Chairman Whittaker called the meeting to order at 730 p. m.

Members present: Hartman, Hansen, Nicoli, Porter, Sakata, Wakem

4. PUBLIC HEARINGS
4.1 Conditional Use CU 4-75 (Darren Dodson dba Trudoor)
Tabled at the February 18 meeting due to absence of applicant.
A. Staff Findings

The applicant described the operation of his proposed
plant and addressed the Fasano requirements.
Cross examination by staff further elaborated on require-

truck delivery and pick-up.

4.2 Conditional Use CU 5-75 (Tigard Evangelical Church and the
Southwest Church of Christ)
A. Staff Findings
Staff report was read by Powell (see attached) .
B. Public Testimony
Woodrow Hughes testified for applicant.
D. Christie, Realtor, testified for applicant illuminating
further the points made in his letter of February 7, 1975.
Co Staff Recommendation
Approval with conditions that:
(1) The use be permitted for a two year period.
(2) That the site and building be brought into code con-
' formance with the e n xceptio that only the daily used
portion of the parking lot need be surfaced.
D. Commission Discussion and Action
Moved (Hansen) , seconded (Wakem) to approve for a two year
period per staff recommendation.
Moved (Porter) to amend to a three year period. Second
(Hansen) . Amendment failed by majority vote.
Original motion was carried by majority vote (Whittaker
against, Sakata abstaining) .
4.3 Variance V 1-75 (Lincoln Properties)
Variance of the Commercial-Professional zone to allow a free-
standing sign.

B. Public Testimony
John Flattery from Lincoln Properties testified indicating
that the sign was a nameplate and that there were many

signs on 1-5 and Hwy. 9.17; that the sign was not adver-
t • tising; that there were 81,000 sq. ft. of office space
41 • in the complex and that this was the minimum variance that
would satisfy Lincoln Properties ' needs.
Mr. Flattery also entered letters from Lamb-Westpn and
from Farmers Insurance indicating their support of his
request.

Mr. Flattery then showed slides of other signs on 1-5 and that 217 indicating at Lincoln Properties was simply attempt-
- ing to preserve its identity.
Commission cross examination dealt with the nature of the
sign requested and whether the Hriderll signs shown in the
illustration would be a permanent part of the sign.
Mr. Flattery indicated they would not and that they would
be removed as soon as the space was leased.
Mr. Ron May from the Gilley Co. spoke in support of the
signs indicating they were necessary for their marketing
program.
Mr. Roy Sims, a neighboring resident, spoke in opposition
to any signs in the C-P zone on SW 72nd or on SW Hampton.

A. Staff Findings
Staff read the staff report (see attached) which was amended
orally to include new lot dimensions revealed by survey for
Sabre Construction Cob after the staff report had, been
printed and distributed.

C. Commission Discussion and Action
Motion for approval (Nicoll) , second (Hansen) on the con-
dition that minor land partition 4-74 be finalized before
building permits be issued. Passed unanimously.
4.5 Temporary Use (Extension) TU 1-74 (Tualatin Development Co. )
. for a truss manufacturing facility on SW 109th Avenue - was moved
to the bottom of the agenda. Applicant was not present.
5. PRELIMINARY DEVELOPMENT PLAN AND PROGRAM PRESENTATION (Not a hearing)
Iron Mountain Investment Co„ , applicant for a Planned Development
west of 121st Ave. , south of Summercrest Drive.
A. Staff Report
Staff report was read by Powell (see attached) .
B. Applicant Presentation
Mr. Henry Vaderburg, architect for the applicant, presented
the preliminary plan and program and outlined the specific
requests to be made of the Planning Commission.
C. Commission Discussion and Action
Nicoll indicated the density trade-off needed to be
tightened up. "Density trade-off for unusable land is
no trade. "
Porter indicated that he shared Nicoll's concern and was
concerned about the road in the flood plain.
Whittaker indicated the information that he would like to
see as part of the general plan would include a vicinity
map showing adjacent and nearby buildings, streets and
topography, a soil study and some assurance that the
, t street indicated as the central spine of the plan goes
through the Planned Development and connects to something
other than a dead end.
The Commission then agreed that they would hear the general
plan and program at a subsequent meeting.
4.5 PUBLIC HEARING - Temporary Use Extension TU 1-74 (Tualatin
Development Co. ) allowing a truss manufacturing facility
on SW 109th Ave.

