This license, given by the City of Tigard, entitles Consolidated
Supply Corporation (hereafter "grantee"), their successors and assigns, to

the certain limited, described uses of the real property described in

Exhibit "A", which will hereafter be referred to as "the subject property".
The subject property is a portion of a dedicated but undeveloped
and unaccepted public street right-of-way. By this license the City of Tigard
grants to grantee the rights to make the following uses of the subject property:
1. To park cars, c,-ucks, and other machinery. (This right
includes the right_ to pave, to mark the pavement, to
14; construct curbs, and like such other improvements and
alterations to the land as may be reasonably necessary
to facilitate the described use and to meet relevant
requirements of the Tigard Municipal Code and such
land-use requirements and limitations as the City
may impose from time to time.)

3. To place upon the subct property piping, wiring, meter
boxes, and such other similar ancillary equipment,
machinery, and supplies as may be useful to any legal
busineso or residential use of the adjacent parcel
described in Exhibit "Li", which is hereby incorporated,
The limitations on this license include the folloWing:•A. If at any time the City or any other government or any person,
partners%ip, or corporation proposes the opening, improvement,
ot governmental acceptance of the subject property as an
improved public street or road, grantee shall remove at his,
expense and within 90 days of receipt of written notice to
do so from the City any curbs, fences, walls, berms, trees',
or other impediments to the opening of the subject property
for public travel, (The City shall not give the described notice
'until it, has authorized the improvement of the subject property
as a public street of road and satisfied itself as to the
proposed developer's good faith intent to make the improvement
and his or its capacity to accomplish the project.)
The opening, imtirovement, or governmental acceptance of the •
subject property as an improved public street or road shall
not give rise to an action or suit for damages to grantee,
their successors and assigns. It is specifically agreed by
grantee that if the opening, improvement, or governmental
acceptance of the subject property occurs any violations of the
land-use regulations of any government caused by the loss of
use of the subject property shall be the responsibility of grantee,

their successors and assigns, and they shall take such action
as may then be required by relevant laws and land-sue
regulations, without costs to the City or any other government.
B. Grantee accepts responsibility for the care and maintenance
of the subject property, and agrees to hold the City and any
other government harmless from any claim arising out of the
maintenance of the subject property, its condition, and the
operation, condition and maintenance of all equipment,
supplies, structures, and artificial conditions placed
upon or created upon the subject property.
C. This license shall not entitle grantee to use of the
subject property for the purpose of providing access to any
tract of land other than that described in Exhibit "B".
D. This license shall expire 99 years from the latest date k, -

The question of whether a landscaped island would be an impediment
to access by fire equipment was raised. Ken Fuglee of the Tual-
atin Rural Fire Protection District stated the are no applicable
standards He did not feel a landscaped island would present an
impediment to fire equipment.
Concern was expressed that if the staff recommendation to eliminate
�. condition No. 1 of April 13, 1978, be approved, the applicant
would not thereby be relieved of providing a berm and landscaping
along Hall Blvd.
Wood moved that condition No. 1 of April 13, 1978, be modified
to read:
"That a berm be provided along the Hall Blvd. frontage
and a landscape plan for the berm be submitted for design
review approval prior to approval of the final plat."

Wayne Morris on behalf of Southern Pacific, spoke in favor of the con-
ditional use add in opposition to any requirement (condition No 6 of
the staff recommendation) that the applicant dedicate 30 feet of right

(principally because of Fire Department objection to long cul-'le-sacs) .
He doubted the 30-foot right of way along the west boundary would ever be
developed because of the cost, estimated by Robert Mayer, PE,at $175,000.
Karl E. Neupert, President of Consolidated Supply Co., reviewed the history
of his company. He stated his desire to mow his two Portland locations
and the company's headquarters onto this one site in Tigard. He out-
lined the nature of the business done and told what kind of material
would be stored in the outside yard.
Stewarttill, ageoteehnicalengineerof -Hill, reported on the soil

conditions and geology of the site, His company's study indicated no
physicel obstacles to the development as proposed.
Ron Adams, attorney, summarized the previous testimony and spoke against
the requirement for a 30-foot street dedicatirn as called for by staff
recommendation No. 6. He pointed out that the applicant does not need
either the 30-foot street dedication requested, nor improvement of the
30-foot unimproved public right of way along the west boundary of the
tract for circulation on or through its property, He suggested the owner
of the property on the north seek access to his property across the
Burlington Northern tracks from S. W. 74th Avenue via a PUC temporary
pertit.

property spoke in opposition, He stated he is able to get only a revocablt
permit for access to his property across the Burlington Northern tracks,

his property. H was asked by the Commission if he would beat the cost
of improving the 1600 feet of unimproved right of way. He said he could
not comment on that at this time,

opposed to only the north, end, might be. Mr. Neupert
stated they had not calculated the cost , but were desirous
of avoiding qny unnecessary cost , and that they felt the
sight barrier on the east and west property line (except
as required to protect th view from Mr. Cresby 's property
on 74th Avenue) to be unnecessary because of the unique
location between two railroad embankments.

