Main Street, Tigard, OR 97223 Re: Re-submittal f CU23-78 } Dear Sir: Since approval of SIERRA Subdivision(CU23-78) November 7, 1978, and a conditional use for duplexes thereon, we have completed the boundary survey(copy attached) , and more accurately located the actual contours in the field. With this more complete data it is evident that we can improve the plat as originally sub- f mitted. The changes asked for apply to the same number of lots (5) , but re-shaped to 65 foot width and 160 foot depth to facil-- • I itate better ove, all use of the land than would be possible by ' just following the present 100 year flood contour(156° ) for the rear lot lines as originally proposed. This would cause the rear of the lots to extend approximately 30 feet into the flood plain, but would move the whole 5 lot subdivision some 124 feet further West and on to better buildable topography. The engineering has been completed and will be the same except for the location of sewer laterals per lot lines. (Street, Storm, Drain, and Sanitary Sewer plans and Profile are also enclosed only for your preliminary reference. ) None of the conditions as set out in ' the original approval will be changed. Thirteen copies of the revised plat will be submitted. Commission Discussion and Action: • o Smith asked about the positioning of the townhouses. o Hartleb stated that there were limits to creativity in order to maintain low cost units. o Wood asked why staff wished removal of the landscape islands? Stated that it was possible to close the street and place a hard surface under the landscape atea to provide for an emergency access. o Smith disagreed with staff on the removal of islands. Thought that it was better to have maintained islands than no islands at all. Stated that it was invalid to plan around emergency vehicles and police accessibility., o Brian was concerned with Smith's reply on: islands and accessibility for emergency vehicles. Thought it was a good development. Agreed with the deletion of #7. Thought 1. lot 14 as additional open space was good and the hard surface under the landscaping for access was good. o Speaker thought the landscape islands should remain. o Helmer was for the removal of the islands. • o Brian pointed out condition #8 for the maintenance of the landscape islands re: the homeowners agreement. o Wood agreed with Smith, Speaker and Brian. o Wood moved for approval with the staff conditions 1-11 as written with the deletion of #7, modification of #8, and the addition of #12 & #13. 8) That a covenant credting a homeowners association be provided for the maintenance of the open space and / landscape islands to the city's satisfaction. This item was tabled by the Planning Commission on September 5, 1978 to allow applicant tha time necessary to redesign the duplex lot location away from the flood plain area. 2. The applicant is resubmitting a design showing five units (instead of the previous seven) all which are totally above the flood plain contour. 3. That the proposed number of units are less than the allowed number per acre (four units ner acre x 8 .32 acres 33 . 40) . 4. That a duplex as defined in Section 18.20.020 of the Tigard 11; Municipal Code is an allowable conditional use in an R-7 zone. 5. The site is currently zoned R-7 and designated Urban Low tensity - on the NPO #7 Plan. • 6. Bartel stated access width would be 30 feet for common wall units. The adjacent development to the north is • required to have the same access width so the proposed access roads will line up. Stated that there was a • possibility of through automobile access but it had not ' been discussed as to whether or not that info.mation would be recorded on the final plat. D. Staff Recommendation: 1. The Greenway shall be established as the backhoe of the open space network and when a direct public benefit can be derived, i.e., when adjacent residential development, the Greenway should be developed for passive recreation and pedestrian/bike travel. The drainageway contains several large specimen fir trees as well as other natural vegetation. Since the surrounding land was used for farm cultivation, these trees represent the only significant vegetation in the area. The extensive grading that would be necessary for Phase III could • be detrimental to their survival. 4. That the proposed number of units are in keeping with the allowed ' number per acreage. 