DESIGNATION: MU -CBD: Mixed Use - Central Business District. The MU -CBD zoning district
is designed to provide a pedestrian friendly urban village in downtown Tigard. A
wide variety of commercial, civic, employment, mixed -use, multifamily and
attached single - family residences are permitted. New development and
redevelopment is required to conform to the standards of Chapter 18.610.

SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 11945 SW Pacific Highway, Suite 238, at the northwest corner of the
intersection of SW Hall Boulevard and SW Pacific Highway. It is further bound by SW 88 Avenue to
the north. The 6.45 acre site is currently developed with two commercial buildings (118,090 square feet)
with mixed use occupancies, associated parking and site improvements. The property is zoned Mixed
Use - Commercial Business District (MU -CDB) as are properties to the south, east and west; properties
to the north are zoned Medium Density Residential (R -12).
In a search of city historical records, the construction of the shopping center dates back to 1961. Since
construction, there have been several conditional use permits approved (CU57 -76, CU12 -77, CU17 -77)
and a site development review (SDR97 -0002) to accommodate new tenants. A minor modification
(MMD2005- 00016) was approved to permit a larger sign than what was originally allowed. There have
also been several temporary use permits, between 1995 and 2001, for Christmas tree and firework sales.
Most recently, a parking adjustment (VAR2013- 00004) was approved to reduce the minimum required
parking by twenty percent.
Proposal Description:
The applicant intends to perform tenant improvements in Suite 238 to accommodate a religious
institution, Southside Christian Fellowship. All the proposed alterations are completely within the
building and no exterior changes are proposed. However, converting from retail space to a religious
institution requires site development review through the minor modification process, with the primary
concern being adequate parking for the new use. In accordance with Chapter 18.765 Of stmet parking
and loading requirements, religious institutions are calculated at 1 space per 3 seats in main assembly. A
sales oriented retail use requires 3.7 spaces per 1,000 square feet. The new tenant proposes to
accommodate 50 attendees (50 seats), which requires 17 parking spaces. The property is located within
the MU -CBD zone which allows uses to provide 75% of the total parking spaces required in Table
18.765.2. An additional parking reduction is granted to mixed -use projects, in which the primary use
(based on floor area) provides parking at 100 %, secondary at 90% and subsequent at 80% of that
required by the table. The recently approved parking adjustment (VAR2013- 00004) further reduced the
minimum required parking from 389 spaces to 312, which is the number currently existing on site. The
site was also granted credit for 20 spaces that were lost as a result of the 2011 SW Pacific Highway /SW
Hall Boulevard intersection improvements, which brings the total parking spaces for the site to 332
spaces. As demonstrated below, the site has sufficient parking and no additional parking is required.

SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW:
The proposed change in use requires a Minor Modification to approved plans or existing
development. Section 18.360.060.0 states that a minor modification shall be approved,
approved with conditions or denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this
title; and
FINDING: Upon review of the proposal's plans and narrative, staff fords that all applicable
requirements of this title are satisfied. As demonstrated above, the site has
sufficient parking for the proposed use. This includes but is not limited to
building height, setbacks, and parking requirements. This criterion is met.
2. The modification is not a major modification.
FINDING: Staff finds that the changes listed in TDC18.360.050.B.1 -11 are either satisfied
or do not apply. Therefore, the proposed development is not a major
modification. This criterion is met.
CONCLUSION: The proposal is a minor modification of existing site development and is in
compliance with the applicable requirements of this title.

We will be moving our church into the space addressed below. We will have non -fixed chairs to
accommodate 50 attendees at our services. Major meeting times will be Sunday morning and
Wednesday evening. Other activities may include church pot lucks or small gatherings during the week.