Burlington Northern railroad tracks, nor411 of Upper Boones
Ferry Road (Wash. Co. Tax Map 2S1 12D, lax Lots 2800, 2900,
3000 and 3100) .

I . Findings of Pact:
1 . The subject parcel is zoned M-3 and is designated on the NPO
#5 Plan as "Light Industrial. "
2. The applicant is requesting to develop an outside storage area
to accommodate space needed for supply and equipment that is
related to the type of business on the subject site.
3. Section 18.48 . 020 of the Tigard Municipal Code states, "Any
business, service, processing, storage or display essential
or incidental to any permitted use in the M-3 zone and not
conducted entirely within ar, enclosed building" , requires a

conditional use permit to be authorized by the Planning
Commission. "

4 . The subject site (public work portion) is presently being
• improved as part of the subdivision project by Southern Pacific
Transportation Co. which was approved on August 9, 1978.
5. The adjacent uses surrounding this site to the north, east and
south are light industry. West of 74th Avenue is open space
and industrial park as shown by the Neighborhood Plan *#5. Urban
low density residential is shown -farther to the west beyond
the open space.
6. The applicant is proposing fifty thousand (50 ,000) square
feet. of warehousing, ten thousand (10 ,000) square feet of
office and four thousand (4,000) square feet of showrooms
7 . This site is in a wetlands plain which will require proper
drainage improvements.
8. This industrial subdivision area i8 expanding the land use
designation. The area is prime for this type of use due to
its location to collector, arterial, and highway connections,
The internetwork of streets will need some extension and
imprnvements to accommodate further industrial use growth.

9 . At present, the public work improvements include a four
hundred and sixty-five foot cul-de-sac terminating
approximately one hundred and ninety-five feet east of
applicant 's most westerly property line. The applicant's
most westerly property line is adjacent parallel with an
unimproved thirty foot public right-of-way running north
and south from the most northern property line of tax
map 2S1 12A, tax lot 1800, south to Fanno Creek Place
approximately 3,450 feet.
II. Conclusionary Findings:
L. The storage area should be defined to allow adequate space
but hot to restrict proper vehicle maneuvering.
2 . The storage grounds should be improved with adequate asphalt
to support the heavy storage use.
3 In considering the long range potential plans of the applicant
to increase his business and the future development of the
4,40 acres north of the subject site (lots 1600, 1700 and
1800) more heavy vehicle transportation is probable and
•
therefore, expanded circulation system will be necessary.
4 . Eliminating the distance of large, heavy vehicles traveling
along a two lane 30 foot right-of-way for approximately 3/4
o a mile is desirable for the interest of health, safety and
welfare for the surrounding property owners and drivers.
• 5. Increasing traffic circulation where a concentration of large
heavy vehicles frequent is also desirable to offset traffi:!
congestion, and distribute traffic movement in all possible
directions.
•
6 The Traffic Safety Program researched by CH2M Hill and
adopted by the City in June 1970, states:
"Streets can and should be designed and constructed to provide
the desired level of service. That is, traffic flow can be
stable, safe and efficint„ with consideration of such factors
as speed, travel time, freedom to maneuver, traffic interruption,
driver comfort, and convenience. To satisfy these conditions,
a balanced street network is necessary. "
7. The proposed extension of the cul-de-sac to the perpendicular
30 feet right-of-way west will provide for increase level of
Service that will comply with the traffic safety program.
8. Section 18.72.010 of the Tigard Municipal Code states :
"In granting approval of a conditional use the planning
commission may r*.quire, in addition to the regulation and

found necessary to protect the best interests of the
surrounding property or neighborhood or the city as a
whole. The conditions may include requirements increasing
the require2 lot size or yard dimensions, controlling the
location and number of vehicular access points to the
property. "
III. Staff Recommendation:
Staff recommends approval subject to the following conditions :
1. That the storage area be defined in its size to the approval
. of the Planning Commission.
2. That the site construction and drainage plans (especially
in regard to the wetland condition) be submitted aid approved
by the building department prior to issuance of permits.
34 That the storage yard area be paved to the standards of the
building department prior to final inspection of the warehouse.
4 . That a site obscuring fence be placed around the storage
yard (type and height) as determined by the Planning
Commission (see 'V 13-78) .
5. That the height of the outside storage above the screening
be determined by the site design planner.
6. That the applicant dedicate 30 feet of right-of-way along the
southern portion of the property from the end of the
cul-de-sac to the most western porti9Aof the property line.
7. That the applicant be permitted to eliminate 20% of the
parking spaces per the Tigard Municipal Code, Section 15. 04,
to compensate for the expansion of the 30 foot right-Of-way
dedication.