5. That a duplex as defined in Section 18.20.020 of the TMC is an allowable conditional use in an R-7 zone. 6. The site is currently zoned R-7 and designated Urban Low Density on the N1,) #7 plan. II. Tigard, Oregon 97223 4 Dear Sirs: . • In addition to the initial letter submitted August 40, 1978, , on SIERRA Subdivision, a narrative more specifically addressing .y . your conditional use pints follows : . , 1. The nature of the proposal is to request duplexes in a residential zone as required in Chapter 18.20.020 of the Municipal . Code: Conditional uses in an R-7 zone. (1) Duplex residential, with , a minimum lot size of ten thousand square feet: one duplex per lot; • 2. Duplexes in a residential zone compliment the Comprehensive ) Plan. The Tigard Comprehensiye Plan has as objectives in urban . low-density reaidentiall (1)' To provide areas of the city having a predominately single-family residential character, (2) To permit . , densities 'ehat will economically support the cost of necessary . public services and facilities, such as paved streets, pedestrian ways, and utilities, (3) To permit a variety of housing 'hypes to - meet the needs of different family size and family income. The Tigard Community Plan allows limited mixing of housing types in e - .. the urban low density residential areas. Some mixing is appropriate • when sensitively designed into the residential areas. " 3. There is a community need to provide greater diversity of housing density than supplied by single family units alone. Duplexes are one answer to this problem. Duplexes supply residential shelter •. • at more reasonable prices while protecting the basic character of . ., the neighborhood. Such an alternative helps supply the demand by the elderly with redtced financial capabilities so that they can continue to live in the community as well as take care of younger III couples and working single people as they move up the economic ladder towards home ownership in the community. The Tigard Housing Plan adopted in April of 1977 recognizes that current community plans and long term housing trends are clearly in conflict with : regard to the future balancing of demand Fad supply in this regard. Duplexes represent the most residential and innocent method of , answering this need at this time and in the area under consideration. 4. There are no environmental, economic or social condition changes that affect this requested action beyond those that are present with single family residential units. 5. The proposed land use is more suitable than other locations in the City because it best meets the conditions usually recommended for duplexes. For example, within the urban low density residential area, duplexes are recommended on lots less appropriate for single family homes. These would be along major thoroughfares (collector . streets) , as buffers between schools and single family areas, . - _ 1 0 , • abutting marginal lands such as flood plain areas, etc. As pointed out in the initial letter, the subject location is along a collect- or street(Tigard Street) , it is adjacent to a future Senior High School on the West and boarders Fanno Creek and its flood plain on the South and East. To the North is future residential land(pre- sently being farmed with a single residence thereon) , but in • Washington County, not in the City. The nearest City residence is located across Fanno Creek to the East, over 400 feet away. The precedent has been set in the area for within one quarter of a mile radius there are presently six(6) duplexes located along Tiedeman--four(4) on the East side of Fanno Creek and adjacent to the balance of this property along Tiedeman and two(2) in Clydesdale Subdivision across from Fowler Junior Hogh School. Three(3) other duplex units are located West of the subject de- velopment on Tigard Street at 114th Place. 4t, • 0 6. The impact or effect the proposed development and use will , be minimal. As mentioned above, the Senior High School to be located on the West makes duplexes desirable as a buffer between such an extensive educational use and more residential areas. The County residential area to the North will be. screened from the housin4 units by any conditions established in conjunction with any duplex approval and is also across a fairly heavily traveled collector street in Tigard Street. The subdivision standards for a half street improvement will make this barrier even wider than it presently is. The remainder of the surrounding area is bounded by Fanno Creek on the East and its flood plain on the South which is not buildable land a.: ,ccupied by any residences. The closest residence is 400 ± to the East at the intersection of Tigard street and Tiedeman .-d is itself screened by many trees on its own site and is across Fanno Creek. Traffic will be minimized if some of the suggestions submitted along with the conditional use are approved. Seven duplexes will not inaxease the traffic load much more than seven full sized houses that would have larger households and enter directly on to Tigard Street with their individual driveways. A standard subdivision in this location is not the best use of the property in the above respect. 7. Public services are all available to and/or on this site. In addition, the subdivision will allow a half streeUmprovement and widen S.W.
