The Center has undergone a tremendous turn around in the last •
,,, ,„•• year. Every one of the merchants has worked very hard to upgrade
. .,, � it. They have done a lot of additional. landscaping; the Center
has been repainted. It has brought in more business into the Center.*.
All the vacancies in the Center ,have been rented. The only vacancy
:k' ' that is available right note was origir ally designed to be an office
buildings I feel that the manes position is very Well meant,
but I think he would find that once he gets into business there,
the'controlling of the loitering that would hang around outside
of his building would be very difficult. He may be able to control
inside, but he is going to have a full time job running a business
and not be able to control the large parking lot that surrounds
that business; and we do have Tigard Police protection; we do have '.
j' fire department protection; but we are not the only shopping center
: in Tigard that has to have this protection, and I feel that this
would just place an added responsibility on the Police Department.

next to the .Thriftvtay Market. We have had a constant problem With
access in and out of the shopping center. The City will certainly
verify this. There has been numerous times they have mentioned
something about redesigning access i,n And Out of the Center.

M. Albo: I have some questions.
Tepedino: Yes, sir?
M. Albo: My name is Mike Albo, owner of the Diamond Loft. And he stated
it is well lit. It is not a well lit area where the area existing
now. What is his intention about lighting the area to the left
as you face the highway?• Schlaht: My intention is around the complete building, around the soffit. ..

under soffit lighting--not great intensity, but enough to light
up the area probably 20 feet around — completely around the
building.

M. Albo: Okay; another question I have is, you said it will be well super-
vised. What happens when the manager is busy with his personnel
and there are drug or drinking problems-..who is going to handle
that? ,r

Schlaht: I will be there about 40 to 30 hours a week.
M. Albo: And what time element....early evening, or the day, or what?
Schlaht: During the day and in the evening. I plan on only being open but
60 hours a week, and hiring someone to work maybe 20 hours.
M. Albo: And what hours are you planning to be open?
Schlaht: Well, probably about 11 to 10; maybe 11 to 11 on the weekends,
and during the week, 12 to ., to maybe 10.
M. Albo: your responsibility to the Center as far as littering in the area.-
What is your intention there? The bids coming and going?
Schlaht: Definitely to keep it clean around my particular location. I
talked to Mr. Cole's agent with Art Lutz --- says that there is
somebody comes along and cleans the parking lot. : don't know i
that is true or not.
M. Albo: We pay for it.
Schlaht: Okay. I would be willing to enter into that also.

. On September 14, 1981, the Tigard City Council reversed the Planning Com-
mission's denial for a Conditional Use request by David Schlaht to operate
an electronic game center at Canterbury Square. One of the conditions for
the approval was a mandatory review after six months.
We have contacted the City's Police Chief who informs us that no complaints
have been received by his department regarding Electro--Sports. Further, no '
complaints. have been received by the Planning Department or Code Enforcement
Officer on this establishment. •
The conditions placed upon the Conditional Use are as follows:
1. Applicant obtain a sign permit.
2. If a "nuisance" is created as defined in Code Section 7.40, and the
Tigard Police Department finds that the applicant is in part in
violation of the Code, the applicant shall be brought before the City
Council and may be subject to revocation of this Conditional Use.
3. No changes will be made to approved plans or specifications unless
formal application is made to the appropriate City department and
changes are approved by that department. Application for changes will
be made in writing and shall include applicable drawings.
4. Between Sunday and Thursday during the school year, persons under the
age of 18 years must be accompanied by an adult after the hour of
9:00 p.m. Between Monday and Friday during the school year, persons.
under the age of 18 must be accompanied by an adult prior to 3:00 p.m, s�
5. Some form of bike rack must be provided.
6. Patrol will be provided by Electro-Sport of a litter barrel outside of
the building.
"j. Tualatin Rural Fire Protection District Fire Marshall shall review
' this rop osal for fire life safety and the applicant shall correct

deficiencies if they are found to exist prior to the issuance of an
occupancy permit.
$. There will be mandatory review of this permit at the end of six months. y,
9. All rules of operation shall be posted conspicuously inside this
establishment.
The Tualatin Rural rise Protection District Fire Marshal has checked the build-
ing for fire--life--safety. lie has determined that a maximum capacity of 50
• . should be sot because there is only one exit. The Vire Marshal will assumw 0
responsibility for posting the sign.

