Our plans for the use of this property remain unchanged. That is,

A substantial amount of architectural work has been done, and dis-
cussions are taking place with potential building tenants.

o Wood asked if there are two cuts on Durham
Road. Did the Council approve road after the
Planning Commission determined no need for it?

family houses would not be downgraded by duplexes .

Tepedino agreed also, because of lack of opposition.
o Goldbach also agreed.
o Sakata disapproved of the way things were handled
with previous street dedication - the McCoys lost
land with nl return.
o Popp agreed with staff that it is not good planning
to put a duplex there but because of all the above
agreed for duplex on lot 6.
Goldbach moved and Sakata seconded for approval,
based on staff findings, omitting #1 and adding #3,
lot 5 to be single family.

A. Staff Report
Laws presented background: Condition 02 needs
clarification, "paving to City standards of maneuver-
ing areas. " Applicant thinks maneuvering area
was only entry and circumference of site. Staff
understood that all areas other than actually
between speakers were to be paved.
B. Commission Discussion and Action:
o Tepedion recalls discussing queing-up of cars
in and out. He didn't recall paving of stall
rows discussion.
o Wood asked what purpose might we require paving
of stall rows for.
o Laws ..tated that the applicant should pave the
area that the DEQ uses.
o Goldbach stated that the applicant doesn't have

o Laws stated that by not requiring paving of all

I. Findings of Fact:
1. The site is designated "Residential-Commercial" on the Ti-
gard Community Plan, 1971 and zoned "C-4 , Neighborhood. Com-
mercial" .
2 . Section 18 .32.020 (9) of the Tigard Municipal Code permits

"doctor or dentist and commercial or professional office"
as a conditional use in the C-4 zone.
II. Staff Findings:
1. The applicant is requestifq permission to construct a 7,430
• s, square foot general purpose professional and commercial of-
. fice building. The applicant has stated that potential
leasees would include a dentist, lawyer, title insurance
company, and a beauty salon operator.
2 The site is a flab, vacant parcel, fronting on the corner
of 105th and McDonald Streets. Surrounding land uses are a
Seven-Eleven store to the west, a Sears Credit Office to
. ? the north and across McDonald Street, apartments to the
east, and the Tigard Care Center to the south. •• •
3. Section 18.60.120 (4) (f) of the Tigard Municipal Code re-
quires one parking space/350 feet gross floor area. The
. ) site plan envisions 27 parking spaces available, whereas
21 are required by code.
4 . An office is generally considered a 1ow traffic generator,
and this use would be compatible with the existing uses

This narrative ire lb reference to a structure which my client, Atrium Homes, pro.
poses to build on tax lot 204; that being the southwest corner of the intersection •
• of S. W. 105th Street and S. W. McDonald Street.

This property is zoned C-4 at this time ana we would like to exercise the conditional
use option of this zone. The project, as we propose it, would be given over primarily
to professional and office use with the remaining space to be used as Neighborhood
Commercial zoning allows. We have been in contact with a lawyer, a dentist, a title
insurance company and a beauty salon operator who have expressed interest in our project
aid indicated satisfaction with the location and preliminary design of the building.
Our site was chosen for a number of reasons. The primary reason was the availability
of the land in proximity to existing projects of a similar nature. It i,s a site which
will give itself to this development with a minimum amount of site work and demand a
minimum from local utilities. The site and the project is, we feel, completely come
patible with what has recently been done on sites nearby. Tax lot 203 has recently
accomoc aced an office structure for Bill Snyder Realty and the new Sears area offices
are be/►ng installed direce y across S. W. McDonald from our project.
We feel, that the following illustrates the advantages that our conditional use would
give over the C-w zoning:
•
1. Lower density and therefore lower traffic use, noise, and pollution.
• 2. Lower demand for water and sewer facilities.
3. Less sign competition as all businesses would be within the "Office
Complex" rather than individual signage.
4. Would be in character with adjacent uses and could tie-in to existing
offestreet parking, paving, and landscape patterns.
5. Less in-andeout traffic, therefore less congestion at access and egress

to property perty and less use and congestion on Highway 99W.
6, Our project will provide a moderating transition between the residences
across S. W. 105th and the heavily-used 7-11 store adjoining our west
y' property line.

h ,► Of all the surrounding properties we feel that the most sensitivity should be given
to the adjacent Tigard Care Center. Our building will be approximately 104 yards from
the Care Center's main building and will be separated by an existing parking area and
planting beds.

As I have previously stated, our project should use lees water and sewer capacity
than would a project built to the zoning allowed, Also, due to the "professional
Office" aspect I would expect less necessity for police or fire protection due to
lower use.
I feel we have shown that this project would bring more business to an area which
has proven that this type of building is feasible. It will lend itself to the exist-
ing urban fabric more than would a higher-use commercial center of the typ,, allowed.
