NOTICE OF TYPE I DECISION MINOR MODIFICATION (MMD) 2013 -00012 TWIG'S BISTRO AND MARTINI BAR T I G A R D 120 DAYS = 06 -27 -2013 SECTION I. APPLICATION SUMMARY FILE NAME: Twig's Bistro and Martini Bar CASE NO.: Minor Modification (MMD) MMD2013 -00012 PROPOSAL: The proposal is to create an open -air outdoor dining area that will include removing four parking spaces. The spaces will be replaced by reducing a landscape island southeast of the main entry. Three trees will be removed and three will be planted in other areas around the establishment. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.330.B. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. BACKGROUND INFORMATION Site Information: The subject parcel is located at the northwest corner of the Bridgeport Shopping Complex near the intersection of 72n Avenue and Lower Boones Ferry Road. It was developed as a conditional use through an intergovernmental agreement by the City of Tualatin. Proposal Description: The proposal is to create an open -air outdoor dining area that will include removing four parking spaces. The spaces will be replaced by reducing a landscape island southeast of the main entry. Three trees will be removed and three will be planted in other areas around the establishment. A 200 square foot addition for a cooler will be placed on the north wall near the west end. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.330.020.C.3 states that a minor modification shall be approved, approved with conditions or denied following the Director's review based on the findings that: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: Upon review of the proposal's plans and narrative, staff finds that all applicable requirements of this title are satisfied. This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the criteria listed in TDC18.330.B.2.a -g do not apply. Therefore, the proposed development is not a major modification. This criterion is met. CONCLUSION: The proposal is in compliance with the applicable requirements of this title and it is a minor modification of a conditional use. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice was posted at City Hall and mailed to: X The applicant and owners X Affected government agencies Final Decision: A Minor Modification is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. Northwest corner of the site. Once the General Contractor arrived at the site to y - start. construction they noticed an existing_water and fire vault located at this exact location. For this reason we are applying for another minor modification that would relocate the four (4) parking stalls to the Southeast of the main restaurant entry doors. Again there will be no change in the number of parking stalls and would fit the site traffic flow much better. Another item that is being requested is the location of a 20' -6" x 10' -0" Keg Cooler at the North or rear of the existing restaurant. . Per conditional use 18.330.020 (B) (2) a. There is no change in land use. b. There is no increase in dwelling unit density. c. There is no change in the type /or location of access ways and parking areas where off -site traffic would be affected. d. There will be no increase in the floor area of more than 10 %. e.