AN ORDINANCE REVERSING A DECISION OF THE PLANNING COMMISSION, RELATIVE TO
CONDITIONAL USE (CU 6-81) .
Whereas, the Planning Commission on July 7, 1981 denied a Conditional Use
application (CU 6-81),for Mr. David Schlat,-E4mmOmmxpxgt,- at Canterbury Square; and
Whereas, Mr. septa appealed the decision of the Planning Commission to
the City Council; and c'cl,,k.dly
Whereas, the City Council reversed the decision of the Planning Commission
• and granted said Conditional Use at a regular meeting held on August 10, 1981; and
Whereas, certain conditions were made a part of this approval of the City
Council.
Therefore, be it ordained as follows:
Section 1. The Conditional Use to operate an amusement enterprise in aGeneral
Commercia1Z------- ;17 (C-3) is allowed under the Tigard Municipal Code Section 18.28.020
if the Planning Commission approves said use,
(1) The Conditional Use to operate an amusement enterprise in a General
Commercial Zone (C-3) is allowed under the Tigard Municipal Code Section 18.28.020
if the Planning Ccmmission approves said use.
(2) The objection voiced in the Planning Commission meeting which led
to the denial of this application initially were not specific enough to justify
outright denial under the circumstances discussed before the Council on appeal.
(3) Additional conditions of development are hereby imposed upon the
applicant to ensure that various concerns of Council are addressed.
Section 2. The following conditions are placed upon this Conditional Use:

• RE: Electro-Sport Family Fun Center
at Canterbury Square
On September 14, 1981) the Tigard City Council reversed the Planning Cm-
mission 's denial fora Conditional Use request by David Schlaht to operate
an electronic game center at Canterbury Square. One of the conditions for
the approval was a mandatory review after six months.
We have contacted the City's Police Chief who informs us that no complaints
have been received by his department regarding Electro-Sports. Further, no
complaints have been received by the Planning Department or Code Enforcement
Officer on this establishment.
The conditions placed upon the Conditional Use are as follows:
1. Applicant obtain a sign permit,
• 2. If a "nuisance" is created as defined in Codc Section 7.40) and the
Tigard Police Department finds that the applicant is in part in
violation of the Code, the applicant shall be brought before the City
" Council and may be subject to revocation of this Conditional Use.
3. No changes will be made to approved plans or specifications unless
formal application is made to the appropriate City department and
changes are approved by that department. Application for changes will
be made in driting and shall include applicable drawings.
4. Between Sunday and Thursday during the school year, persons under the
age of 18 years must be accompanied by an adult after the hour of

5. Some form of bike rack must be provided.
6. Patrol will be provided by Electro-Sport of a litter barrel outside of

this proposal for fire life safety and the applicant shall correct
deficiencies if they are found to exist prior to the issuance of an
occupancy permit.

establishment.
The Tualatin Rural rite Protection District FireMarshal has checked the build-,
ing for fire-life-satety, lie has determined that a maximum capacity of 50
should be get because there is only one exit. The Fire Marshal will assume
responsibility for posting the sign.

Subject: Ordinance for David Schalaht Appeal.
The following are the conditions air they will appear in the ordinance
approving the David Schalaht/Flectro, Sports Conditional Use apprcval.
The ordinance will be presented for action on August 24th, however,
please advise me if you have some concerns regarding the wordage of
the conditions. 1
1. Applicant obtain a sign permit.

At the appeal hearing I would like to ro ose that the Canterbur Merr;hants aYld
myself set up an account withwAlch to hire an all night security guard that could
use my location for his base station. The average cost for a guar is 6.50'per br.

There would not be any additional loitering caused by my store than which is
•4• now the case with the 12 or more games located at the pizza parlor and the grocery
store. The games in the locations would continue to be played by the patrons that
are using them now. But if t;;c t is not the case, and the people that come to the center
to play the games all end up it, my store, isn't it better that these people are at my
store congregated in one place away from the main center than to have them walking and
parking between the pizza parlor and the grocery store using the prime parking spots?
The majority of the patrons coming to the game center would be on foot or riding
bicycles. Also parents will be more inclined to shop at the center if they know they
would have a place to drop off the kids for a hall:' an hoar or more.
It has been proven that a Family game center would not add to a hotbrodding
situation for the same reasons stated above.
Electro Sport is catering to the average good citizen and by our actions we feel
; that the people who cause the problems will know that their actions will not be tolerated,
Peet pre .ire plays a big part in achieving this good outcome„ Also I must point out
again, that Electro Sport will not have any loitering devices that promote loitering,
such as, pool tables, foosball tables, juke bones, and also we will not be serving
any food or beverages. This has been the case in other game centers that are run the
same way that Electro Sport would be managed.
• One Man wanted to know if Mr. Kolve, the shopping center owner had given his
approval for our business, Another person said that he had not given approval. Well
• that is simply not trued Mr, Kolve would not have given his approval and signed the
lease with me if he had not wanted me there. Also I have been assurred in writing that
• Mr. Kolve does approve of our proposal.
• Ct, Electro Sport would be in a C-3 and 4 zone which complies with the codes and
therefor Y feel my rights have been violated by the decision of the Planning Commission.
Di I ask the City Council to reverse the decision of the City Planning Commission,
with regards to the proposal of Electro Sports family came Center in the Canterbury
Square Shopping Center.

