C, September 5, 1972, the Tigard Planning Commission dissaproved our site
development plan for 74 apartmen4- developtent units because of the adopted
Tigard Community Plan ceiling of 13 units per acre. This land, however, is
subject to a recorded memorandum of arreement dated the 17th of February019690
which provides that the city approve the issuance of permits for a maximum of
7L units and a like number of sewer service connections. Also, we have a
letter from Mr. Telfer, the City Administrator, dated July 20, 1972, verifying
this agreement and explaining the various points therein.
Our position is silnply that according to the above mentioned agreement, we must:
(a) Submit a plot plan and building plans in accordance to the Planned
Residential Development Procedure, which we have done,
(b) Improve S. W. Murdock Street from Canterbury Lane southerly to the
beginning of tax lot 4700, or make a bond in proper form covering the
cost of the improvements, which we are willing to do at the proper time.
(c) Execute a street dedication compliance agreement which we are willing
to do at the proper time.
(d) Submit Engineering for the above mentioned streets, sanitary sewers,
and storm sewers) which we are presently doing by working with the
City Engineers.
In return, we would appreciate your cooperation in abiding by the recorded
memorandum and your letter of June 20, 1972, as litigation to settle this
matter would be expensive and time consuming to everyone involved.

It appears that most of the changes that we would request, you had noted. How-
. ever, there are a few that would be required in order that it meet with our

standards and our requirements for approval. 1. You will note on the one
copy the changes in size of the storm sewer, plus we would request that the
engineer furnish to us a set of his drainage calculations showing the area •
: that was used in making the study and the figures with which he arrived at the
pipe sizes. 2. In area where it may be necessary to construct sidewalks, we
. are requesting that the ground line be carried up at a grade of 1/4 inch per

. foot to the property line and then the slopes of maximum 1 1/2 to 1 from there.
This would enable the construction of a sidewalk if necessary as well as some

of the utilities that are placed behind the curbs.
It will be necessary to change the grade of Murdock within the intersection .
with Canterbury as you will note on the profile shown on the map, so that
Canterbury will have a smooth transition through the intersection. Therefore,

construction and that the catch basins will receive the water and not be left

APPLICANT'S REQUEST
Approval of a change of zone classification for 19 acres from R-7, rt
Single Family Residential to P-R, Planned Residential Development.
LOCATION AND LAND USE OF SUBJECT PROPERTY 0 <
Tho property under consideration, which Is developed to agricultural
field crops, an orchard and a portion in native trees, is located on
the south side of Canterbury Lane approximately 400 feet easterly of
the SW Pacific Highway adjacent to the south Tigard City Limits line.
SURROUNDING ZONING AND LAND USE jai
The subject property is located on what is commonly known as Little
• Bull Mountain and the area is zoned R-7 to the east, south and west,
supporting small acreage plots with scattered single family dwellings
on land that is used for various agricultural pursuits. To the north '
of the site, part of which lies within d igard ac
Canterbury Lane, is zoned A-2, Apartment Resintal but is undevelo ed. r�
A remaining portion on the north, which is within the County, is also
zoned A-2 by virtue of a recent zone change and this too Is yet undeveloped.
APPLICANT'S JUSTIFICATION
The means of access to this property at the present time is from Pacific
Highway up Canterbury Lane, which Is a 50 foot wide road, to the property
which is designated as Tax Lot 4700. Application has been made for the ,
extension of Canterbury Lane across this property and through the ad jo'n-
Ing property, connecting to a road now developed adjoining the Tigard
Water Department tank, and thereby connecting to 103rd Street.
The attached plan shows the road circulation on the property, which has
been laid out to provide a connection to 109th Avenue on the south and a
future cor section to Murdock Street to the west.
The Tigard Water District has evidenced their willingness to serve this
property, and this property has been within the Tigard Water District for
more than ten years.
The Tigard Sewer System, City of Tigard, has from their manhole in
Canterbury Lane, run out an 8-inch stub for connection to this property, `
and this property has been assessed for sewer Improvements.
Contiguous zones to this property are A-2 on the North and R-7 on the
East, South and West.
This application includes nineteen ( 19) acres of Tax Lot 4700; density re.
quested I s for no more than 300 living units, with a minimum of 450 park-
_... Ing spaces, and Is consistent with the development as originally proposed
by the City of Tigard Planning and Zoning Department. The City of Tigard
adjoins this property on the North.

