DOCKET: CU 31-76 (Davies) REQUEST: To locate a professional and commercial office building , • in a C-4, Neighborhood Commercial zone. LOCATION: On S .W. Pacific Highway south of S .W. McDonald Street (Wash. Co . Tax Map 251 10A, Tax Lot 203, 205) . APPLICANT: M.A.B. , Inc. and Robert Davies BASIC FACTS : 1 . The site is designated "Residential-Commercial" on the Tigard Community Plan and zoned "C-4, Neighborhood Commercial . " 2. Section 18. 32.020 (9) permits "Doctor or dentist and professional or commercial office" as a conditional use in the C-4 zone. II , FINDINGS : 1 . The applicant is requesting permission to locate a 10,000 square foot general purpose professional and commercial office building to house the administrative offices as well as a sales office for the Bill Snyder Realty Company . 2 , The site slopes gently up, away from Pacific Highway, 3, The surrounding land uses are a service station , small quick-stop grocery and convalescent home . , . 4 . An office is generally considered a low traffic generator and is of the type to be encouraged to locate along Pacific • Hlghway. All new traffic will utilize existing curb cuts, 5. Section 18 . 56 of the Tigard Municipal Code requires one parking space/350 ' gross 'Moor area. The site plan shows 41 parking spaces available whereas 29 are required, 6, The site plan shows on-site drainage to be surface drained, The Director of Public Works has stated that this is inadequate . The Highway Division of the Oregon Department of Transportation requires outfall permits to place drain water into the highway right-of-way, They reviewed the request on 10/26 and have stated that a 12" pipe outside the curb be connected to the storm sewer in S .W . McDonald. This requires catch basins within the site , 7. The site plan shows a nYaw free standing sign but no dimensions or materials are provided, The sign should be architecturally compatable with the building. The proposal conforms with the Tigard Community Plan by utilizing existing curb cuts and being low traffic generating. 2. There is a public need to locate low traffic generating uses instead of higher generating ones along S.W. Pacific Highway and this particular site is not adverse to the type of use proposed. 3. The proposal will have minimal impact on surrounding uses and less of an adverse impact than other uses allowed in the C-4 zone. IV. STAFF RECOMMENDATION: , To be advised. Nature of Proposal The conditional use is sought for a general purpose, professional and commercial office building to be located on • the site. The C-4 zone requires a conditional use for this use The primary initial tenant of the building is proposed to be the administrative offices of The Bill Snyder Co. , residential real estate brokers. The Bill Snyder Co. presently ' has over 15 branches within the metropolitan area, and the office will serve as administrative offices as well as a branch office for Tigard. It will replace the existing building used as a branch office now on the site. 2. Conformance with Comprehensive General Plan The project conforms to the comprehensive General Plan Designation for the site in that it is within an area designated y ' on the Plan as "Residential--Commercial. " The Residential-- Commercial area is intended to accommodate a range of compatible ly" office and business uses. The proposed two-story office '' building for an administrative office falls exactly into ' this type of use and will be exceedingly compatible to the overall development of the General Plan area. 3. Community Need and Public Benefit The following community needs and benefits will be provided by the conditional use and construction: A. The administrative and general office building • will provide a low traffic, commercial use along a 1 very busy highway that will not need additional direct access onto Southwest Pacific Highway. B. The administrative offices will provide approximately • 15 to 20 new administrative and clerical jobs to the Tigard community upon completion of the building. C. The attractive new structure will be of benefit to 71 the environmental impact the commercial district has upon the community. O. The conditional use will fill a need for a privately owned commercial office that cannot be met in the larger tracts in the industrial area. . . Changes That Would Justify Request The conditional use will require less traffic flow than uses allowed outright. 5. Location More Suitable This property has been owned and used by applicants for • over 10 years for a real estate office, and they now desire to construct the office building that has always been planned for the site. The use has been an outright use until the amendments to the zoning ordinance were exacted to make it a conditional use. Therefore, other sites have not been considered. However, the site has good access, all public utilities, and it is planned as requested. iApplicant is not aware of any better site. 6„ Impact Upon Adjacent Sites ' No adverse impact different from authorized uses, although the conditional use will provide less traffic , thrcugh and across easements and thus less congestion than the permitted uses. 7.
