Thereupon the following expressed opposition on the basis rd existing drainage problems, traffic on 110th, but imarily on the topic of the expectation when they purchased their homes that the neighborhood would continue to be developed in accordance with the zoning for single-family residential, thereby assuring maintenance of value in their • home investments: • • Ronald D. Howard read the STAFF .RECOMMENDATION. In REBUTTAL Mr. Gause submitted that the logical place to stop duplexes is the is the 110th Avenue exit; that the drainage complained of will be taken care of. • ; Selby requested an additional Condition No. 6: "That a 5'6" sight-obscuring fence of the same type as the fence being emplaced on the Garden Park place develop- , ment be provided prior to issuance of the building permit. " The reason, he explained, Was that the fence would be the buffer between the multiple and single family • residences. Further discussion indicated this conditional use request is not in compliance with the NPO plan; that the applicant would, if his finances permitted, retain the duplexes for rentals; that Lot 4 is adjoined by duplexes. Smith MOVED for approval of Conditional Use CU 4-79, based on staff findings and recommendations: including Conditions 1 through 6. Under OLD BUStNd55, Howard discussed changes in the sensitive lands ordinance discussed in the study session last week. He asked that any further comments be given to him before presentation to the City Council at a study session on Monday, March 19. Under N Busragss, Howard explained a problem which had arisen with a developer on Bonita Road who, due to approvals given by previous Planning Department staff members, had proceeded substantially in his development, but that a parking area was in the flood plain. The developer has agreed to maintain the greenway for five yearst and will work out an equalization plan to eliminate any reduction in capacity of the floodway. The applicant proposes to build four duplex lots (8 dwelling units) , The density calculation for this zone (R-10 = 10,000 square foot dwelling unit) is as follows: , . , . 1,45 gross acres (converted into sq.ft.) x 43,560 sq. ft. = 63,162 sq. ft. of gross . ) i area. . Divide 63,162 sq. ft. by number of proposed units: 63,162 * 8 = 7,895.25 sq, ft. per dwelling unit. Therefore, the project's dwelling units per gross acre are below the required 10,000 square foot lots. 5. The site slopes from the southeast corner dropping approximately three percent diagonlly to the northwest corner. The surrounding property uses are a residential unit to the west across S.W. 110th and single family units directly to the north. Unified Sewerage Agency service and the Tigard Water facility is available from the east approximately 140 feet and the north along S.W. 110th • approximately 150 feet. 11. Conclusionary Findings: 1. Southwest 110th is in substandard condition having inadequate right-of-way or paving width, no curb, gutter or sidewalks and in its present condition is over capacitated. 2. This request does not conform to the density limitations of the R-10 zone (Single Family Residential) . 3. There is an identified public need to provide a diversity of housing type within the community, according to policies set out in the Housing Plan. III. Staff. Recommendations: Staff recommends -approval of the conditional use for duplexes subject to the following conditions: 1. That the duplex units be limited to one located on the southeastern • portion of the site with the remaining site area being improved a5 subdivision lots Aut to exceed six dwelling units in total. 2. That the applicant dedicate the adequate distance (as deter.Mined by City Engineer) of right-of-Way along S.W. 110th, and construct half street • improvements to City Standards prior to issuance of building permits. 3. That the required construction and drainage plans be submitted and approved with the necessary bond agreement to the Engineer and Building Departments for approval prior to issuance of permits. 4. No changes will be made to approved plans or specification S unless formal application is made to the appropriate department and changes are approved by that department. Application for changes will be made in writing and shall include applicable drawings, engineering • specifications and other details requested by the department. Community goal #2 states : 4 The comprehensive plan recognizes the established character of existing neighborhoods and seeks to perserve and enhance existing i . neighborhood values. Puture development 'proposals should be sensitive • to the concern of citizens for their own immediate environment as well as to the welt being of the city as a whole. 3. Tne City of Tigard lies in close proximity to major employment centers : Intel and Tektronix for example . (not to mention being a major suburb of the Portland Metropolitan area ) It is for this reason that a diversity of compatible housing types is desi t^abl c.. Public : Jrvices affected by this development will not suffer. Fire service will be benefited because of the extention and widening of SW Garden Park Place. Water, sewer, and other utilities are avail- able adjacent to the site. As mentioned previously, streets will benefit by additional improvement. Police protection is already! available in the area . We, the undersigned, feel that ,chanz:4,-ng_ the existing- zoning on a 1.45 acre parcel of land, east of S.W. 110th Avenue, at the . west end of Garden Park to allow duplexes would be detrimental to the basic character of our neghborhood. This is a neighborhood of established single family homes mostly over tett years old with lot sizes from approximately 15,000 square feet to 2/3 of an acre. , , The Garden Park development off S.W. 110th Avenue and Gaarde Street will be bringing sixty six families and increasing traffic to our area as the only access is off of S.W. 110th. This development is more than enough as a "so called" buffer between the commercial professional. highway frontage and our single family neighborhood. This higher density should not be allowed to disrupt an established neighborhood with increased traffic, danger to children, incompatible lots and housing and neighborhood instability.
