PROPOSAL: The owner of the property proposes to install an enclosure around an existing trash
dumpster to make the property more pleasing and presentable.
LOCATION: The property is located at 11485 SW Greenburg Road; Washington County Tax
Assessor's Map 1S135CD, Tax Lot 00300.
ZONING: R -12: Medium - Density Residential District. The R -12 zoning district is designed to
accommodate a full range of housing types at a minimum lot size of 3,050 square
feet. A wide range of civic and institutional uses are also permitted conditionally.

CRITERIA: Community Development Code Chapters 18.360, 18.510, and 18.755.
SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request. The findings and conclusions on which the decision is based are noted in
Section IV.

SECTION III. BACKGROUND INFORMATION
Proposal:
The owner of the property proposes to install an enclosure around an existing trash dumpster to make the
property more pleasing and presentable. The existing trash cans and dumpster are located in a parking space
without screening to the side of the drive aisle within the 20 -foot building setback from Greenburg Road.
Site History:
Staff conducted a search of land use records in the City and found no record for The Birches Apartments.
It was likely built in the 1970s prior to annexation into the City in 1983.
Vicinity Information:
The Birches Apartments are located on the south side of Greenburg midway between SW 95t and 98`"
Avenues. The properties on either side of the subject property are zoned R -12; properties to the south are
zoned R -4.5. Apartments and single - family houses are adjacent to the subject property.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW:
Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or
denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this title;
and
FINDING: As shown in the applicant's narrative and site plan, and in the analysis below, the
site meets the location, design, and access standards for mixed solid waste and
recyclable storage. Staff finds that all applicable requirements of this title are
satisfied. This criterion is met.
2. The modification is not a major modification.
FINDING: Staff finds that the changes listed in TDC18.360.050.B.1 -11 either do not apply or
are not proposed. Therefore, the proposed development is not a major
modification. This criterion is met.
CONCLUSION: As reviewed in this decision, the proposal is in compliance with the applicable
requirements of this title and is a minor modification of a site development.
Therefore, the proposed mixed solid waste and recyclable storage facility may be
approved.
Development Standards In Residential Zones (18.510)
According to Table 18.510.2, Development Standards In Residential Zones, the front yard setback for
multi-family dwellings in the R -12 zone is 20 feet.
FINDING: The existing building is setback 20 feet per Table 18.510.2. However, the existing trash
storage area is located within the 20 -foot setback, which is nonconforming. In order to
approve a new enclosure, its location must be consistent with Location, Design and Access
Standards for Storage Areas (18.755.050).

18.755.050 Location, Design and Access Standards for Storage Areas
A. Applicable standards. The following location, design and access standards for storage areas are
apphcable to all four methods of compliance, described in 18.755.040 above.
B. Location standards.
1. To encourage its use, the storage area for source - separated recyclable shall be co- located with the
storage area for residual mixed solid waste;
2. Indoor and outdoor storage areas shall comply with Uniform Building and Fire Code
requirements;
3. Storage area space requirements can be satisfied with a single location or multiple locations, and
can combine both interior and exterior locations;
4. Exterior storage areas can be located within interior side yard or rear yard areas. Exterior storage
areas shall not be located within a required front yard setback or in a yard adjacent to a public or
private street;
5. Exterior storage areas shall be located in central and visible locations on a site to enhance security
for users;
6. Exterior storage areas can be located in a parking area, if the proposed use provides at least the
minimum number of parking spaces required for the use after deducting the area used for storage.
Storage areas shall be appropriately screened according to the provisions in 18.755.050 C, design
standards;
7. The storage area shall be accessible for collection vehicles and located so that the storage area will
not obstruct pedestrian or vehicle traffic movement on the site or on public streets adjacent to the
site.
C. Design standards.
1. The dimensions of the storage area shall accommodate containers consistent with current
methods of local collection;
2. Storage containers shall meet Uniform Fire Code standards and be made and covered with
waterproof materials or situated in a covered area;
3. Exterior storage areas shall be enclosed by a sight - obscuring fence wall, or hedge at least six feet
in height. Gate openings which allow access to users and haulers shall be provided. Gate openings
for haulers shall be a minimum of 10 feet wide and shall be capable of being secured in a closed and
open position;
4. Storage area(s) and containers shall be clearly labeled to indicate the type of materials accepted.
D. Access standards.
1. Access to storage areas can be limited for security reasons. However, the storage area shall be
accessible to users at convenient times of the day, and to collection service personnel on the day and
approximate time they are scheduled to provide collection service;
2. Storage areas shall be designed to be easily accessible to collection trucks and equipment,
considering paving, grade and vehicle access. A minimum of 10 feet horizontal clearance and eight
feet of vertical clearance is required if the storage area is covered;
3. Storage areas shall be accessible to collection vehicles without requiring backing out of a driveway
onto a public street. If only a single access point is available to the storage area, adequate turning
radius shall be provided to allow collection vehicles to safety exit the site in a forward motion.
FINDING: As shown in the applicant's site plan, the location of the proposed storage area is outside of
the 20 -foot setback. The applicant states that changing the location does not impact the
existing number of parking spaces. The proposed six -foot high chain link fence with privacy
slats for the enclosure meet the sight obscuring design standards. The Pride service provider
letter submitted with the application approves the location and access design for servicing the
facility. Therefore, the Mixed Solid Waste and Recyclable Storage standards have been met.

