school. After being shown by Mr. Altman, Mr. Tepedino stated

felt this current request for a realignment of Katherine St.

Wood stated the new alignment crosses the flood plain at tha

approve this request and would they be able to review the
access? Also what constituted fill?
Altman read from the T.M.C. book defining flood plain fill,

#1 and 42 with an additional item for the approval based only
on Planning Commission findings that the proposed route is
superior to the existing route and that the P.C. has not
) addressed the issue of whether the old or the new rourj-Will
be appropriate in its crossing of and possible fill of the
flood plain and the approval of realignment does not involve
any consideration of the entrance to the site

6.2 A request for a Similar Use Interpretation
A request by Chuck Cota for a Similar Use Interpretation for a
truck service, rental business in a Santry Tire Location on SW
Pacific Highway.
Commissioners agreed it was a similar use to the current use
but would still have to be heard before the P.C. as a Conditional Use. ,

business as a florist, having hired a full time floral arranger

Commissioners requested a report by staff at the next meeting on the
Status of the Sierra subdivision application. •
Corliss announced the approval at the Design Review Board of the
84,000 sq. foot warehouse on Hunziker.

The Tigard School District is requesting that Katherine
Street be realigned as per the attached drawing. While
their submitted written material does not directly state
why the District is seeking the change, they do present
a convincing case for making the realignment . Their
submission addresses all of the relevant issues and
staff concurs with the findings made and conclusion
reached by the applicant .
Staff therefore recommends that the request be approved
subject to the following conditions:
1 , That the School District initiate vacation
preceedings on the existing Katherine
Street right-of-way.

2 . That the School District proceed to dedicate
the subject realignment concurrent with
vacation of the existing alignment.
3. That the garage structure adjacent 121st

Pr,_,_ osal To establish a new street dedication to serve Bellwood/Brookway
and new elementary school site
Background - The voters have approved the construction of a new elementary
•
school to be located northerly of Bellwood/Brookway. Scheduled occupancy
is 1979. Site characteristics dictate that all foundation and earthwork be
•
done during dry summer months. In order to meet occupancy date, a building
•
•
permit must be obtained as soon as possible. The necessary architect/engineering
work is underway to obtain a permit. A separate requirement necessary to
obtain a building permit is the establishment of an access from the school site
•
• to 121st. The purpose of this proposal is to attain approval, by the City, •
of this new street location and for the City to accept the dedication therefore.
The expeditious approval will
1 . Allow a building permit to be issued so that construction
•
can proceed toward a 1979 occupancy date.
2. Allow the new road to be cut and fill placed which can
•
• be well compacted by all of the heavy trucks which

• will be associated with the school construction.
•
3 . Allow the heavy equipment and trucks to service the
• school construction without winding through the
•
residential Bellwood/Brookway neighborhood.
• .
The desireability of an alternate access to these neighborhoods has long been
recognized by the City. The only remaining question concerns the best
•
1 location of this access street.
A few years ago, a right-=of-way was displayed on County tax maps which ran
^ ' ~ from the Katherine Street terminus by the sr~pool site to the intersection of
121st and Katherine Street. To our knowledge, this location was not planned
by the City, nor was any detailed analysis performed. In fact, the legal
status of this presumed right-of-way is still uncertain. •
•
T.he, Proposal - It is proposed that a new right-of-way be established in
• J j accordance with Exhibit C and the legal description attached thereto and
that the previously considered right-of-way, if legally existdht, be vacated.
•
• Planning- Considerations - Assuming the need for a connector between Katherine
• Street in Bellwood/Brockway and 121st, the following considerations should
be utilized in establishing the best location for the facility:
1. Safety for autos, pedestrians and school buses

2 Street function
• 3. Surrounding uses
4. Conservation of resources •

intersect to make four-way intersections. Other intersecting points

sight distance due to vertical and horizontal profile of 121st St.
. The residential, limited traffic flow characteristics of both•• • Lynn Street and Katherine Street mitigate any serious hazard

. associated with locating at these points.