The plan development will in no way change the basic use of the land
and will be consistent with the surrounding area, all of which is
residential .
Traffic to and from the property wi I l have three means of ingress and
egress, which should result in no congestion in the area.
The development will take place over a period of five years and thus
not create any unexpected or excessive loads on any of the public
utilities or schools in the area.
This property was originally zoned, when in the City of Tigard, A-2
and you have on file from the previous zone request, copy of a letter
from the City of Tigard substantiating tnis original zoning."
PUBLIC UTILITIES REPORT
The applicant submits that the site will be served by the City of Tigard
Sewage Treatment Plant and the Tigard Water District. No written confir-
mat i on has been received from the Tigard Sanitary District as to their
ability to serve the subject site. I n response to an earlier application
a for A-2 zoning on the property, the Tigard Water District indicated in
writing their intent'to include water service to the area by means of
puny ng and the district would require a reservoir site approximately
100 x 100 at the highest point possible to provide adequate service to
the site. It was further indicated that water mains would be provided
and constructed at the developers expense under the districts specifica-

tions and supervision, provided that the property Is annexed to the Tigard
Water District,
CONFORMANCE TO THE PLAN OF DEVELOPMENT
The Plan of Development indicates residential use for the subjeci property
but does not specify intensity of such use. The proposal, therefore, is
not In conflict with the Plan,
SPECIAL CONSIDERATION
An earlier application for the subject property, which proposed to change
•l he zone from R-7 to A-2 for apartment residential , was acted upon by the
Planning Commission at their April 9, 1968 meeting. At that time, the
application was denied,
The earlier application was for a 23 acre parcel . The current app l i ca-
+i on is for 19 acres.
In support of the previous applica+ion, the City of Tigard submitted a
letter suggesting that a zone change be approved to allow multiple
dwellings to be developed on the property and stating that it was the

STAFF ECOMMENDATION
As was stated by the staff in the previous A-2 application for the property,
(Zone Change 24-68) although the City of Tigard has suggested that the
application for multiple development be approved, as being I n compliance
with the City's comprehensive plan, it is the staff's concern that certain
development criteria should be met that I s necessary to adequately serve
the higher density development. The major area of concern is the fact .
that he property nas its primary access off of Canterbury Lane. This
roadway is only partially improved to its intersection with Pacific
Highway and does not meet the County standards for County roads nor does
it adequately provide access to the subject proeprty. In addition, SW
109th Avenue which terminates as a stub street at the southwesterly corner
of the subject property, is a gravaI road, although within the County
road system.
I n consideration of the above factors, it is the staff's recommendation
that the request be given favorable consideration subject to the follow-
ing conditions:
1. That Canterbury Lane shall be fully i mpt`oved to County road standards
from the east boundary line of the subject property to its inter-
. ' section with SW Pacific Highway. The design and construction of the
improvement shall be approved by the Department of Public Works.
2. If the development is to be constructed in phases, as indicated by
the applicant's suggestion that the development would be over a 5 I,
' year period, the determination of each phase shall be approved by
the Planning Director prior to construction.
3. That the northerly prolongation of SW (09th Avenue as it extends

Mr. Robert Brown appeared from the County Health Department stating that
they would prefer the subdivision to be submitted on two separate plats
because of the area that can be served by sewer and the area that wi i l
"` have to be served by septic tanks. He stated that the Health Department
would rather have two preliminary plats submitted, one for the portion
being served by sewer and one for the portion being served by septic
tanks. i
The Commission voiced some concern as to the alignment of the
applicant can have the p
streets if some of the lots had to be developed on septic tanks. 1
Moore moved to defer action until the a

reviewed again by the Subdivision Committee and the County Health Depart-
meat and re-present the application. Mr. Busch seconded. After discussion
the motion and second was withdrawn. Mr. Brown stated tha•f the I-real+h
Department would approve the part on sewer with the conditions that
the applicant submit letters to the Health Department from the Aloha
Sanitary District, Aloha Water District, the State Sanitary Authority
III stating that they will except this annexation and from the firm installing
the line saying that they will lower it for gravity flow. Mr. Annand
moved that the application be approved for that portion on sewer system
with the conditions as set forth by the County Health Department, the
Subdivision Committee, and that a new preliminary r

Mr. Annand appeared in support of the application and presented a
petition with 7 signatures in favor of the application. Mr. Annand i
stated that the proposal consists of 280 units and that the view areas 1
for each unit will be preserved. He pointed out that the City of Tigard 1
" ' claims the right to improve Canterbury Lane to its standards and he has p
applied to them for this improvement. Mr. Annand also stated his feeling 1
that the street connecting SW Canterbury Lane and SW Murdock Street
should be a minor road and not a 50 foot street as the conditions state.
He pointed out the lot that the water tower will be placed on and
dedicated to the Tigard Water District. There were no objectors. The 1
public hearing was closed. Mr. Moore moved that the application be

During suit Annand requested right to
file for annexation and was refused.
Legal opinion was that such action
might adversely affect Tigard' s posi-
tion in suit. Annand waited until suit
was concluded and filed for annexation.
Papers disappeared and nothing was done.
COUNTY APPROVED S Planned Residential - July 2, 1968
in 4 Phases to extend over 5 years.
CITY OF TIGARD Approved proved Planned Residential,
February 17, 1969 with 151 sewer con-
nections contingent upon property being
annexed to City and Plan Review on
balance of property. Annexation was
granted March 10, 1969.