For: Installing an enclosure around current trash dumpsters.
The owner of the property is proposing to install an enclosure around the current location of the trash
dumpsters to make the property more visually pleasing and presentable. There will be no loss of existing
ground cover or landscaping. The area of the new trash enclosure is currently covered with asphalt and
is part of the parking lot. One parking space will be relocated to accommodate the 20' front yard set
back requirements per 18.755.050 B -4. The enclosure will not impede into or obstruct any drive aisles.
The attached design has been approved by the collection provider to this facility and is also compliant
with 18.755.050 Part C- Design Standards and Part D- Access Standards. See attached acceptance letter
from Pride Disposal who currently services this complex.
The enclosure will be comprised of a 6" thick concrete slab on grade surrounded by a 6" tall curb in
which the fencing will be mounted except for across the front at the garbage truck access gate. At this
point the slab on grade will be flush with existing asphalt. Fencing will be 6' at any given point. All chain
link fencing will have privacy slates installed.

Re: Revised Enclosure at The Birches Apartments
We have reviewed the revised site plan for the enclosure at The Birches Apartments.
The enclosure is shown to be at least 13' wide. You show a 7 -8 foot gate with a 5 foot opening to
the left. This is fine as long as the gate does not have a pole on the right hand side (next to the
walkway). A 7 -8' opening would not be adequate to service the cont5iner, so the full 13' opening
must be maintained to ensure our access.
The gate should be hinged in front of, not inside, the enclosure walls. This will allow for it to
open the full 120 degrees necessary. There should be cane bolts and holes in place for the gate to
be held in the open position (at 120 degrees) as well as the closed position (in place of a pole).
The depth of the enclosure is shown to vary between 12' and 14' deep with an angle in the back.
As it's drawn, this will be acceptable.

The city had us make a few adjustments for the trash enclosure at the Birches Apartments in Tigard. They
wanted us to move the enclosure 20' in from the street. See attached drawing. Please issue another approval

space with the new enclosure. Approximately 8 x 10 sqft of existing ground cover will be removed to
accommodate the enclosure with the placement of concrete. The remaining area of trash enclosure
currently is covered with asphalt and is part of the parking lot. The enclosure will not impede into or
obstruct any drive aisles. Contrary to 18.755.050 B -4 the current trash bin location is within the 20 foot
front yard but per line 6 in the same section the trash bin location will be part of the existing parking lot
and will be screened off with a chain link fence with privacy slats.
The attached design has been approved by the collection provider to this facility and is also compliant

Mounted to top of concrete wall /curb will be a 4' chain link fence on the 2' 6" wall and a 6' chain link
fence on top of the 6" curb. Fencing will be 6' at any given point. All chain link fencing will have privacy
slates installed.