Staff Findings
1. Tigard Industrial Park is presently 75-80% developed. Site
design of the industrial park itself is subject to Design
Review. Overall site planning has therefor been previously
addressed.
2. "Trudoor" and "Wood Stove" will apparently share some
common facilities. Some conflict may exist between occu-
pancy classifications which should be addressed by the
applicants.
3. No appreciable impact on traffic generation of the in-
dustrial park or on circulation within the park is antici-
pated.
4. Adequate parking appears to be provided although some con-
flict is possible with the anticipated development of
Tigard III which will introduce new construction adjacent
to the "Trudoor" and "Wood Stove" sites
5 . Stardrill Co, has a present existing problem with provision
of acceptable outside storage of heavy equipment which they
base on the site. Their prominant location at the entrance
to the industrial park contributes to the problem if they
continue to store their equipment in its present usual
location,

6. Chapter 18.52.060 requires that all permitted outside
storage be screened by a sight obscuring fence at least
6 ft. high. Stardrill has been notified of this require-
,- , ment and has indicated its willingness to work out a re-
4 7 asonable solution.
7. All three activities appear compatible with the design and
present occupancy of the project with the possible ex-
,
ception of the reservation cited by staff in finding #2
of this report.

8. The present uses in the industrial park, the conditional
uses proposed and the park _conform to present zoning and to
the Tigard Community Plan. N. P. 0 #2 's proposed Plan
agrees also. Present land use in the vicinity of the
,
industrial park is residential, but has also been desig-
nated as future industrial in the Tigard Community Plan. a

February 18, 1975

1. CALL TO ORDER - The meeting was called to order. at 7:35 p.m.
2. ROLL CALL - All members were present and staff members Bolen and •
Powell
3. APPROVAL OF MINUTES
The minutes of the January 28, 1975, and February 4, 1975, meetings
were considered. The minutes of the January 28, 1975, meeting were
amended to show that George Penrose of NPO #1 and Commissioner Alan
Popp were present.
4. PUBLIC HEARING
4.1 'Conditional Use - CU 2-75, CU 3-75, CU 4-75
All above located in Tigard Industrial Park, an M-4 (industrial
park) site on SW Tigard Ave.
A. Staff Findings
1. Powell presented the staff findings pointing out that all
4 three conditional uses are inihe same industrial park and
have therefore been grouped into one staff report.
•• Testimony and Commission Action in the following minutes are separated
into separate requests.
B. Public Testimony - Stardrill Co.
1. Bob Steuben of Stardrill described his companyts operation
saying that they supply well drilling rigs and components to
operators. He said the used rigs, which have been stored
• on the premises, are in the process of being repaired and
resold. This was said to be their busiest time of the year
and it is rare that 5 used vehicles will be stored at one
time. It was stated that the Stardrill Co. , with the co-
.
operation of the industrial park owner, would be willing to
provide a screened area for well drilling equipment.
2. Joe Schulty, from SW Johnson St. and across Fanno Creek
from the proposed use stated his opposition to allowing
the outside storage of vehicles in that the property abuts
a residential area.
3, Roy Shaw of 10005 SW Johnson also stated his opposition to
the request saying that anything which makes additional

noise for the residential area he found objectionable.
C. Staff Recommendation
1. Staff recommended approval of the use with storage area to
be provided screening the sight of stored vehicles and as
approved by the Design Review Board. •
D. Commission Discussion and Action
1. Ball stated that the applicant had not attempted to meet
the burden required by "Fasanou and the request should be
denied. When asked what particular item should have been
addressed, Ball replied that the applicant had not in any way
II shown that his requested outside storage would not be detri-
mental to adjacent residential uses.
2. Hansen said that he could vote to approve the wholesale
distribution use, but not the proposed outside storage.
3. Ball moved to deny the conditional use request, Hartman
seconded and the motion passed by majority vote with Popp,
Hansen, Nicoli and Whittaker voting no.
4. Popp queried the other commissioners as to whether their vote
meant they disapproved both outside storage and wholesale
k distribution.
5. Ball responded that the reason for his motion was that the
applicant had not provided the proper burden of proof, not
because he necessarily disapproved of the request. But,
in order to approve the request he would need more infor-
mation than the applicant had made available at the hearing.
B. Public Testimony - Wood Stove •
1. Mr. Tofflemeyer described his Wood Stove fabricating process
and stated there would be no outside storage nor would noise
levels exceed acceptable standards.
2. No one spoke in opposition to this request.
C. Staff Recommendation
1. Staff recommended approval of the request.
D. Commission Discussion and Action
1. Popp moved for approval of the request and Hartman sbconded.
The commission vote was unanimous on the motion.
B. Public Testimony - Tru-Door
/. 1. This item was tabled to the next meeting because the appli-
cant was not present to present his case. Moved Wakern,
seconded Popp, vote unanimous.

4.2 Minor Land Partitioning - MLP 1-75

for the purpose of leasing land to individual developers.
# A. Staff Findings
1. Bolen presented the staff findings which described the ,
proposed lot areas and means of providing access.