• • B. ,Sight distance - A critical safety factor. The point on 121st Street
that gives maximum sight distance in both directions is at Lynn Street
.
• . . (about 1,000 feet southerly to S. W. Walnut Street and about 1,000 .

feet northerly where the road bends) . By contract. the Katherine ,.
Street point provides about 500 feet sight line to the south (inter-
section of Lynn and 121st) and about 500 feet to the north. Based •
,. upon the assumption that the existing windmill. will remain and
the existing garage is to be torn down; an assumption in which
the landowners concur. All other points between Katherine and

Lynn and Lynn and Walnut do not provide adequate sight distances.
•

, C. Speed - Speed is not effectively controlled by design. Maximum
• speed by law will be 25 m.p.h. The gently curving alignment of

. • either the Lynn Street conneeHon or the Katherine Street connection
• • ,, may help to reduce speed by eliminating a long straight road.
2. Street Function
A. Any street making the connection under discussion will serve two
primary functions (1) providing access to the school and neighborhood
4:. and (2) providing access to future home sites. Any of the possible,
locations perform this function effectively, with the exception of the
existing dedicated right-of-way. This is true because that alignment
follows the edge of the flood plain which precludes any development
• use of at least cne side of the street c (Topography is such that it•could also prove difficult to attain access to home sites to the south
of the street as well).

3. Surrounding Uses
A. The land is zoned for residential use, hence the street will serve
a residential function. The land is presently underdeveloped.
B. The street location will be made prior to development, hence there
is the need to be sure that the establishment of a right--of--way
does not preclude reasonable, efficient development patterns. The
Lynn Street alignment does not preclude reasonable development
or use of the surrounding land. The Katherine Street alignment
does preclude efficient site utilization due to the single loading o ''
required by the proximity to the flood plain.
4. Conservation of Resources
A. Pavement Coverage,- The Lynn connection does not preclude officiont
0 development The
t of the site. 'ihe Katherine Street connection, clue to
single loading necessity will result in more ground being covered
by asphalt in order to utilize the site. Such excess road construction
is inefficient, costly, and is not in accord with good planning
principles.

°. • B. The soil along the dedicated right-of-way contains a peaty deposit
which must be removed in order to provide a stable base„ The Lynn 1 .
Street alignment eliminates this problem except in the area where
the road crosses the drainage Swale,
•
C. The dedicated right-of-way transverses a slope along the total distance
which will require considerable cut into the site to the south, This
cut is compounded by the peaty deposit along the edge of the flood
plain. This combination dictates the need for excessive cm. This
problem can be reduced considerably by utilizing the Lynn Street
alignment.
Summary - The Lynn Street connection is the better alternative due to:
1. Best sight distance for safety
2. Equally effective speed control through street alignment
3. Allows reasonable development of land without precluding options
4, Is an efficient utilization of land resources by reducing the
amount of resources that must be brought an from other areas for
fill purposes and by reducing the amount of cut that must be made
5. Reduces asphalt coverage of site
6. Is less costly to construct due to soil conditions while serving
• all functions in a better manner
7, Longevity of street would probably be greater due to a better soil
base

in the vicinity of Katherine Street is supportiv r.! of the
concept being proposed by the Tigard School District to
vacate the existing road right-of-way and to re-align
the extension of Katherine Street to intersect with 121st
street at Lynn street rather than at Katherine street.
It is our opinion that with the co-or ration of the
City planners a better overall development will be poss-
ible while at the same time making the road construction

o Sakata stated, as an employee of the applicant, she
wouldn't vote; but, if she abstained, there would
not be a quorum.
o Popp questioned the school district boundaries of
Beaverton and whether or not changing of boundaries
had been discussed with Beaverton, as Beaverton
district is adjacent to the property.
o Fennell stated they had discussed chanaes, and it
was not feasible.
o Goldbach questioned whether this area was covered
by the Comprehensive Plan.
o Laws responded the 1971 Plan applied and also peo-
ple in NPO 7 were in agreement with the proposed
alignment with Katherine Street.
o Mrs. Risner, 12345 S.W. Katherine, expressed con-
) cern over playground and ball field location and
mvpi agreed on their proposed location.

Brian moved and Sakata seconded approval of the use
based on staff findings and recommendations.

