Dear Mr. Hector:
Please be advised that the Tigard Planning Commission at their
• • regular meeting of March 21, 1976, approved your request for a
Conditional Use Permit to operate a nursery with retail sales
on a 1.4 acre parcel at 15300 S.W. Pacific Highway (Wash. Co.
Tax Map 2S1 10D, Tax Lots 900 and 901) . This approval is subject
to the following conditions:

1. That a landscape plan be submitted to design review, and
the sales area and growing amtbe screened.
2. That Sales be limited to plant materials and related plant
insecticides (i.e. , no accessory products such as peat moss,
gardening equipment)4
3. That an access easement be provided along the Pacific
Highway frontage which would accommodate either the
developzent qf a frontage road or combined curb cut
with the .adj4ent properties, azd the applicant may re-
tain the exit at the north end of Pacific Highway.

and economically appealing lower cost housing alternatives
. but getting higher density which left little room for
children to play. She felt it was the responsibility

the land itself was the most expensive cost.

.Hartley responded the land costs at $5,000 a lot were

sextremely high and construction costs were $32 a foot .
.Quimby asked if it was more economical to build smaller
lots with land being the major cost,
.Hartley stated $60,000 to $70,000 is low cost housing,
and the median cost of a new home is now $72,000, .

.Sakata stated it was the intent of the NPO Plan to anew .
for maximum use of these acres when the services were
44 ' available, not now. She also felt it proposed a maximum
house size on a minimum sized lot,
,Wood cited staff recommendation #8 and said the lots should
be the same size as lots 1 and 2 in order to support single
, . family detached units. He asked to what extent the small
lots lowered the price of the home.
.Rossman had no additional comments,

,Laws recommended adding additional language to the end
of condition #8, "and have minimum lot size of 5 ,000
square feet , "
.Quimby was concerned with the 32-foot turning radius in
cul-de-sac .
1Law6 stated 40 feet was acceptable with Washington County
Vire Department, and that condition #3 should read, "a
half cul-de-sac with a 40-foot radius , "
*Wood moved for approval based on staff findings and vecom-
mendations, Tepedino seconded. Vote passed. Sakata
and Quimby voted "no" ,

5.2 Zone Change ZC 3-78 "The Windmill"
. A request by Century 21 Homes for a preliminary plan and
program review of a residential planned development and zone
map amendment from R-7 and R-15 to R-7 PD for a 19 .62 acre
parcel consisting of 20 attached and 18 detached single family
units for a total of 58 units at S .W. 121st and Katherine
Streets (Wash. Co. Tax Map 2S1 3BB, Tax Lot 7200; 1S1 34C)
Tax Lot 1200) .
A. Staff Report : Read by Laws
. B. Applicant 's Presentation :
Herb Booke, Century 21, 1701 Blankenship Rd, , West Linn,
.stated the proposed plan was in. accordance with the 1971
Plan and NPO Draft : The density would be three units
per acre and the plan called for no more than four per
acre; the single family attached units which just needed
a line drawn down the middle to show two ownerships; all
lots are to be 5,000 square feet ; there would be no home-
owners association; there is no evidence that more speed-
ing would occur with street realignment which was done
at the request of the school district ; aesthetically die
present street alignment causes abutment to the open space;
. • he read a letter from the school district about meeting
the needs of rapid growth, and for improved visibility
,‘ and safety of the community the road should be straightened;
the cul-de-sac was longer to avoid creating an intersection
with a traffic problem; less congestion allowed for fire
protection; this wasn 't a case of a developer making some-
thing from nothing - the land is very useable - the marsh
land is dry eight months out of the year, there is lots
of native flora and fauna in the isolated area; the code
says the purpose of a planned development is the creation
of more flexible and diversified land use which this plan
proposes to do while economizing and using all available
p buildable land.
.Wood asked about the house near the windmill.
,Booke stated it never did belong to the rest of the land,
but to an individual who wished to preserve the rural
quality of his home.
,Tepedino asked if the road would be completed through
the flood plain.
.Booke answered yes; it was the plan of the school .
.Deb renne1.1 , of Tigard School District , supported the
relocation of Katherine Street stating it to be safe as
well as economical .