B. Public Testimony ,
1. Mr. Jack Robertson, the _grp'perty owner, spoke for his
request stating that he had already signed a 21 year lease
with the McDonalds Restaurant Corp. and he wished the
commission to permit the partitioning so a building permit
could be issued. In addition he said that there had been
some discussion of not allowing McDonalds to use School St.
as an access point and he said that this is a public through•. • way and they should have the right to utilize it for access.
2. Larry Haugset, the realtor, asked the commission not to deny
access to School St. , but rather to leave this issue to the
Design Review Board who were responsible for reviewing the
. site development plan.
3. Cliff Ashley, NPO #1 Chairman, said that he was speaking as
a private citizen and that he was concerned that the pro-
posed McDonalds is incompatible with other uses in the area
such as the School site, that tremendous amounts of traffic
. would be generated and the site configuration just didn't
seem to lend itself to this intense of a use. . .
C. Staff Recommendation

1. Staff recommended approval of the applicantts request with
the condition that 5 ft. be dedicated to Grant Ave. and
, . that access be provided to lot "B" from Pacific Hwy. only.

5. Porter stated his concern that to partition the property to
allow the development of a McDonalds Restaurant at the
location adjacent a school site would be a safety hazard
due to the high traffic volumes generated by such a use.
He continued saying that the opLurpose section of the sub-
division code requires the commission to consider public
safety when approving subdivisions and partitions. He then
stated that'he was in opposition to allowing this partitioning
for the McDonalds use in that it would jeopardize the public
safety.
• 6. The commission voted on Hartman's motion and it passed by a
majority vote with Porter voting nay.
4.3 Establishment of a Planned Development District and a Zone
Change (ZC 5-75) changing an R-7 zoned parcel on SW 98th Ave.
• soth of Greenburg Rd. to A-2 (PD) .
A. Staff Findings
1. Powell presented the staff findings relevant to this case
pointing out that it conforms with both the Tigard Community
Plan and the NPO #2 Plan.
D. Public Testimony
1. Pat.Thomas„ the project planner, presented this proposal to
the commission addressing the various fiFasane items and
pointed out that the proposed density will be 7.7 dwelling
• units per acre, below the 12 dwelling units allowed in the
adopted plan.
2. There was no one present to speak in opposition to the requesi.
C. Staff Recommendation
• 1. Staff recommended approval of the request with the conditions
that
a. If the PD is not implemented, it will revert to the R-7
zoning.
• b. The owner dedicate 10 ft. right-of-way to SW 98th and
sign an agreement to participate in a Local Improvement
District.

d. That density be controlled by the site development
plan which specifies 7.7 dwelling units per acre.
D. Commission Discussion and Action
1. Whittaker pointed out that this site is less than the mini-
mum specified for a planned development in the City's code
which is 4 acres; however, as he pointed out, the Planning
Commission does have the capability to consider PD's of
less than 4 acres if it so desires. He then asked the
commissioners if they agreed that this proposal does merit
being considered. The commissioners did concur that the
proposal does have merit, --
2. Ball said he wanted to see the density of 7.7 dwelling units
per acre attached to the PD and asked the applicant, Mr.
Scott, if he agreed to this density restriction, Mr. Scott
replied that he did agree to this density.
3. Hansen moved to approve the zone change from R-7 to A-2,
with the submitted PD, based upon the staff findings and
including the staff conditions with the exception that the
density be based on 7.7 dwelling units per acre and not
according to the depiction on the site plan and with the
additional condition that a maintenance agreement be
required for areas to be held in common ownership. Ball
seconded the motion and it passed by unanimous vote.
4.4 Recommending Amendment of the Tigard Comprehensive Plan for
the area known as NPO #1 (CPR 1-75)
A. Staff Findings
1. Bolen presented the staff findings for this item which in-
cluded a summary of the joint meeting between the NPO #1
and the Planning Commission. He pointed out that using
the resolution of the City Council which specified certain
concerns and testimony which had been offered at previous
meetings a revised plan was developed. This plan was dis-
played in graphic form for everyone at the meeting and Bolen
pointed out the changes from the previous plan.
B. Public Testimony
• 1. Chuck Stearns said that the existing frontage road on
Pacific Hwy. should remain and should hook into the highway
for easy access.
2. Craig Eagleson, owner of Farm Craft Chemicals on Commercial
St. , presented two maps that he had prepared for the
commission showing the one being proposed and the land use
pattern that he would like to see shown, which included
his parcel as the only industrial parcel on Commercial St.
He then presented a history of his business.