Another aspect that is to the benefit of the public and
related to environmental concerns is that Consolidated
Supply Co. is a clean industry which does not produce any
adverse conditions such as pollution.
4 AS for any environmental changes, there are no major fea-
tures that will have to be altered except for the addition
•
of some culverts to maintain proper site drainage and
placing some fill to make the site ready for corwtruction.
Consolidated Supply Co. is aware that this property is in
a designated wetlands area as defined by the City of
Tigard. They have retained CH2M Engineers to conduct a
soils and hydrology report to determine if any conditions
exist that will need to be in conformance with 7igard's
Flood Plains and Wetlands policy.
• The tree coverage is minimal as illustrated on the enclosed
tree survey. Consolidated Supply Co. plans to provide
landscaping around their office and parking. The removal •
of any substantial trees will be replaced within these
•
planned landscaped areas.
The economic conditions directly affecting the site that
. justifies the requested action is the increased tax
revenue for the City of Tigard, and the potential for
employment within Tigard. Both of these points will
increase with the growth of the company.
There should be no changes in the social conditions and/or
changes in availability or public services or access,

and/or any other aspect of community development directly
affecting the subject site. Most of these sewer connec-

tions planned for the property will be the responsibility
of Consolidated supply Co.

6 . The adjacent uses surrounding this site to the north, east
and south are light industry. West of 74th Avenue is open
° space and industrial park as shown by the 'Neighborhood
Plan Number 5. Urban low density residential is shown
farther to the west beyond the open space. Therefore, the
impact or effect that the proposed development will have
upon adjacent sites, occupants, activittes, or on im`nedi-
ate neighborhoods is minimal. With the site' s proximity
to the I-5 Freeway and Highway 217, the ease of access by
' truck minimizes the use of inter-city streets for such
heavy commercial traffic. Also, the services of Southern
Pacific Railroad contribute to making light industry and
Consolidated Supply Co. the best use for the property.
With both the proposed Southern Pacific Railroad drill
track on, the east, and the Burlington Northern Railroad on
the west, the property will be blocked visually from the
adjacent uses and any pedestrian or vehicular traffic along
these boundaries by the elevated railroad tracks. Consoli-
dated Supply Co. has planned a security fence around the
perimeter of the outdoor storage area.

protection will be necessary. Consolidated Supply Co. ,
however, will have the necessary fire protection within the

Southern Pacific Railroad is providing a forty-four (44)
' foot wide road, Kable Lane, into the Southern Pacific

. cul-de• sac at its terminus. Consolidated Supply Co. will
be making a curb cut-off of the cul-de-sac to allow vehicular
and truck access onto their property. Consolidated Supply
Co. will be responsible for this necessary construction
and all costs involved.

. As for any impact upon the schools or parks of Tigard,
there are no negative aspects; however, a positive aspect
, is that the development will increase the tax base.
The employees of Consolidated Supply Co. will have the

seventy-five (75) cars as requested. In accounting for

Consolidated Supply's application for its light industry sub-division. •
COMMENTS :
1. In regards to the schematic site plan and layout of proposed
functions (parking, storage,/ warehouse, office and showroom) ,
the question of altering their position was discussed with •
you on the phone. It is our understanding, if the site plan
is approved by the Planning Commission, we have the flexibility
to alter the position of the above items if they are within the
restrictions of the code and zoning regulations.
2. Any modification that increases the square footages after the
; . October 17th Planning Commission Meeting will have to be re-
viewed again. However,/ any reduction in square footages will
not have to be reviewed.
3. At this time, our program requirements are 10 ,000 square feet
• of office, 4 ,000 square feet of showroom, 50 ,000 square feet
of warehouse and some outdoor pipe storage. As per the code,
• we have arrived at the requirement of providing parking for
90 cars.

SUMMARY OF PROCESS:
1) Pick up necessary application for light industry subdivision
land use in a M-3 zone with a conditional use permit.
2) Draw desired site plan.
3) Locate 6" diameter trees on an aerial photograph.
4 •
4) submit an 81/2" a 11" tax accessors map of stated property and
documentary proof of ownership.
5) Set up an appointment with Mr. Pete Green (with two copies
of site plan and aerial photograph) to review requirements
as outlined in Title 18b Zoning before September 27,
reEtlata.
6) Review conditions stated by Mr. Pete Green and Mr. Ken Selby.
Pay fee of $425.00 ($325.00 for development of light industry vision on a vacant parcel aid $100.00 for conditional
use of outdoor storage of pipe before September 27. Verify
placement on October 17th Planning Commission Agenda.
, 7) Submit a letter of justification for light industry sub-
division. (Review with Mr. Ken Selby'
8) Submit a letter of justification for conditional use. (Review
with Mr. Ken Selby)

submit fourteen (14) copies of preliminary plat showing
office, show room, warehouse, parking, access, and outside
storage. These drawings will be reviewed by Mr. Green and
Mt. Selby who will submit a staff report with the drawings

PRESENT SITUATION
6, We are proceeding with the application and site planning. We
have ordered an aerial photograph from Spencer Gross to plot,
the 6" diameter trees on the site After reviewing with you
next week a preliminary site plan, we will finalize the drawing
and set up an appointment with Mr. Green to pay the necessary
fees, review the site plan, and reserve a spot on the October 17th
agenda.
