The Planning Director of the City of Tigard has made the following findingst 1 . That in order for Larry Grayson, the developer of Kneeland Estates, to commence construction on his project, pursuant to conditional use CU23-80, the appeal filed by Tualatin Development Co. , Inc. , as a result of the planning Commission hearing held on January 6, 1981, must first be disposed of. 2. Among other issues raised in its appeal, Tualatin Development Co. , Inc. objected to the increase of traffic within TDC' s Copper Creek development (ZC 1-80 and S 3-80) inasmuch as TDC' s access to Durham Road is temporary only and is due to expire on September 20, 1982. 3. That substantial financial damage will be done to both Larry Grayson and to Tualatin Development Co. , Inc. if: (a) Grayson' s project is delayed, and (b) if access to the Copper Creek project is terminated before all residences in both projects have been readied for occupancy. The moasure of damages is unestimated at this time because of the anticipated increase of traffic flow in both projects. 4. There is a public need to commence construction of the residences as soon as practicable in both Kneeland • Estates and the Copper Creek development. The Planning Commission has approved all that is necessary to be approved • 4, before construction of these structures can be commenced . -1- kj 4 4,0025--Y , 14 L (71-, 21=-11cc:7 - • 4, , . 1 . 5. It is in the public interest to maintain - during the course of the construction of each project - the integrity and the distinctions between Kneeland Estates, on one hand, and the Copper Creek development, on the other. , Not to maintain those distinctions in the character of each 4 respective project could very well lead to a diminution of market value of the property in either project. Because of the increased traffTh flow, it will become necessary to develop a Local Improvement District which will initiate traffic studies from SW Serena Way at Pick's Landing and Kerwood Estates east to the intersection of Hall Blvd. and Durham Road. This traffic analysis will be an important part of the formation of a t . Local Improvement District. 7. When both ) rojects have been completed , there will be a total of . iving units available, plus an additional five units in Lot 116 of the Copper Creek develop- ment plan [ approved by the City of Tigard , 9/20/80] within the next three years. This may materially affect vehicular ; traffic on Durham Road and on all access roads feeding Durhaw. Based upon these findings, the Planning Staff concludes: 1. In order to maintain the integrity of the character of the two respective developments. Kneeland 4 Estates and Copper Creek, the temporary access to Durham ey Road, which is presently centered -2- L -713C, 110 feet West of the Northeast corner o2 Copper Creek Development • shall remain available as a temporary access until changed through the L.I.D. process. 2. It will be important to form a Local Improvement District, an integral part of which will be a thorough traffic analysis to develop traffic data from Std Serena Way at Pick's Landing and Kerwood Estates east to the intersection of Hall Boulevard and Durham Road. A primary issue of this traffic analysis would be to resolve whether or not the temporary access at Cooper Creek, which is described above, should r i 4 or should not be made a permanent access. IY i 3. The present temporary access will exist for a period of time of at least two years from the date approved of construction plans for public improvements in Cooper Creek :. 4' 4. COPPER CREEK (ZC 1-80 and S 3 .80) The Tigard City Council at a regular meeting held February 23, 1981 agreed • to the following conditions relative to development of both Kneeland Estates • and Copper Creek. 1. The "temporary access" to Durham Road for Copper Creek is to remain in effect for two (2) years from this date, plus the time it takes to complete the improvements to Durham Road following the formation of a Local Improve- ' . ment District (LID) for this purpose. This LID shall be initiated ); from SW Serena Way at Picks' Landing and Kerwood Estates east to the • intersection of Hall Boulevard and Durham Road. A complete traffic analysis will be an important part of this LID. A primary issue to be addressed is the resolve of this temporary access for Copper Creek. The decision whether or not to make it a "permanent access" or to close it 1' ` will be made through the LID public hearing process. In the interim, • Tualatin Development Company, Inc. has agreed to make a declaration on each deed in Copper Creek that this access is "temporary" and m,ay be :-, closed at a future date. The access is to be posted as "temporary" until the issue is resolved. ' N . It is the intentof theCity Council to ensure that adequate notice is given . to each future owner of land in Copper Creek, that the access to Durham is subject to change in the future and that they will abide by the final decisions reached through the LID process. �' 2. He warned we will have to change our thinking about density, predicting Tigard would have 25,000 residents by the year 2000, and 750 square foot units within three years. There was a general discussion of traffic, density, fencing, .school capacity, degredation of Cook Park and drug abuse there and around the high school. This complies with compehensive plan for conditional use in R-7 zoning, We are asking for one dwelling unit for a minimum of 5,000 sq. ft. lot area. This would be zero lot line housing with each unit being sold separately, An additional application for minor land partitioning is being filed together with this application to accomplish the zero lot line concept. There is a need for quality housing at affordable prices in this community which can only be accomplished by these or similar concepts at today's high costs. There is a slight increase in density resulting in better utilization of utilities • and public services. Very little additional impact will be felt on adjacent sites or neighborhood activities. This site is newly developed subdivision designed with the capa- % ' bility of handling these additional dwelling units in both traffic and utility areas.