3. Chuck Stearns spoke again stating that the proposed change
from C--3, genera % commercial, to C-P, commercial-professional,
• would take Value from his property.
4. Fred Olson, who lives on the Frontage Rd. , stated his oppo-
sition to the proposed C-P uses and said that there are
already four lots with C-3 uses in the area so proposed.
5. Jess Mason, a realtor representing Mr. Olson, asked the
commission to be objective and to see a change from C-3
to C-P as a "down ' zoning. He then stated his belief that
the property cannot be marketed as C-P in that no demand
exists.
6. Cliff Ashley, NPO #1 Chairman, pointed out to the commission
that this reconsideration had come about because the means
to accomplish the plan's objectives were not acceptable to
the Council. He then asked the commission to again con-
sider the plan objectives, especially in terms of controlling
strip commercial development on the highway and to see if
the proposed means were not appropriate. He concluded that
more plans are changed by 'zoning pressure than zoning is
changed by planning pressure.
C. Staff Recommendation
1. Staff recommended that the revised plan be adopted.
D. Commission Discussion and Action
1. Hartman stated his support for the Commercial-Professional
proposed use on the highway and his feeling that the staff
findings had shown that a definite community interest exists
to control continued strip commercial development on the
highway.
2. Hansen stated his concern that NPO's do not actually deal
with the real problem of traffic congestion on the highway.
3, Nicoli stated his agreement with Hartman that the area
shown for Commercial-Professional uses on the highway is
in the community interest but said that Farm Craft should
remain in an industrial zone.
4. Hartman stated his agreement with Nicoll in that Farm Craft
• should remain industrial.
5, Wakem said that commercial zoning on Commercial St. met the
• plan objectives and should therefore be recognized.
6. In response to a statement leaving Farmcraft zoned industrial
and zoning the other parcels commercial would result in spot
zoning, Ball replied that the issue is not spot zoning, but

rather the functional relationship of Commercial St. to
Main St. The commission should be applying land planning
criteria to this matter and if they were, this would lead
them to the conclusion that commercial zoning is appropriate.
7. Hartman moved to adopt the revision for Burnham Street and
' leave Commercial St. designated for commercial use and Ball
seconded.
B. Hansen moved to leave Commercial St. in industrial zoning
and Nicoli seconded. The motion lost by a majority vote.
91 The commission then voted on Hartman's motion with the
majority voting yes and Nicoli voting no.
10. Wakem then moved to adopt the revision which would make all
of the Buchholz property retail-commercial. Hartman
seconded and the motion passed by unanimous vote.
11. Popp said that in the frontage road portion of the highway
he would like to see the frontage road connected with the
new street proposed to go from Pacific Hwy. at the point of
the Heinz Repair Shop back to Ash Avenue connected. In
addition he said that he recognized that there might be
some loss of property value with the proposed commercial
professional use, but that this was definitely within the
public interest and was therefore in favor of it. He then
made a motion that the frontage road be connected on the
south to provide the safest connection possible with the
proposed new street. Sakata seconded and the motion passed
by unanimous vote.
12. The commission next discussed the best type of proposed
zoning to deal with the problem of strip commercial develop-
, ment.
13. Porter suggested that the commission should construct an
entirely new zone applicable specifically to Pacific Hwy.
to protect the hwy. as much as possible from uses which

would be detrimental to it.
14. Ball moved that the plan be accepted with the proposed
commercial-professional uses in the frontage road portion
of Pacific Hwy. Popp seconded stating that possibly the
C-P zone is somewhat restrictive but that it does provide
a proper type of zoning for this area until a possibly
refined type of zone as suggested by Porter could be
developed.
15. The commission voted on Ball's motion and it passed by
majority vote with Hansen, Porter and Nicoli voting no.
4.5 Zone Change (ZC 11-74) changing the zoning map in that area
known as NPO #1 to conform to the Comprehensive Plan,

Subject: Determination of Land Use classification in an
M-4 zone
Under provisions of chapter 18. 52. 020 § 13, Tigard Municipal
Code, any use held by the planning commission to be similar to
the explicity identified conditional uses allowable in an
. M-4 zone may be granteri a conditional use permit.
". An application for a conditional use permit has been received
for a fabricator of prehung doors to locate in Tigard Industrial
Park.
An interview hold today with the applicant has revealed that
his intention is to assemble premilled door jambs, doors,
and hardware into prehung units. No wood machining or milling
however, should be allowed in this zone.
It is the staff' s contension that this activity is less intensive
1 than furniture manufacturing or any of several other activities
allowable either outright or by permit in the M-4 zone.
• Staff requests that the above activity be allowed in an
M-4 zone as a conditional use, implying no permit or prior
approval is here 'given but that application ma./ be vccepted.
