I. CALL TO ORDER: 8:00 P.M.

Present: Commissioners Fletcher, Goslin, Nicoll, Severson,
Whittaker, Woodard and Chairman Paterson: Fred
Anderson, City Attorney: Keith Thompson, City
Engineer: Ray Rangila, City Planner
• Absent: commissioner Lewis
III. APPROVAL OF MINUTES
A. The minutes for the regular meeting of July 20, 1971
were approved as submitted.
Tv. PUBLIC HEARING
A. Zone Change (carried over from July 20, 1971)
• WALLY JOHNSON, Applicant
request for a change of zone classification from M-4,
Industrial Park to P-D, Planned Development on a 1.23
acre parcel located on the southwest corner of S.W.
Grant Avenue and S.W. Tigard Street (Map 2S1 2BA
tax lot 800) .
1. Staff Recommendation
a, The staff recommended approval.
2. Public Hearing
a. Wally Johnson, applicant, testified it favor
of the request.
b. Mr. Johnson stated that Mr. Graves (the
neighbor) was concerned only about the building
setback from Tigard Street.
c. Public Hearing was closed.
Commission Discussion and Action
a. Commissioner Whittaker asked what Mr. Graves
reaction was if the building was not set back
from the side property line.
b. Mr. Johnson stated that Mr. Graves had no
objections to the building being on the property
line.

co Commissioner Whittaker stated he felt that
screening should be provided along the
setback areas or that the building; should
be allowed on the property line.
d. Commissioner Fletcher asked if the building
would be set back further or made larger if
it were on the property line.
e. Mr. Johnson stated that the building would be
set back ,further and not enlarged.
'. Commissioner Severson ~Mated concern for
maintenance of the building if it were
allowed on the property line.
• g. It was moved (Nicoll) , seconded (Goslin)
and passed by a unanimous vote of the
Commission present to approve the zone change
to P-D (with no setback from side property
line) with the following provisions:
1. That a detailed tree planting and
landscaping plan shall be provided
as part of the general plan and
program.
2. That utilities, drainage and driveway
specifications shall be provided as
part of the general plan and program.
• 3. That uses other than allowed as out-
right permitted uses within the M-4
District shall be reviewed and approved
by the Planning Commission in order to
preoerve the integrity of the Community
Plan and Zoning Ordinance.
4. That the Planning Commission shall review
the completed general plan.
B. Variance (carried over from July 20, 1971)

Location and Land Use of Subject Pro ert
The vacant subject sites are located on the southwest
and southeast corners of S.W. 114th Place and S.W. Tigard St.
Surrounding Zoning and Land Use
The area surrounding the subject property is zoned R-7
and developed with scattered single family dwellings and
agricultural uses. R-7 zoning to the northwest is
subdivided and developed with single family lots.
Applicant's Justification
"This is a request for a Conditional Use in a R-7 zone
for 22.21,91 Residential, with a minimum lot size of
8,000 square feet-one duplex per lot. `'Zoning Ordinance
70-18, Section 110 .2, Conditional Uses Permitted,
Sub-section a. )
Subdivision 114th PLACE, recently preliminarily platted
in Washington County, subsequently annexed to the City
of Tigard, and finally granted a variance to allow
County standards, was platted with the intent of having
duplex lots along S.W. Tigard. (ie. Lots 1, 2, and 17.
The County has a special A--1 zone for duplexes and
requires only 7,000 square feet per lot. Under advise-
ment of the County, it was considered more appropriate
to apply for a conditional use once the subdivision
was annexed to the City of Tigard rather than initiate
a zone change in the County. For this reason the
subject lots, 1, 2, and 17 were increased in size to
8,000 square feet for the expressed purpose of qualifying

them for Duplex Residential Conditional Use in the
City of Tigard without having to obtain a variance
for lot size for same.
In view of the need for rental housing, especially
that of a residential nature, it is requested that
this conditional use be approved tor duplex residential
lots at the entrance to 114 r PLACE. It is felt that
this approach to planning is the best in this instance
since Tigard Street is too busy a thoroughfare to be
the most desirable as a single family residential
site. Three duplex residential units in keeping
with the overall style of the development ihould
enhance the livability of the whole area and best
fulfill the needs of the community for residential
• housing growth in the City. "
Public Utilities
The subject sites are within the boundaries of the
Tigard Water District and Tigard Sewerage system
(U.S.A. )
Conformance with the Communittt Plan
The adopted Tigard Community Plan designates the
subject area for urban low density residential devel-
opment, having an average density of 4 dwellings
(13 persons) per gross acre. The 4 acre "114t Place"
Subdivision contains 17 residential lots.
Staff Pindin• s and Recommendation
The staff finds that, although the existing sub-
division would contain 4.25 dwelling units per gross
acre, it is desirable to provide duplex dwellings
in urban low density subdivisions. In addition, the
staff finds that the platting procedure was carried
out prior to the adoption of the Community Plan,
The staff further finds that a most desirable locational
standard for duplexes, except when developed within
' ►} planned units, is to place them only on corner lots
within subdivision.
The staff concurs with the applicant in that duplexes
can be compatibly developed on the lots at the entrance
to the subdivision.
It is recommended that the request be approved for the
two corner lots within the subdivision with the following
condition:

be from S.W. 114th Place only.