.Sonnie Owens, 12450 S.W. Summercrest Drive, NPO 7 •
Chairman, stated this wasn 't in compliance with the
plans for the area, and that there hadn 't been time
for a meeting of the NPO 7 members, but her objections
were based on previous meetings . She was concerned
H about the number of attached single family dwellings
and that they might be more highly concentrated than
deemed appropriate; traffic flow through the site
was a problem; access to the isolated area was cumber-
some; it was poor planning for all units to be a+ '..ached
single family; the open space park area didn 't s'it
with the surrounding area; that NPO 7 members hadn ' t
addressed themselves yet to the problem of realign-
ment of Katherine Street.

.Phil Spiff, 11990 S .W . 121st, stated where Katherine
Street ends is already congested and overburdened, -and
it would be undersirable to add to this ; Katherine
Street would dead-end into houses creating an intolerable
situation; Lynn Street should be used as a better
extension to the school .
' 1' „dr. Friberg, 12070 S .W. Ann, stated the attached houses
weren ' t ih keeping with the neighborhood.
.Adam Sardotz, 12020 S .W. 121st , stated the density
was too high for the street creating too many hazards .
,Bill Risner, 12345 S .W, Katherine, was opposed to the
duplex density and preferred the original design.
,Ralph Butz, 12170 SA. 124th, expressed concern over
the effect on the creek and its flooding,
.Jim Asp, 11945 S.W. Katherine , also expressed a simi-
lar concern,
.Ann Shannon, 12165 S ,W. 124th, stated it was presently
a beautiful area and high density housing at low
quality would bring property values down,
,Len Kluffner, 121st and Lynn , objected to the added
• congestion of the duplexes.

ment) .
3. That an access easement be provided along the Pacific
Highway frontage which would accommodate either the
development of a frontage road or combined curb cut

.John Kempe, 11695 S,W. Terrace Trails,, stated the road
would encroach upon his property.
.Ardenmore continued to cite human factors of Terrace
Trails which would be alter9d; the emergency access was
currently adequate; two couples had checked with City
Hall at the time of their purchasing homes on Terrace ,
Trails and were then told the street would never be ex-
tended.

Laws was present when Mr. Bolen spoke to Mrs. Stemler,
.Laws said "no" and stated the subdivision was required to
have a 40-foot right-of- way on a 34-foot surface.

.Sakata felt it should be sent back to developer'.
:Quimby agreed and felt all subdivisions should come before
the Planning Commission.

Tepedino felt not enough information was presented about
some major issues.
,Corliss recommended tabling until more information is re-
quired.

treated as a P."U.D. ; there was a serious problem with land
and neighbors; the subdivision ordinance doesn 't give staff
the clout required to address these issues; it was a unique
parcel with

corporated and trade-offs made; drainage problems should
be approached with full community participation.
.Popp agreed with Wood and the feelings of the residents;
couldn' t conceive of the Planning Commission approving a
cul-de-sac of that length without thinking it would be

The nature of this proposal is to establish a greenhouse business devoted to
. growing house plants, seasonal, holiday and bedding plants for sale, retail, and whole-
, ' sale, on a site of ample room for now and room to grow in the future (1.4) acres.
' This property is also my home as it is important to live close to the greenhouse; it '
• needs 24 hours attention.
, • My decision to purchase this property was made on the basis of N.P.O. 6 meetings

last September; were before annexation into Tigard. N.P.O. 6 people were saying they
were looking for residential-commerical type zoning and after talking to city planer,
Dick Bolens he thought it would be a very acceptable type business for this location.
On the strength of these facts I purchased the property and anlnow following instructions
from associate planer, John Laws, to ask for a R-7 zoning with a Conditional Use permit.
Tigard already has nursery retailers but has no grower-wholeeJlerTretailer,
who can offer plants grown right here in Tigard instead of Florida or Southern Calif-

rigors and cost of shipping.
This property is graced with many beautiful trees and shrubs which will stay and
by building this green house 85 feet back from the road and manacuring the landscape
it will have a park-like appearance. To the south, adjacent property has 11 junk cars,
trucks, bus, trailer and an abandoned house; which I hope something can be done about
it. To the north, the adjacent property is a prtvato residence with an unmowed lawn.
I can only see a major improvement in eye appeal on this side of the highway
and offer :Little or no traffic problem as I propose a soperate entranee and exit with
ample parking.
