Staff concluded that there are reasons to both approve or deny the claims, but that the core issue to resolve was the
code violation. Instead of proccssing the 1�leasure 37 claims, staff concluded that the timliest and least cosdy �va}� for
the Cih� to setde the issue �vould be thmugh an agreement. Under the agmcment, thc City would suspend the code
��iolation until the affected properties de��elop in the future,at�vhich point I�1r.Pascuzzi has a�reed to meet standards in
place at the rime of filing the �leasure 37 claims. l��r Pascuzzi will�vithdraw the nvo claims and be refunded the fee of
$1,000 per claim.
