Forbes Representative; Lans Stout, Mackenzie/Saito Engineering, who were

Lana Stout, Planning Project Manager, Mackenzie/Saito Engineering, explained ,,

owners" Mt-. Stout, referencing condition number one of the Staff Report, stated
Tire Systems would not be making any sur-cace changes that would affect the

site in question. Regarding condition number two, Tire Systems would not be „"
;' making any outside changes, except painting, and felt, since parking was

Ed Maney, Macadam Forbes, Industrial Brokers, 5441 S.W. Macadam Ave., Portlama.
Mr. Maney informed Commit-:gion that Tire Systems Inc. had signed.a five year
lease at industrial prices and would show supporting documents if necessary.

registered with the cotporate commissioners as Tire Systems, Inc. Group
Discount Wholesalers and solicate with outside salesmen for wholesale and

Action.
The applicant, Tire Systems Inc. , proposes to ],ease a portion of an
, • existing structure for use as a tire sales and service facility.
Tire Systems, Inc. is a group discount operation, with only a
minimum of "walk,,.in" retail sales and service to the public. Approx-
. imately 8-10 persons will be employed in the areas of administrative,
s,.ples and service.
A survey of the area by the applicant revealed a lack of suitable
alternative sites for the proposed use. The subject site/
building was selected due to its current availability, good
access and sufficient total area. General upgrading/painting of
the building will be accomplished upon approval of the conditional
use requested.
2. How the Proposed Use is in Conformancewith122±0
Comprehensive Plan.
The proposed use conforms with the Tigard Comprehensive Plan in
that it is prescribed as a conditional use by the Tigard Zoning
Ordinance (title 18) , which subsequently reflects the goals and
guidelines of the Comprehensive Plan.

Need is generally established by the Zoning Ordinance through
recognition of the potential conditional use. That is, since
the conditional use is provided, it is assumed that a general
need is established, and the issue is the potential to meet the
need by the specific proposal and the specific site. This
presumption is confirmed by the Oregon Court of Appeals decision
in "Kristenoen vs. City of Eugene" . The applicant has determined
• that there is a reasonable potential for market success for the
proposed tire sales and service facility.

1. Nature of the Proposal andthe Reason for Requesting the Particular
Action.
The applic..ant, Tire Systems Inc. , proposes to lease a portion of an
existing structure for use as a tire sales and service facility.

Approx-
imately 8-10 persons will be employed in the areas of administrative,
sales and service ,
A survey of the area by the applicant revealed a lack of suitable
alternative sites for the proposed use. The subject site/
building was selected due to its current availability, good
access and sufficient total area. General upgrading/painting of
the building will be accomplished upon approval of the conditional
use requested.
2. How the Prozollilsrlisinj2lEarEariFe with Tigard's Adopted
Comprehensive Plan.
The proposed use conforms with the Tigard Comprehensive Plan in
that it is prescribed as a conditional use by the Tigard Zoning
Ordinance (title 18) , which subsequently reflects the goals and
guidelines of the Comprehensive Plan.
3 Community Need and/or Public Benefit Derived from the Proposed Action.
Need is generally established by the Zoning Ordinance through
• recognition of the potential conditional use. That is, since
the conditional use is provided, it is assumed that a general
need is established, and the issue is the potential to meet the
need by the specific proposal and the specific site. This
presumption is confirmed by the Oregon Court of Appeals decision
in "Kristensen vs. City of Eugene" . The applicant has determined
that there is a reasonable potential for market success for the
• proposed tire sales and service facility.

There are no significant changes in environmental, economic or
social conditions in the area which would positively or negatively
affect the subject site and/or proposed use. However, the
availability of current leasable space for the proposed use can
be interpreted as a need for furthering economic development in

the area. Approval of the conditional use can accomplish this
without negatively impacting public services and facilities and/or
necessitating major modifications by the applicant.

6. The Im2act or Effect the Proposed Development, Use, or Activity
will have on Adjacent Sites, ®ecupants or .ctivit,ies and on the
Immediate Neighborhood.
Y; ,,'` The impact attributed to the proposed Tire Systems, Inc. is
,J negligible, since a general impact is already established This
impact is attributed to the leasing of an existing structure for
a use similar in overall intensity to its former use. Surrounding
i.,
uses include Mini-Storage to the north, Mayflower Moving and
Storage to the west, Bakery Thrift Store to the southwest, and a service ,
, station to the south of an adjoining undeveloped parcel. None of
these uses represent a land use incompatability with the
proposed tire sales and service facility.
Traffic generation attributed to Tire Systems, Inc. would'
be similar to uses permitted in the M-4 industrial zone.
Tire Systems, Inc. does not rely heavily upon "walk-in"
business, rather, through circular advertising to selected
groups. Therefore, actual traffic impact on surrounding road
systems would be minimal.