• Please be advised that the Tigard Planning Commission at
their regular meeting of July 7, 1981 denied your request
for a Conditional Use to operate an amusement enterprise
in a General Commercial Zone.
This proposal was denied due to poor traffic flow and
incompatability with the other tenants.
Action of the Planning Commission is final unless notifica-
tion of appeal to the City Council is filed with the City
Recorder within 20 days of the Planning Commission Action.

Manager running Electro-Sport. I would like to point out M.:.
Howard said this is a family game center—this is not an arcade.
We Will also have retail sales of Atari hoWo computers, Atari
cartridges. I will be obtaining;atelevision which is put out by
myself after ??? which I am not exactly sure who the parent
- corporation is on that, but they are forms of Atari cartridges,
We will also be selling hand-held games, miscellaneous TV products
also. •
I understand that there have been other4problems with other loca..
• tions,-.1 don't know what they are, but I would like to point out
what or to our company would be run. rirst, we would have no
food, no drinking. We will not allow smoking on the premises, and
• definitely will not allow any drug paraphernalia or any drug-
,
related activity in the parking area or within the building. All
patrons ,must wear shoes, shirts appropriate .to.the center. Liter-
ing is not permitted on the premises and the conduct of patrons
• will be monitored in order to complement the pleasant atmosphere
of the shopping (letter. Management will endeavor to attract all
age groupse-,-not just cateel,ng to young people. This will be done

through various promotional activities such as involving parent-
. child competition, lun6b, time compotitionttor the business c' uti
ity, etc,' We have other ideas to attract -a good croWd: one that
.( I Will mention in, every time a thild 'receivos a report card, we
will hand out two tokens for an A and one for a 1.s.

mention we will not be hiring --will endeavor not to hire anyone
under the age of 30. Managers and employees will be respotsibl;
for enforcement of the rules, demeanor of patrons, and maintenance •
• ' of leased premises. Hours of operation will generally coincide
with hours of the shopping center. And between Monday and Friday
during the school year, children under the age of 16 must be
accompaxiied by an adult prior to 2:00 p.m. in the afternoon, and '
after the hour of 9:00 p.m. Monday through Friday. During the
. summer months the• management will abide by the Local curfew Laws

set by the City of Tigard, and these laws will be posted at our '
location.
I have had the experience of being able to objectively Zook, at
other locations, and the biggest things that can be done to better
the so-called arcade atmosphere, which has been quite, tarnished in ,..
the past . . . no smoke, or no food. If you have* say, a' paper cup
with coke in it in a robot set aside for food and ar.thk, someone
can bring u t a bottle of liquor and mix their own drinks. I have ,

is something he wants to see go, and this is something he plants ,
to see go with your community; that all you people feel happy With
and comfortable with, and feel that it Will be part of the community.

it Will be up to our decision; but if they are there after 20 or

off). We have known this-.Glen and I have figured this is a problem
° with. a lot of; places. It can be. And this is one of the reasons ,
we picked this particular location. It isnot that large m.. 1200
square feet m and it is totally surrounded by a parking iot. !.

fire protection. It isn't immediately adjacent to anything else
. that can cause a problem, and my personal. feeling was it is the '
best lighted area I could find i.n Tigard. I know that can be a
problem for loitering, especially in the evening. A Well lit
parking lot'-they are not going to stand. around or smoke marijuana,
''''''.' or do something like that -m they just are not going to do that.
One other thing: one of the parents I have talked to has asked me ' .
hour I Will decorate the inside, and their biggest complaint is
every one they have been into is black. The ceilings are dark, the .
rooms are dark. Well, this is all glass -m well, it is glass on '
two sides, and it will be ceiling lit and everything else will be .

carpeting: it will, be done right.

We have been striving very hard to,keep a clean and convenient

We have loitering now, and this is not going to help the situation,. .
It will create vandalism, of which we have some now, and We are
trying very hard to avoid that. It's just not a good influence,
I don't think, for the youth; and to call it a fatai1y center --
I am afraid they don't turn out that way; maybe it Is intended
that way, and maybe all the efforts he has would be pointed toward
that, but it doesn't come out that way. It it create a problem,

Center, I oppose this. My main Concern s vandalism,t,A have had
my car within the last year, ray car hit axtd omm `e parking lot.,
I have had ??? blown out from behind my shop, I have had
aquariums broken and left back there when I was painting them.
I have had cages destroyed back there, and gard z: h ses-sto1erp
from there. So this is my main conu''o;rrW" �.
You cat: go there just about two nights out of the week, and you
can go, not in front of the building, but between the building and
the apartments behind, and you will see kids smoking'marijuana
back there. This is one of the bad areas; and it is well lighted
in front, but back there it is not. There has also been a, case
• where cars parked in the lot--,a van had sold keg beer to the kids
b�causo they couldn't buy it at Penny Hokers (Hokieea Pizza House).
.� They did go out there and buy it for a dollar a cup because they
couldn't get it inside. You go to Rico's up by the pie place
up there, and McDona1d's up on Barbur Boulevard. They took a large
carrousel out and put electronic games in there, Now they have to
post security guards because of the drug problems it there*
I think the same thing Will happen here, and E am very much opposed
to it, 1 don't want any kids in my pet store.

