The President reported a COMMUNICATION from Puget Diecasting and Injection
Moulding dated September 13, which was discussed further after the public

The President opened the PUBLIC HEARINGS portion of the meeting by reading

the order of hearing the agenda items would be 5.1, 5.3, then 5,2, at the
request of Staff.

Request: For a conditional use permit to construct and operate a professional office

Previous Action: On August 21, 1979, the Planning Commission approved an extension
' of the conditional w'e for the extended height of the building.
I. Findings of Fact:
1. The site is designated"Retail Commercial' on the Neighborhood Planning
Organization #2 Plan and zoned C-3, "General Commercial."
2. Section 18.28.020(36), of the Tigard Municipal Code allows professional
office buildings as a conditional use in the C-3 zone.
- , 3. The site is a vacant, triangular-shaped parcel which is situated several :.
feet below the grade of SW Shady Lane. A large Oak tree is located
approximately west of center on the lot. Surrounding land uses are Highway
A 217 to the north, vacant land to the southeast, across Shady Lane and to
the south an insurance office and a retail store (under construction); Co
4M the west is service station.
4. The applicant is proposing to construct a three-story, 32,090 square foot
real estate office building with other professional office uses on the north
Side of Shady Lane.
5. SW Shady Laae is designated a local street on the NPO #2 Plan. There
is presently sufficient right-of-way to meet the local street standards

sidowaiks or street lig its) Y
6. Sanitary sewer and water services are available to the site via existing
lines in SW Shady Lane.

II. Conclusionary Findings:
1. Professional office operation is similar to the permitted real estate

2. The proposed use is in keeping with the intent of the commercial zone.

CONDITIONAL USE PERMIT NARRATIVE
Nature of Proposal and Reasons for requesting the particular action:
To allow a professional office building use in a C-3 zone.
The building will house Tarbell Realtors on the main floor with the
upper two floors being rented out as professional office space, thus
a conditional use is being requested for ,a professional office building
on this site.
How the proposed use is in conformance with Tigard's Adopted Comprehensive

Plan: �.
In Section 18,28.020 of the City of Tigard Zoning states In the C-3
zone the following uses and their accessory uses may be permited. . .
(30) professional or commercial office building. " Thus a professional
office building is in direct conformance with the City of Tigard's
' Adopted Comprehensive Plan by provision of a conditional use permit.
Community need and/or public benefit derived from the proposed action:
Permitted uses for a General Commercial Zone (C-3) are for the most
part retail businesses such as parts stores, furniture stores, motels
and so on Retail businesses generally create more traffic, more
people, more noise, later business hours and bright flashing signs
as compared to a professional office building where traffic is limited
mostly to employees (thus creating less traffic and noise) , working
hours are limited to "8 to 5", and no bright flashing signage. From
a retail building viewpoint, a professional office building will
greatly benefit the community and the public.
Any changes in environmental , economic or social conditions and/or changes
in availability or public services or acess, and/or any other aspect of
community development, directly affecting the subject site that would
justify the requested action.
Changes in environmental , economic or social conditions or other aspects
of community devel opment wi l l occur by al l owl nri a professional office
building on this site in lieu of a retail business. The immediatl
surrounding community will benefit from a business with shorter working
hours, less customer vehicular traffic (which will cut down on noise)
and no possibility of unwanted lights from flashing signage and vehicular
lights, The benefit for this conditional use permit will greatly enhance
the surrounding community and in no way degrade it,

The impact or effect the propos;-d development, use, or activity will have
on adjacent sites, occupants Qw activities and on the immediate neighborhood:
Adjacent properties to the site are a service station and across the
street is an existing insurance company. The rest of the surrounding
� property is vacant but zoned A-2 multifamily.
In' The effect or impact a professional office building will have upon the
adjacent properties will be lessen in lieu of a retail business
Residential areas in close proximity to the building will not have to
put up with after hours noise and traffic that a retail establishment
would create,

and the impact that your project may have on these public services:
