A. Do to the fact that the Commission did not receive the minutes
of the regular meoting of December 15, 19700 they will be
approved at the net meeting.

A. Conditional Use

req, for concUtional use approval to allow a radiator
service on a 0031 acre C -3, General Commercial parcel located
on the east side of S.W. 90th Avenue approximately 1808 feet
north of S.W. Greenburg Road. (Map 1S1 35DD tax lot 3800)

2. Public searing
a. Ira Art Mason, 11695 S.W. 90th, expressed concern
over the noise caused by possible traffic in and
out of the subject property. He was also concerned
about the parking on the street and subject property,
and about signing Mr0 Bauer may wish to erect.
b. Mr. and Mrs. Albertson asked if the shop was to be
a regular radiator shop or if it was just to help
Mr. Bauer's son with the over flow from his shop.
They also stated concern over the traffic on the
driveway leading back to the garage.

3. Commission Discussion and Action
a. The Commission asked if Mr. Bauer was 'present to
answer these questions. Mr. Bauer wms not present.
The Commission discussed adding additional conditions
to the request concerning parking and traffic.
b. It was moved (Goslin), seconded (Severson) and passed
by majority vote of the Commission present that the
application be denied (Commissioner Woodard voting
no and Chairman Paterson abstaining).
B. Conditional Use
CARL WINTHERS, Applicant
A uest for conditional use approval to allow a planned
residential development of 42 towthouses on two one acre
R -7, Single Family Residential parcels located on the
east side of S.W. 98th Avenue approximately 400 feet south
of S.W. Greenburg Road. (Mrp 1S1 35CB tax lots 1600 and
1700)
1. Staff Recommendation
a. Staff recommendation for approval with conditions.
2. Public Hearing
a. Mr. Charles Polinsky, 9655 S.W. Lewis Lane, was
concerned about the fact that apartments seemed
to be surrounding him.
b. A lady from the audience asked how the project
was compatible with the surrounding properties.
Ray Rangila stated that the design and lay out of
the project would help make it compatible, and
that such design control was only possible in a
P -R, Planned Residential development.
c. Mr. Edward Poerster, 11665 S.W. 98th, asked to what
standards 98th Street would be improved. Ray Rangila
answered by stating that 98th would be improved to
a minimum of 50 foot right -of -way, with paving9
curbing, etc. to meet City standards.
d. Mr. Forest Whitthar, 11700 S.W. 9860 asked what
side of 98th would the additional right of-way be
taken° Ray Rangila stated that the additional
right- of-way would normally cone from both sides--
each giving 5 feet. Mr. Whitthar also asked if
the improvements would go to the end of the street
and if his side would have to give because they
gave for improvements some years ago Ray Rangila
stated that it would have to be a co ..operative
agreement with the people along that street.
Mra Whitthar asked if it was the Commission's
opinion that a 50 foot right -of -way would give
the people of the proposed development, along
with the rest of the people, the necessary access

needed on the dead end street. Mr. Whitthar also
stated concern about a backup of traffic in the
morning behind the buses. Chairman Paterson stated
that 50 feet of right-of-way with 34 feet of pave.

e. Mr. Polinsky asked if there was to be some type of
screening. Mr. Winthers explained that he would
be glad to put screening either block or cyclone
fence up all around the development.
f. Chairman Paterson asked the applicant if he
understood the conditions the staff imposed.
Mr. Winthers said he understood.
3. Commission Discussion and Action
a. Commissioner Goslin stated that the plans the
Commission were looking at were not the plans
that would be approved: that the final plan
would allow 27 units in groups of three instead
of 42 units in groups of three.
b. Commissioner Fletcher asked the applicant if
he agreed to 27 units instead of 42. Mr. Winthers
said he agreed.
o. Chairman Paterson asked Mr. Winthers if he under-
stood what the Local Improvement District procedure
was Mr. Winthers said he did.
d. Commissioner Severson stater/ concern over the patios
being on the second floor level. Mr. Winthers
stated that all the patios would be on the ground
level and that there would be screening.
e. Commissioner Gosiin moved to amend staff condition
number 2 to read that one stage before final
plans or preliminary plans the Commission would
have the opportunity to review the preliminary
plans9 screiming and other features that they
may wish to consider.
S. Commissioner Goslin stated that he wished to change
his previous amendment from condition 2 to condition
3 of the staff recommendation by having the Commission
approve the final plans.
go The builder stated that he was building this same
project elsewhere. Commissioner Goslit asked the
builder if he could bring pictures of the develop-
ment for the Commission to see. The builder agreed.
h. It was moved (Goolin), seconded (Pletcher) and passed
by unanimous vote of bile Commission present to approve
the request with the following conditions