Whereas, Mt. Schlat appealed the decision of the Planning Commission to
the City Council; and
Whereas, the City Council reversed the decision of the Planning Commission
and granted. said Conditional Use at a regular meeting held on August 10, 1981; and
Whereas, certain conditions were made a part of this approval of the City
' Council.
Therefore, be it ordained as follows:
Section 1. The Conditional Use to operate an amusement enterprise in aGeneral
Commercial Zone (C-3) is allowed under the Tigard Municipal Code Section 18.28.020
• if the Planning Commission approves said use. •

` (2) The objection voiced in the Planning Commission meeting which led
to the denial of this application initially were not specific enough to justify
outright denial under the circumstances discussed before thr Council on appeal.
(3) Additional conditions of development are hereby imposed upon the
applicant to ensure that various concerns of Cout.cil are addressed.
Section 2. The following conditions are placed upon this Conditional Use:

1, Applicant obtain a sign permit.
2, If a "nuisance" is created as defined in Code Section 7.40, and the
Tigard Police Department finds that the applicant is in part in
violation of the Codes the applicant shall be brought before the
City Council and may be subject to revocation of this Conditional Use.
3. No changes will be made to approved plans or specif,i.cactions unless
formal application is made to the appropriate City department and
changes are approved by that department. Application for changes
will be made in vriting and shall include applicable drawings.

6. Patrol will be provided by Electro-Sport of a litter barrel outside
the building.
7. Tualatin Rural Fire Protection District Fire Marshall shall review
this proposal for fire life safety aiid the applicant shall correct
deficiencies if they are found to exist prior to the issuance of an
occupancy permit.

1, Electro Sport proposes to open a Family Came Center at 14463 S.W. Pacific Hwy,
in Canterbury Square Shopping Center.
Electro Sport requests a conditional use hearing by the City of Tigard's
Planning Commission prior to issuance of a city business license, and a
conditional use penult.
2, Electro Sport would be located in a C-3, and C-4 zone. This appears to be
within the stated guidelines of the cities Comprehensive Plan,

3. With the proper management proposed, the family game center will be a positive •
contribution to the community. The facility will pirovide a challenging and
inexpensive way for people of all ages to enjoy themselves.
4. Electro Sport will be supervised at all times to insure a positive effect
on, the environment. The clean, orderly, well lighted, and socially high
standard now being experienced by Canterbury Square will surely continue.
Econimically, due to increased traffic, other merchants in the area could
' expect an increase in business. No changes in public services, access roads, 1
or additional community development should be necessary'.
5. Though not required to answer 00 5 on application format, we felt this location
was exceptionally suitable for a Family Game Center. For instance:
1. The proposed site is located in an attractive, unattached brick building.
This will slightly seperate the traffic flow from other merchants.
2. Location is visible from all angles.
3: Easy access to police and fire officials.
4. Good parking in a well lighted area.

6. The impact or effect the proposed use would have on the adjacent sites,
occupants, and the immediate neighborhood, would be beneficial.
Our observation and those of other major operators of existing Family Game
Centers, within and around the Mall or Shopping Center confines, seems to
reflect an excellent behavioral pattern of the patrons.
Our goal is to make the Family Game Center a place that parents would feel
comfortable having their children go to,

7. A brief explanation of how our family game center would be managed.
1. No food, drink, drugs, or smoking permitted on premises.

2. All patrons must wear shoes, shirts, appropriate to the center.
3. Loitering is not permitted on premises. f:
4. Conduct of patrops will be monitored in order to compliment the

pleasant atmosphr.re of the Shopping Center.
5. Management will endeavor to attract all age groups, not just cal:ering
'` . to young people. This will be done through various promotional activities
such as involving parent-child competition, lunch time competition for
the business community, etc.
6. There will be some retail sales of electronic hand held, and T V type
games for home use.
7. Managers and employees will be trained for Family Game Center operation,
having ability to relate with young people as well as adults. Supervision
will be provided during all hours of operation.
8. Managers and employees will be responsible for enforcement of rules,
demeanor of patrons, and maintenance of leased premises.
9. Hours of operation will generally coincide with hours of the Shopping Center.
10. Between monday and friday during the school year, children under the age of 16
must be accompanied by an adult prior to 2:00 PM, and after the hour of 9t00
PM.
11. During the summer months, the management will abide.wi.th the local curfew
laws set by the city of tigard„ These laws will be posted at our location.
