BACKGROUND INFORMATION Site Information and Pro osal Descri tion: e site is a resi entiay eve ope parcel of land that was created by the Lake Terrace No. 2 subdivision in 1979. The drainage way in question was designated as a 20-foot-wide storm drainage easement at the time that the fot was originally created, and it is unclear whether or not the drainage way is natural or manmade. The existing facility is domestically landscaped. As a condition of the service provider letter, the applicant is required to enhance the buffer of the drainage way. The applicant is proposing to build a 564 square foot addition to the existing house that would encroach on the vegetated corridor as prescribed by Clean Water Services. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: The Tigard Community Development Code (TDC), Sensitive Lands Review Section, states that, "The Director shall review the repair, reconstruction, or improvement of an existing structure or utility, the cost of which is less than 50 percent of the market value of the structure prior to the imQrovement or the damage requiring reconstruction provided no development occurs in the floodway by means of a Type I procedure, as governed by Section 18.390.030 subject to compliance with all of the standards in this Chapter;" The applicant is proposing to construct a 564-square foot addition to an existin house, and disturb less than 5 cubic yards to connect to the existing rain drains within the vege�ated corridor of a drainage way. All applicable permits from CWS have been obtained. DRAINAGE WAY The extent and nature of the proposed land form alteration or development will not create site disturbances to the extent greater than that required for the use. There will be no change of use. Disturbance will be limited to that required to install the addition and the rain drain as discussed previously. This criterion is satisfied. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property. The work is subject to an approved erosion control plan and will be inspected by Clean Water Services prior to commencing construction. There is no evidence in the record to suggest that this disturbance will result in any adverse on or off-site effects or hazards to life or property. The water flow capacity of the drainage way is not decreased. The flow characteristics of the drainage way will not be altered. Where natural vegetation has been removed due to land form alteration or development, the areas not covered by structures or impervious surfaces will be replanted to prevent erosion in accordance with Chapter 18.745, Landscaping and Screening. In fact, the non-native plant materials are to be replaced with native and beneficial plantings. This criterion is satisfied. The drainage way will be replaced by a public facility of adequate size to accommodate maximum flow in accordance with the adopted 1981 Master Drainage Plan. The drainage way will remain in place and unaltered. The necessary U.S. Army Corps of Engineers (USACOE) and State of Oregon Land Board, Division of State Lands (ODSL) approvals shall be obtained. Since the activity does not relate to navigable waters, is outside of any designated wetland, and does not involve physical activity witfiin the drainage way with the exception of the plant restoration, the activity is exempt from the USACOE and ODSL approval. This criterion is satisfied. Where land form alterations and/or development are allowed within and adjacent to the 100-year floodplain, the City shall require the consideration of dedication of sufficient open land area within and adjacent to the floodplain in accordance with the Comprehensive Plan. The land form alteration is not adjacent to the 100-year floodplain. This criterion is not applicable. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice: Notice was mailed to the applicant and owners. Final Decision: This is a Type I Sensitive Lands Review. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. Response to Code 18.775-11 Section D. Within Drainageways: The extent and nature of the proposed land form alteration or development will not create site disturbances to an extent greater than that required for the use; The disturbance to be created for the proposed development will be confided to the specific areas required by Clean Water Services for Site Certification issuance as shown on sheet LA-1 for landscape plant materials additions and to the building addition (16'x24') shown on LA-1 and on site plan A-0. No greater work will be required. The rain drain will be re-connected to existing rain drains or connected to redistribution lines to be reabsorbed into the soil depending on location. The project is subject to an erosion control plan with Clean Water Services as the enforcement agency and is subject to joint enforcement from CWS and the City of Tigard. The proposed land form alteration or development will not result in erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or properry; Erosion control devices will be employed as per Clean Water services water quality protection requirements throughout the entire construction process to mitigate localized soil destabilization, which could occur for short periods of time during development. A Service Provider Letter has been submitted with this application dated March 22, 2004. The new and relocated rain drains will require a small trench (4" x 12") displacing only minor amounts of soil. The proposed development will create no erosion, stream sedimentation, ground instability, or other adverse on-site and off-site effects or hazards to life or property. The project is subject to an erosion control plan with Clean Water Services as the enforcement agency and is subject to joint enforcement from CWS and the City of Tigard. 4/16/04 Narrative for Sensitive Lands Review Tvpe I Administrative Review (continued) The water flow capacity of the drainage is not decreased; The water flow capacity of the drainage will remain unaltered by all proposed land form alterations and development.