1. That S.W. 98th Avenue shall be developed
to City standards from the south line of
the subject property north to Greenburg Rd.
2. That the total number of dwelling units
shall be no more than 27 and shell be com-
patible to surrounding residential developments.
3s That final plans showing typical elevations,
landscaping, building locations, storm drain-
age specifications, adequate utility provisions
and off - street parking shall be submitted for
Planning Department, Public Works Department
and Planning Commission approval prior to
issuance of building permits.
V. OTHER ITEMS
Ap Shell ail Sign (Corner of S.W. Greenburg Rd. and S.W. Shady
Lane)
1n Shell requested, a sign 35 feet high with a 12° x 12'
pectena
a. Ch.irman Paterson explained that a representative
from Sher. Oil, Ray Rauxgila and himself had gone
out to the site and Shell Oil had an 8' x 8' letter
"E" raised to 35feet and that this seemed suitable.
b. Mr. Goslin pointed out that the sign Shell Oil
was requesting was 25% large, than the one that
was shown to Chairman Paterson,
c. Commissioner. Gosiin moved that the sign be 25 feet
high with an 8' x 8' pecten0 He stated that this
would provide guide lines for other service stations.
Commissioner Fletcher seconded the motion.
d. Commissioner Severson stated the sign would be too
small. Travelers would not be able to see it.
The motion was defeated by a vote of 3 -30
e. Commissioner Woodard moved that the sign be 35 feet
high with an 8' x 8' pecten. It was seconded by
Commissioner Peterson. Commissioner Peterson
amended the motion by stating the sign must be
turned off when the station closes. The motion
was approved by a vote of 5 to 1
PO "Kinder College" (S.W. Grant Avenue)
1. The applicant was asking for a 42 square foot non-
illuminated sign facing S.W. Pacific Highway —an
amendment to the original conditional use approval
by the Planning Commission in 1969
a. Staff recommended for a 32 square foot sign.
b. Commission asked what the proposed Sigri Code
would allow. Ray Rangila states the proposed
code would generally allow 32 sq. ft signs

in residentially oriented conditional uses such
as churches.
c. Commission asked how large the letters would be.
The applicant explained that the sign would be
2° x 16° with 14 inch letters. It was moved
(Peterson), seconded (Fletcher) and passed by
unanimous vote of the Commission present that
a non - illuminated 32 sq. ft. sign be approved.
C. Katherine Street extension to 121st
1. Ray Rangila explained that the Tigard School District
was planning to extend Katherine Street to 121st Ave.
It was moved (Fletcher)9 seconded (nos1in) and passed
by unanimous vote of Commission present to approve
the connection of Katherine St. at 121st Ave.
D. Murray Blvd. Corridor Hearing
1. Ray Rangila told the Commission of the Murray Blvd.
Corridor hearing in the Tigard High School on Thursday
night (January 21, 1971) at 7230 P.M.
B. Date for Planning Commission Study Meetings
1. Ray Rangila explained the need for the Planning
Commission to hold study sessions to consider such
items as Planned Development requests, subdivisions 9
etc. The fourth Wednesday of each month at 800 P.M.
was set aside for study sessions.

SIZE OF PROPERTY: 0.2 'acres
STAFF RECOMMENDATION:
The staff recommends approval of this
application with conditions. This is an appropriate use
for this property adjacent to the public elementary school.
The conditions the staff would recom-
mend are:
1. That any sign used to identify this
use be limited to a non - illuminated

would object to a water tank of such proportion which
would be completely unscreened from his land.
d. Mrs. John Bishop, 7375 S.W. Varnes Street, spoke,
saying that her neighborhood generally felt that, faced
only with such alternatives, they would pre6e a water'
tank to multiple family or commercial development.
e. Mr. Severson asked if a tank half as high and twice as
wide might not be possible, and more acceptable to the
City. Mr. Carter said that this would not provide the
pressure they were after, and that screening could be
provided by planting fast-growing poplars on those
sides which would be unscreened.
f. Mr. Woodard asked if the District would turn the rest
of the property into a park, use it for equipment
storage, build more tanks, or what? Mr. Anderson,
Chairman of the Metzger Water District Board, said
they had no plans for any other use of the property,
but would probably put it up for sale to the City or
Park District or anyone else who was interested in it.
g. Mr. Thompson asked if the tank would be necessary if
the District were to get water from Lake Oswego. Mr.
Carter said he felt that this would not be practical,
because such water would have to be pumped.
h. Mr. Thompson asked if this tank would be only a dupli-
cation if the Tigard and Metzger Water Districts were
to merge. Mr. carter said no.
i. The public hearing was closed.
3. Commission Discussion and Action
a. Mr. Woodard said he would like to see a lower tank.
b. Mr. Woodard suggested that the application be tabled
until the next meeting and that, in the meantime, the
District should talk to the City Staff and show engi-
neering justification and possible alternative teak

on his privacy.
d. Mrs. Grotjohn presented the petition, and hear letter,
and spoke in opposition to apartment development in
quiet, single - family neighborhoods.
e, Mr. Fred Felzin, 12115 S.W. Lincoln, spoke, saying he
had no objections to duplexes, but didn't want high•
rise apartments here,
f. Mr. Janoe, applicant, said he had to do something with
the property, now that he had retired.
g. Mr. Paterson asked about the inadequate 20° access
which would not permit any more than one additional
unit to be built, Mr, Janoe said this could be worked
out,
