %) of all parking spaces were occupied; between 113 and 166 parking spaces remained empty at any time. Up until 6:30 p.m. there was a higher level of parking occupancy in the Main Lot. After that time, the Lower Level lot filled up to a higher degree such that by 7:00 p.m. an observed 69% of the Lower Level spaces were occupied, while only 49% of the Main Lot spaces were occupied. Even at this highest demand time, there remained abundant parking spaces available at the Tigard Plaza Shopping Center. ADDITIONAL PARKING DEMAND FROM BRIDAL -TO- CHURCH RE -USE The Precious Memories Boutique bridal shop had vacated Unit 238 at the time the parking counts were conducted, and the Southside Church had not yet taken occupancy. Based on conversations with shopping center representatives and our knowledge of church operations, the highest demand period for the church will be on Sunday mornings, a time when the shopping center's demand is lowest. During the two peak time periods for which demand was observed, parking demand related to the proposed church use will be relatively low. Parking demand for the church during these weekday peak periods is estimated to be less than ten vehicles. For purposes of this analysis, a conservative assumption of ten vehicles is assumed for the church use during these periods. Thus, there would be abundant parking spaces available for the church or for other new land uses at this shopping center. Table 1 shows the projected parking demand, utilization, and surplus capacity during these peak periods. Kittelson & Associates, Inc. As previously summarized, the existing Tigard Plaza Shopping Center has a total of 312 parking spaces resulting in a parking deficit of 77 spaces. As stated in Development Code section 18.765.060 F.2., the total required off street vehicle parking spaces may be reduced by up to 20% when the following criteria in Section 18.370.020.C.7.a. can be met: 7. Adjustments to parking standards (Chapter 18.765). a. Reduction from minimum parking requirements. By means of a Type 11 procedure, as governed by Section 18.390.040, the Director may authorize up to a 20% reduction in the total minimum vehicle parking spaces required in Section 18.765.070.H when an applicant for a development permit can demonstrate in a parking study prepared by a traffic consultant or in parking data from comparable sites that: (1) Use of transit, demand management programs, and /or special characteristics of the customer, client employee or resident population will reduce expected vehicle use and parking space demand for this development, as compared to standards Institute of Transportation Engineers (ITE) vehicle trip generation rates and minimum city parking requirements, and (2) A reduction in parking will not have an adverse impact on adjacent uses. A review of the parking demand and utilization suggests that the Tigard Plaza Shopping Center has considerable surplus parking supply (119 stalls) during existing peak periods. In addition, estimated parking demand associated with a proposed church use is not anticipated to significantly reduce the excess parking supply during peak time periods. As such, it can be concluded that the unique characteristics of the shopping center result in significantly lower parking needs when compared to the typical parking rates generated by comparable uses. In addition, there are several TriMet bus lines that have stops in the vicinity of the Tigard Plaza Shopping Center (Lines 12 and 94 along Highway 99W and Lines 76 and 78 along SW Greenburg Road). Therefore, a 20% reduction in the total minimum vehicle parking spaces can be considered appropriate for this site. Table 2 summarizes the overall parking calculations for the Tigard Plaza Shopping Center. As shown in the table, a 20% reduction would result in a minimum parking requirement of 312 spaces. The existing parking supply of 312 spaces plus a credit of 20 parking spaces' results in an overall parking supply of 332 spaces. The existing Tigard Plaza Shopping Center has a total of 312 parking spaces resulting in a parking deficit of 77 spaces. Approximately 20 Tigard Plaza Shopping Center parking spaces were lost as part of the City's recent Highway 99W /SW Hall Boulevard intersection improvement project.