I . Findings of Fact:

1. The site is designated Urban Low Density Residential both
on the Tigard Community Plan, 1971 and the NPO 7 Draft Plan
and zoned R-7, Single Family Residential.
2, Section 18.20 .020 of the Tigard Municipal Code allows
schools (elementary) and their accessory uses as condi-
tional uses in the R-7 zone.
II. Staff Observations and Findings:
1. The site is a relatively flat, vacant parcel surrounded by
single family development to the south, undeveloped parcels
to the north and east, and to the west the proposed Summer
Lake Planned Development.
2 . The applicant is proposing to construct an approximately
24,500 square foot building, which is planned as Phase I of
a multi-phased development on a 10, 35 acre parcel. Total
development is projected to be approximately 54 ,800 square
feet of floor area, which will represent the addition of
another eight to ten classrooms and total enrollment of 500
students.
3. Phase I is to be located in the southeastern portion of the
site and will consist of the construction of eight to ten
classrooms, with an enrollment estimated between 200 to 250
students, with a staff of six teachers, and supported staff
of four to six persons. The construction of a parking lot
to accommodate 46 parking spaces will also be included
within Phase I.

school site and avoid running school buses through the
Brookway Subdivision.
v The site is connected with Katherine Street, to the south,
He by a 100 foot long dedicated street right-of-way (50 feet
wide) . The d8velopment plan proposes improving this right
. , of-way to less than city street standards, The applicant
has stated that the tapering of tilt: pavement surface will
discourage extra-curricular traffic use of the school site
after normal hours of operation and will still provide the
necessary area to accommodate school buses accessing the
,. site.
6 , Sanitary sewer is available to the site via a 12 inch line
located adjacent the southeast corner of the parcel. Water
. is available throught the Tigard Distritt via a six inch
line in S.W. Katherine at 124th and an eight Inch line in
.) S.V . 121st.
i 7 . A very small po -tion (4,500 square feet) of the 100 year
flood plain of Summer Creek is located in the uppermost,
northeast corner of the parcel. This area drops off quite
sharply, and no present or future development is proposed

III . Conclusionary Findings:
1. The applicant's proposal to deviate from the street stand-
t ares (reduction of surface pavement width) for that portion
of right-of-way between S.W. Katherine and the school prop-
,
erty would not appear to adversely impede the safe and ef-
ficient flow of traffic in that this portion of the street
essentially represents an extension of the access driveway
from the site to where it intersects with S.W. Katherine
Street. However, the retention of a sidewalk on the west
side of the street would appear imperative to protect both
, (
the health and welfare of the students using the school fa-
• m •cilities as well as to provide for a continuation of pedes-
' trian access to the school site from the neighborhood.
2. The location of the school buildings, proposed ball field,
and playground areas adjacent existing single family devel•
. opment to the south and proposed development to the north
and west necessitates thah an effective buffer be provided
between these properties and the school . . Phis cohld be ac-
complished by means of site-obscuring landscape materials
(e.g. , earth berms, hedges, trees, fencing, etc. ) .
Staff Recommendation:
Based on findings of fact and conclusionary findings, staff
recommends approval of the proposed elementary school with the
following conditions:

We were scheduled for a 16 November conditional use permit.
Laws wants more detailed plot plan.
Y explained to him that it would be several weeks yet before

enough for the City of Tigard.
We agreed to switching the hearing date to 6 December 1977.
All material must be in by 16 November that is to be considered
at the 6 December hearing.

The following is a written narrative for the Planning Commission to review
on points listed below:
1. Nature of proposal and the reason for requesting the particular action.
School District facilities are at present in capacity or overloaded,
New facilities are required. The site will be used for the construction
of a new elementary starter school of 200 - 250 students.
Total future capacity of the school will be 500 students.

2. How the proposed use is in conformance with Tigard's adopted comprehensive
plan.
The low density residential use will not be compromised by the proposed
elementary school .
• 3. Community need and/or public benefit derived from the proposed action.
Community need as described in Item (1) above.
4. Any changes in environmental , economic or social conditions and/or
changes in availability of public services, or access, and/or any
other aspect of community development directly affecting the subject
r r+ site that would justify the required action.
• The proposed elementary school would provide an extension of
S.W. Katherine Street from S.W. 121st. Ave. to the subdivision south
of the school property.
5. Why the proposed location for your proposed land use is more suitable
than other locations in the city zoned to allow the proposed use?
The property is well located in the Fringe of the school district
boundary and will be able to reduce the overload at Charles F. Tigard
School .

The impact or effect the proposed development, use, or activity will
.,� have on adjacent sites, occupants or activities and on the immediate
neighborhood.
The proposed school would provide a playground for neighborhood children
during off school hours and during the summer.
7. Tye types of public services necessitated by your proposed development
