Request: For a Conditional Use permit to operate an avis vehicle rental facility in a C-3 "General Commercial" zone on a 1.31 acre parcel. I. Findings of Fact: 1. The site is designated "Retail Commercial" on the NPO #2 Plan Map and currently zoned C-3 "General Commercial." 2, The applicant requests a conditional use (see attached narrative) permit to operate an Avis Vehicle rental facility in accordance with Section 18.28.020 (5) of the Tigard Municipal Code Permitting Automobile, boat and trailer sales; and in accordance with Section 18.12.030 Authorization of Similar uses. 3. The site is relatively flat and below grade of S.W. Greenburg Road. Surrounding land uses are commercial and industrial buildings to the west, east and south, Highway 217 is located to the north. 4. Water service is available to the site from the Tigard Water Districts eight inch line in S.W. Cascade Avenue, 5. Sanitary sever is available from the Unified Sewerage Agency/ Tigard with an eight inch line in S.W. Greenburg Road. 6. Southwest Greenburg is designated as an arterial street north of 5.W. North Dakota Street i:equiring 80--121" of right-of-way. There is currently adequate tight-of-way to meet these ste zdards. Southwest Cascade Avenue is 6esignated as a collector Street. There currently exists the necessary 60 feet of right-of-way. 7. On May 22, 1978, the City Council approved the subject site zone change from Washington County "General Extensive Commercial's to the City of Tigard "General Commercial" with the following conditions (the owner has complied) : A. Five feet of right-of-way be provided along the Cascade Avenue frontage. B. The applicant file with the City Recorder an agreement not to remonstrate against a Local Improvement District (LID) for street improvements to S.W. Cascade Avenue and the frontage road along the southeastern portion of the property. The applicant has pointed out (In the narrative dated December 14, 1978) and staff agrees that the subject property location lends itself to this type of operation and it will not adversely affect the traffic or property condition in the vicinity. 2. Proper landscaping will screen and enhance the property. 3. The proposed use is in compliance with the land use designation of the Comprehensi-re Plan and is a similar use to the Conditional Use allowed in the C-3 zone. 4. The applicant proposes to provide two accesses (see attached map) and hours of operation that will alleviate traffic flow problems. III. Conformity With Comprehensive Plan , - According to the comprehensive plan adopted by Tigard, the area wherein this parcel lies is designated for development by commercial uses. Tigard Planning Commission . and Planning Department December 14, 1978 Page TWO • Specifically, the Plan recognizes as one of its most sic..3nificant concerns the impact of vehicular traffic on the neighborhood. A discussion of the traffic generation by the proposed facility appears below, but it is noteworthy here that • the expected traffic generation is so slight that it will not have discernible affect at all. The proposed use would fall in • line with any of the Plans' assignment alternatives. The Plan expresses use of the Greenburg 217 Interchange peripheral sites as serving the transit demand for highway commercial establish- , ments. The Avis facility is specifically highway oriented by • nature and use. The use of the parcel as a vehicle rental location is an excellent buffer to the industrial uses adjacent to it because it is not a use which offends or is offended by either the traffic or the industrial uses. 4 V One of the deficiencies in the general area as noted by the Plan is inadequate landscaping and attention to building appearance and identifying signs for commercial development. The proposed use, as shown by the preliminary site plan, intends to utilize landscaping to its advantage in making the site a "clean- . , green" facility; one which softens the harsher impact of the "road- way" appearance and tends to accent a most peaceful environment. In this case, the means of invitation to Avis customers is pre- cisely what the Plan calls for to improve the neighborhood. While the community and general public would derive benefit from almost any financially sound and artfully ,r.esented commer- . cial enterprise on this parcel, its use as we propose it is particularly desirable. The primary basis for our opinion is • community need combined with the 'unique location . • The size, shape and presentment of the parcel to the thorough- / fare lends itself to Ingress and egress of the type of vehicles used by our client. Its proximity to the specific highway is ad- vantageous in moving the vehicles efficiently and safely to and from the facility. The enhanced safety of our customers and the general public on the road because of the use is certainly a general benefit. At the same time, the actual number of vehicles accomplish- ing ingress and egress is substantially less than say a repair shop, bank, retail store, or motel. All of which are permitterl uses in the C-3 zone. Vinally, when services such as vehicle rental, especially trucks, are readily available to the citizens of Tigard in their city rather than at a greater distance, several benefits accrue ranging from increased dollar circulation in the immediate community to convenience, which itself should not be disparaged when people are helped to perform worthwhile or profitable tasks. .. .. , ,. ' Q_ ,- _ Tigard Planning Commission and Planning Department December 14, 1978 f Page THREE Environmental, Social Impact We know of no changes in environmental, economic or social conditions that would negatively affect the use proposed by our client; on the contrary, the accelerated growth of the ,, . area and the positive planning policy implemented to regulate, refine and channel growth are, in our mind, important indicators • that environmental, social and economic conditions are supportive .. of the proposed use. I .. Impact on Neighborhood. The proposed use will of course have an impact or affect upon the surrounding area. No development of vacant property regardless of use can fail to have an effect. Here, however, the impact will be unquestionably positive. The traffic genera- tion is minimal, as discussed below, hence the development of this use will, to the extent it precludes a higher generator ,, from using the site, be beneficial. The character of the service offered by Avis is environmentally unobtrusive and is supportive of the social and business interest of the adjacent uses and occupants. There is, in our minds, no detriment accruing from . the proposed use. ` Utility and Services Impact The size of the parcel and proposed use will not have a significant or discernible affect upon public service and will certainly not burden them. While, as in all commercial areas, some surface drainage may occur due to paved parking, it is not more than would be developed by any other use. The close proximity of a storm sewer and other utilities will make any impact on exist- ing roadways and public improvements minimal. The low incidence of vandalism and other police related problems at our other Avis sites including the present location in Tigard leads us to believe that regulatory functions such as police and fire protection will be used at a minimum. Traffic Generation Perhaps the most startling (unexpected) information about ' the proposed use, considering the vehicular nature of its service, is the low incidence of traffic. The traffic at the Avis sites is generated by three primary sources: a. Customers C b. Employees . . c. vendors The customers presently account for a daily average of 10 rentals. The 10 rentals involve delivery and pick up of the driver of the , • • . o ti Tigard Planning Commission and Planning Department December 14, 1978 Page FOUR rental and the rental leaving and returning. In all, there would be about 20 ingress and egress activities (the equivalent of 20 vehicles per day) . (Actually, the true average is less because the driver often parks his vehicle at the site and does not therefore account for as many arrivals and departures. Employees and vendors combined, account for another 10 vehicle equivalent considering both ingress and egress. The net result is an estimated 30 vehicle per day traffic generation. This average is 30% less on Saturday and 80% less on Sunday. There is no "peak" time for traffic although 70% of rentalw occur in the morning. Other than that, we have no data to indicate that there are times of peak activity. Only very rarely will two vehicles leave simultaneously, hence, the typical ingress or ^..egress activity is a single vehicle without others "pushing" it. If such simultaneous activity does occur, it would probably be about 8:30 a.m. At the proposed site, there is expected to be an increase (in rental only, ie. , customer activity) in traffic volume of about . ' 10% to 15% over the above-stated figures. Translated, it means that we expert 2 to 3 more rentals per day at the new site than we have presently. Attitude and Intent of Petitioners Finally, every effort will be made to comply with each re- quirement of the Planning Staff and City officers in executing the development of the parcel.
