By this letter we request a hearing before the City Council in order
to appeal the decision of the Planning and Zoning Commission on
November 21, 1967 denying our request for variance of our agree-
ment reached regarding the conthtional use granted on October 17, t.
1967.

The variance that we are requesting, is in compliance with the
reccommendation of both the State Highway Department and the •
City Engineering Department, i. e. , that a 35 foot access be
• constructed at the Pacific Highway instead of the 42 foot access
as requested by the Planning and Zoning Commission.
We believe that no safety factor is being compromised here since
the State Highway Department has stated that the 35 foot access is
adequate to handle the traffic intended.
Further, we will construct curbs, street and sidewalk to meet
State and City specifications.

Dear Mr. Huntley:
This letter is in reference to the telephone conversation
you and I had on the 17th of October. At that time we
discussed the possibility of approving access to Mr. Stan
Adkins property.
The curb cut under discussion is located just off of
Highway 99 between a Dentist's orfice and an Ice Cream
• Parlor called The Dairy Queen. At present this access is
, .
an extended curb cut, carrying an excessive traffic load,
and causing a grave traffic hazzard.
The proposed developer, Mr. Stan Adkins, plans to build
apartments on Tax Lot 1700, 1800, 1900, using the above
mentioned curb cut as access. The Tigard City Staff, and
the Plannin,4 and Zoning Commission felt that improvements
must be made before the proposed development could be allowed.
Realizing that the State Highway Department must make the
final decision as to whether or not access can be improved,
I have enclosed the recommendations of the Tigard Planning
• and Zoning Commission for said improvements.
I sincerely hope that this improvement will be granted, thus
provid:',.ng safe access for both the proposed development and
the existing facilities which also use this curb cut.

• the followinig conditions: 1. That the hump in the driveway
be cut down to match the entrance level of Highway 99. 2. That
permanent curbing be laid on the Dairy Queen side of the road,
, ) to the entrance of Highway 99, 3. That radiuses as described
on the ,drawing be put, in at the entrance of Highway 99, 4. That
concrete be laid from the Dairy Queen Curb to the Dairy Queen
wall, 5 . That the parking lines, next to the driveway and
behind the Dairy Queen, be repainted. 6. That the dimensions
and all design work conform with the drawing presented to the
Commission, 7. That the proposed development conform with
the submitted plot plan using included landscaping,
